An intent to sole source will be posted on SAM.gov. The Contracting Officer will conduct a price analysis upon receipt of UFC's quote to ensure fair and reasonable pricing. No other companies have expressed written interest in the acquisition since the procurement was not advertised.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304 (A) (X)

1. Identification of the agency and contracting activity.

The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Professional Services Acquisition Unit (PSAU) has prepared this justification for other than full and open competition for defense tactical technical training on behalf of the Training Division.

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

It is the intent of the PSAU, Finance Division, to acquire a firm fixed price contract for The period of performance will be for a one (1) year base. The contract will be sole source to offer time for a competitive long-term contract.

3. A description of the supplies or services required to meet the agency’s needs.

The FBI requires a training program for special agents in defense tactical techniques that focus on integrating mixed martial arts (MMA) skills with specialized defense tactics. The purpose of the training is to enhance physical combat abilities, mental toughness, and tactical awareness, which are crucial for special agents in high-risk situations.

4. The statutory authority permitting other than full and open competition.

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.103-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

Ultimate Fighting Championship (UFC) is uniquely qualified to provide these services to the FBI based upon the following:

UFC has demonstrated an expertise in all of the mixed martial arts skills that are demonstrated in the PWS. The trainers provided by UFC have the skills necessary to instruct striking techniques, grappling/takedowns, weapon defense, ground control, as well as conditioning to the standard that the FBI expects and requires. Though other vendors found through market research demonstrate some of these skills, none are able to provide a training that encompasses all of these at the expertise that is required by the PWS.

In addition to this, no other vendor has experience providing this training that is specific to the FBI. Given the time constraints for this requirement, only UFC has the experience necessary to provide FBI ready training with the time that is allowed.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.1 and, if not, which exception under 5.101 applies.

Once the documents are complete, the Contracting Officer will post an intent to sole source on SAM.gov so other vendors are aware. This requirement is only one (1) base year to allow for a more competitive procurement in the future. This “bridge” contract will allow us to conduct more market research and create a competitive environment for a long-term contract.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Independent Government Cost Estimate for this requirement totals . Once a quote is received from the vendor, the contracting officer will conduct a price analysis to ensure the price is fair and reasonable.

8. A description of the market research conducted and the results.

The Contracting Officer conducted market research through internet searches, SAM.gov, and FPDS. The market research resulted in the sole source contract because only one vendor was found who could meet all the requirements in the PWS and have the experience necessary to provide the training in a short amount of time.

9. Any other facts supporting the use of other than full and open competition.

Defense tactical training is provided to agents as they must be prepared to defend themselves in varying situations they may face once they are on duty. As agents face varying threats on missions, they must be prepared to defend themselves against varying attacks which include mixed martial arts. The requirement is written in a way that will allow them to learn each of these styles and how to defend them. That is why this contract must be sole sourced to UFC, as they are the only vendor who can provide training that includes all of these styles at the level of expertise that is required by the FBI.

10. A listing of any sources that expressed a written interest in the acquisition.

Since the procurement was not advertised, no other companies have expressed an interest either orally or in writing.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.

This contract will be for one (1) base year which will allow for more market research to be conducted and allow for vendors to become more equipped to handle this requirement. The long-term contract that will be created in the future will be done so on a competitive basis.
