About this file

This is a Justification for Single Source Awards document from the Department of Veterans Affairs for an emergency construction project. Network Contracting Office (NCO) 7, administering on behalf of VISN 7 at Ralph H. Johnson VAMC in Charleston, South Carolina, is awarding a sole source contract to Medpro Systems LLC for the "Prepare B315 Pain Procedures Room" project with an estimated cost of $26,402.00 (Purchase Request Number: 534-26-3-5788-0033).

The scope of work includes installing lead-lined sheetrock and sheet-vinyl flooring to meet radiation shielding requirements per LBT Radiation Physics Consulting LTD specifications, pointing and painting sheetrock to VAMC standards, replacing the B315 door with the existing B321 door, and cleaning the room prior to turnover. All work must comply with ICRA requirements. The justification for the sole source award is based on RFO 6.103-2 (Unusual and Compelling Urgency), as Medpro Systems LLC is already on-site for other work and possesses the required certifications, technical expertise, and facility knowledge necessary for rapid mobilization and completion. The contractor's status as a certified Service-Disabled Veteran Owned Small Business (SDVOSB) also authorizes the sole source award under RFO 6.103-5 and VAAR 819.7008. Market research identified other capable vendors under NAICS 236220, but none could mobilize as quickly or possess equivalent facility knowledge. No public announcement was made due to the emergency exemption at RFO 5.101(b)(2).

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards

Acquisition Plan Action ID: 36C247-26-AP-3136

1. Contracting Activity

Administration of the proposed contract will be completed by Network Contracting Office (NCO) 7 on behalf of the Department of Veterans Affairs, VISN 7, Ralph H. Johnson VAMC 109 Bee Street Charleston, SC 29401. The Purchase Request Number is 534-26-3-5788-0033.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount

The project, Prepare B315 Pain Procedures Room, will consist of installing lead-lined sheetrock and sheet-vinyl flooring necessary to meet shielding requirements per direction of LBT Radiation Physics Consulting LTD. Upon completion of installation, sheetrock is to be pointed and painted to meet VAMC standards. Contractor shall comply to ICRA requirements. The door for B315 is to be replaced with the existing door of room B321. B315 is to be cleaned prior to turnover. The estimated cost to the Government for this emergency project is approximately $26,402.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used

This emergency order will use a specialized construction contractor, Medpro Systems LLC., who is already on-site for other separate work. Medpro Systems LLC., has all required certifications and knowledge of the problem to include the understanding of the environment in which the problem exists. Given the highly complex and emergent nature of the requirements, we strongly encourage deployment of a firm with a proven track record of performance, which is Medpro Systems LLC. The Government justifies the use of Medpro Systems LLC. for a sole source contract through use of RFO 6.103-2 – Unusual and Compelling Urgency.

Medpro Systems LLC. is also a certified Service-Disabled Veteran Owned Small Business (SDVOSB). In addition to RFO 6.103-5, Authorized by Statute, and VAAR 819.7008, Sole source awards to verified service-disabled veteran-owned small businesses. No further justification is needed.

Note: No announcement was made for this requirement given the exemption at RFO 5.101(b)(2).

Also, future requirements of a non-emergent nature may allow for full and open competition, and it is the Government’s intent to remove barriers to competition for future construction-related projects.

4. Description of market research conducted and results or statement why it was not conducted

Market research was conducted and found numerous vendors in the United States and Alabama, SDVOSBs included, who were potentially capable of completing the required work under NAICS 236220. However, it is highly unlikely that any of these firms would have the ability to mobilize for work as quickly as Medpro Systems LLC., and it is unlikely that the firms would also have the expertise and knowledge of the facility that Medpro Systems LLC. has. Additionally, due to the urgent nature of this requirement, the VA is incapable of reaching out to other potentially qualified firms to compete the requirement.

5. Contracting Officer's Certification

A record of the negotiations and the Contracting Officer’s (CO’s) conclusion that the price is fair and reasonable will be kept in the contract files. I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
