JUSTIFICATION AND APPROVAL (J&A) FOR USE OF OTHER
THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC)Norfolk
2. Description of the Action Being Approved: This is a sole source justification for work to be provided under Work Items (WIs) 0451, 0452, 0485, 0562, 0563, 0565, 0567, 0570, 0571, 0688 and 0702 of the Statement of Work (SOW) for the Regular Overhaul and Drydocking (ROH/DD) of the USS EMORY S LAND (AS-39) under contract modification N3220520C6501P00001. This Justification covers only the portion of the acquisition for which an Original Equipment Manufacturer (OEM) Authorized Facility / Manufacturer / Representative is required, and the approval level requirements will then only apply to that portion.
3. Description of Supply Services: MSC Norfolk requires OEM authorized field service technical representatives and OEM parts to accomplish requirements of the WIs listed below. The estimated combined dollar value of the eleven (11) WIs is that will be funded utilizing FY 20/21 Operation & Maintenance funds.

0451: Annual Radar Service (1 YR) 0452: Annual ECDIS Service (1 YR) 0485: Communications Equipment Groom and Service (5 YR) 0562: CCSI_SCBA Annual Inspection 0563: CCSI_SCBA Compressor & Filling Station 0565: CCSI_Fixed Gas Firefighting System Inspection & Test 0567: CCSI_Fixed Foam Firefighting System 0570: CCSI_Portable Fire Extinguisher Service (Annual) 0571: CCSI_Fire and Smoke Damper Service (Annual) 0688: Rescue Boat Engine and Drive Servicing (2 YR)
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c)(1) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsiblesources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
5. Rationale Justifying Use of Cited Authority (Unique capabilities and technical data per FAR 6.302.1(b)):
a. WI 0451, Annual Radar Service (1 YR) This work requires a Furuno authorized field service 2827S/12 and FAR 2837 radars, and radar uninterrupted power supplies (UPS). The radars are critical equipment per SMS #10.6-002-01-AS. Only qualified service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of navigation at sea. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non- OEM service and replacement parts are equivalent to the OEM service and replacement parts.
b. WI 0452, Annual ECDIS Service (1 YR)
This work requires a Sperry authorized field service Master. The ECDIS is critical equipment per SMS #10.6-002-01-AS. Per COMSC INSTRUCTION 4490.1, an OEM or OEM-authorized technical representative is required to perform or supervise

c. WI 0485, Communications Equipment Groom and Service (5 YR) This work requires the services of an ABS Recognized Specialist and OEM Technical Representative approved by ABS and USCG to perform an equipment groom in the Communications Center, and associated Antennas located on weather decks. Only qualified service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of critical communication for the crew onboard the vessel. Qualified representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
d. WI 0562, CCSI_SCBA Annual Inspection This work requires a recognized service facility and technical representative IAW ABS recognized

Incorrectly installed or deficient parts could cause firefighting equipment failure and loss of firefighting capability at sea. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.

Incorrectly installed or deficient parts could cause firefighting equipment failure and loss of firefighting capability at sea. i. WI 0571, CCSI_Fire Smoke Damper Service (Annual) This work requires a recognized service facility and authorized technical representative to service the ical equipment per SMS #10.6-002-01-AS. Per COMSC INSTRUCTION 4490.1, an ABS/Coast Guard recognized specialist is required to perform or supervise maintenance and repairs of equipment, such as

j. WI 0688, Rescue Boat Engine and Drive Servicing (2 YR) This work requires the services of a Willard Marine Technical Representative to inspect, service, and test and drives. Only qualified service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of critical communication for the crew onboard the vessel. Qualified representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
k. WI 0702, C Belzona coating currently exists in the CPS Sump and is the standardized coating for CPS Sumps onboard MSC vessels. Belzona provides the only consistently dependable coating to provide an extended service life under the harsh CPS Sump environment. A Belzona technical representative is further directed since the application of this material requires specialized tools and training for the personnel accomplishing the requirements. Having the representative oversee the requirements of the work item will ensure that the proper surface preparation is accomplished and coatings are applied in accordance with manufactu harsh environment of the CPS Sump.
6. Description of Efforts Made To Solicit Offers from as Many Offerors as Practicable: The requirement has been synopsized at the Government Point of Entry (GPE), Contract Opportunities (formerly FedBizOps) website and the Government intends to post this justification at the GPE with the intent of issuing a firm-fixed price contract modification to Mare Island Dry Dock, LLC. Mare Island Dry Dock, LLC will be required to use the OEM or OEM Authorized vendor as a subcontractor to perform the work in the related WIs.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions To Remove Barriers to Future Competition: For reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible. If the prime contractor identifies an alternate source fully qualified by technical expertise, experience, and access to OEM parts and technical data, the prime contractor must submit its analysis and documentation supporting the alternate source to the Contracting Officer no later than the closing date for clarifications as stated in the solicitation.
