About this file

This is a Justification & Approval (J&A) document authorizing the use of other than full and open competition for a sole-source purchase order to Curtiss-Wright for HP/LP Turbine materials for the USS EMORY S. LAND (AS-39). The procurement will be funded with FY2025 Navy working capital funds.

The J&A cites 10 U.S.C. 3204(a)(1) as authority, stating Curtiss-Wright is the Original Equipment Manufacturer (OEM) and sole provider capable of supplying the proprietary HP/LP Turbine system components. The turbines are classified as L4 critical equipment (highest criticality level) and require scheduled five-year maintenance with replacement parts. A sources sought notice was posted November 15-18, 2024, with only one capable vendor responding. The Military Sealift Command (MSC) will post a sole source combined synopsis/solicitation notice to award a firm-fixed-price purchase order. Due to Curtiss-Wright maintaining proprietary data rights and not authorizing other vendors, MSC has no current plans to allow non-OEM suppliers for future requirements, though they continue seeking qualified alternatives through their website portal.

J&A No. N10425Q2129

JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Norfolk

2. Description of the Action Being Approved: Award of a purchase order on a sole source basis to the sole provider, CURTISS-WRIGHT, of the HP/LP Turbines installed on the AS Class Ships.

CURTISS-WRIGHT is the Original Equipment Manufacturer (OEM) and sole provider of the required materials for HP/LP Turbine for the upcoming availabilities for the USS EMORY S LAND (AS-39), using other than full and open competition.

3. Description of Supply Services: Procure the materials for the HP/LP Turbine system installed on the USS EMORY S. LAND (AS-39) to ensure the items are available for upcoming availabilities.

The estimated dollar value is which will be funded utilizing fiscal year 2025 Navy working capital funds.

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C. 3204(a)(1)

Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Authority: The AS Class HP/LP Turbines are nearing end of service life and have scheduled Five-year maintenance that requires replacement of various part of the turbine. The Allied HP/LP Turbine are critical equipment that is used to make the shaft turn on either forward or astern. All HP/LP Turbine systems installed onboard AS Class vessels are required to be maintained to perform its required national defense mission. Safety Management System Number (SMS) 10.6-002-ALL “Identification of Critical Equipment” has labeled these systems/items as L4 critical equipment; on a scale from L1 to L4 with L4 being the most critical. L4 critical equipment and systems are required be repaired/maintained in accordance with regulatory body requirements, MSC Policy, and OEM recommendations.” as stated in SMS number 10.4-001-ALL “Preventive Maintenance (PM)” and SMS Number 10.7-001-ALL “Corrective Maintenance”. Curtiss-Wright is the only company able to provide proprietary technical data/drawings for these systems/parts as required by United States Coast Guard (USCG) and American Bureau of Shipping (ABS) regulations and is the only company that have the capability to provide services and manufacture parts to maintain these systems. For these systems, Curtiss-Wright does not share proprietary data or authorize outside vendors to service or manufacture these systems, making them the only known source to provide supplies and services. In sum, the engineering, technical characteristics, construction drawings, manufacturing procedures, tolerances, and installation procedures for these systems/items are proprietary to Curtiss-Wright. Failure of these systems or associated parts would result in C-4 CASREP for the USS EMORY S. LAND (AS-39). Curtiss-Wright will not sell their data rights to the Government and maintains that these systems were procured/manufactured via commercial standards. Requirements for services and parts for these systems will be sole sourced to Curtiss-Wright at the order level.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: A sources sought was posted from November 15, 2024 to November 18, 2024 date for this requirement and only one capable vendor responded. There is sufficient historical data showing that there are no other capable vendors of providing HP/LP Turbine OEM material. MSC perpetually seeks submissions from non-OEM contractors for consideration of qualification of their parts and/or services as an acceptable alternative to the OEM at https://www.msc.usff.navy.mil/Business- Opportunities/Contracts/Qualification-for-Items-Critical-to-Shipboard-Safety-on-MSC-Vessels/. The Government intends to post a sole source combined synopsis and solicitation notice along with this justification at the Government Point of Entry to award a firm-fixed-price purchase order.

J&A No. N10425Q2129

7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

8. Actions to Removed Barriers to Future Competition: For reasons set forth in paragraph 5, MSC has no plans at this time to allow for non-OEM suppliers in future contracts or purchase orders for the types of supplies covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
