JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
10 U.S.C. § 3204
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.3, the following facts and rationale justify the use of such authority:
1. Agency and Contracting Activity.
The Department of Homeland Security, United States Coast Guard (USCG), Office of Contract Operations (CG-912), on behalf of the Coast Guard National Maritime Center, prepared this justification for other than full and open competition.
2. Nature and/or Description of the Action being Approved
(a) Nature of the action: USCG intends to extend contract 70Z02320CMMZ00100 on a basis other than full and open competition.
(b) Name and address of the contractor:
ANSIBLE GOVERNMENT SOLUTIONS, LLC
21 Chateau Cir Wayne, PA 19087
(c) Type of action: Firm fixed-price contract, contract modification to extend current contract five (5) additional months.
(d) Contract period of performance will change by five (5) months from 03/23/2020 to 03/22/2024 to 03/23/2020 to 08/22/2024.
(e) Estimated total value (including options):
Current Contract
Description Period of Performance Total Amount Base 03/23/2020 - 03/22/2021 Option Period 1 03/23/2021 - 03/22/2022 Option Period 2 03/23/2022 - 03/22/2023 Option Period 3 03/23/2023 - 03/22/2024
02/13/2024. Delays occurred with revisions to the statement of work (SOW). During the USCG’s final SOW review, it determined that a newly-discovered need necessitated the incorporation of additional tasking into the SOW.
The additional time under this extension will serve several functions. It will allow the Government to finalize its solicitation review, permit sufficient time for vendor responses to the solicitation, and enable the Government to complete the evaluation process. No other contractor can support these services for an additional five (5) months. Insufficient time exists to solicit and award for a five-month contract. In addition, start-up costs, transition costs, and developmental costs for these services for only five (5) months would be cost prohibitive. This would also result in substantial duplication of Government cost unrecoverable through competition for such a short timeframe; furthermore, it will introduce significant disruption in services, create an increased risk in maintaining continuity of services, and likely result in unacceptable performance standards. The only way for the Government to continue these services for five (5) months at a fair and reasonable price is to extend existing services with the current contractor.
6. Description of Efforts Made to Ensure that Offers are Solicited from as Many
Potential Sources as is Practicable.
The Government will post a synopsis of this proposed contract action on SAM.gov in accordance with FAR 5.203(a). In accordance with FAR 6.305(a), the justification will be made publicly available on SAM.gov within fourteen (14) calendar days after award. The USCG’s aforementioned use of APFS timely assisted industry with identifying this procurement opportunity as early in the acquisition process as possible. Industry, therefore, remains aware of the planned recompete.
7. Determination by the Contracting Officer that the Anticipated Cost to the
Government will be Fair and Reasonable.
The contracting officer determines that the anticipated prices will be fair and reasonable in that the rates specified in the extension are the same rates as option year three (3) and have already been determined to be fair and reasonable through competition.
8. Description of Market Research.
The Government completed extensive market research in anticipation of a competitively awarded contract. Market research revealed that these services were not available through Ability One’s procurement list, Federal Prison Industries, or the Department of Homeland Security (DHS) mandatory strategic sourcing vehicles. The USCG issued an RFI to understand the availability of these services through the use of Federal Supply Schedules.
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition.
None.
10. A Listing of the Sources, if Any, that Expressed, in Writing, an Interest in the
Acquisition.
Responses to an RFI conducted during market research indicated an interest in the follow-on action among several small business vendors.
11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome
Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required.
The Government anticipates no subsequent barriers to competition.
12. Contracting Officer’s Certification.
I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
13. Technical/Requirements Personnel Certification.
I certify that this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for the justification, is accurate and complete.
