About this file
Summary: Justification for Exception to Fair Opportunity
This is a Justification for Exception to Fair Opportunity document for a firm-fixed-price order under the NASA Solutions for Enterprise-Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC).
The Department of Veterans Affairs (VA), through its Central Texas VA Medical Center (VAMC), requires renewal of annual software subscription, maintenance, and support for the Document Storage System (DSS) Veterans Health Information Systems and Technology Architecture (ViStA) Integrated LiveData PeriOperative (PeriOp) Manager perpetual license. The DSS PeriOp Manager is a proprietary software product that integrates with VA's ViStA environment to provide perioperative management capabilities for operating rooms, including real-time patient status views, surgical case tracking, preoperative complexity management, team communication, patient safety enhancements, and operational efficiency improvements. The solution synchronizes preoperative patient progress, enables surgical case planning, and coordinates patient progression from surgical referral through scheduled procedures. Services include maintenance and support provided Monday through Friday, 8 a.m. to 7 p.m. Eastern Standard Time, including technical support, bug fixes, minor release upgrades, and on-site and remote training. The period of performance is one 12-month base period with one 12-month option period.
Market research conducted April through June 2026 identified that only DSS or authorized resellers can provide maintenance on the existing DSS LiveData PeriOp software due to proprietary constraints and technical integration requirements with VA's ViStA/CPRS platform. Three authorized resellers were identified, including two Women Owned Small Businesses and one Service Disabled Veteran Owned Small Business. The justification cites the unique and highly specialized nature of the supplies and services per 41 U.S.C. § 4106(c)(2) and FAR 16.507-7(b). The award notice will be synopsized on the Contract Opportunities website with the justification made publicly available within 30 days of award.
