About this file

This is a Justification and Approval (J&A) for Other Than Full and Open Competition document from GSA Public Building Services Great Lakes Region 5 for janitorial and related services at the Indianapolis International Airport TSA Location. The J&A seeks to extend Contract 47PF0019D0043 with Professional Management Enterprises, Inc. for two months from January 31, 2025 to March 31, 2025.

The extension is needed due to unusual and compelling urgency while GSA finalizes a follow-on contract. The estimated value is $13,813.48 for the two-month period. The incumbent contractor will continue services at the same monthly price previously accepted in modification PS0016. No market research was conducted due to time constraints, and the urgency requires limiting competition since no other contractors could obtain necessary building knowledge and security credentials in time. A new procurement is already underway with services expected to begin April 1, 2025. The J&A was signed by the Contracting Officer on January 29, 2025 and will be posted publicly within 14 days of the modification execution.

GSA GREAT LAKES REGION

General Services Administration

Public Building Service Great Lakes, Region 5

Acquisition Management Division Justification and Approval for Other Than Full and Open Competition

Janitorial and Related Services

Contract 47PF0019D0043 at

Indianapolis International Airport – TSA Location Indianapolis, IN 46241-8003

1. Identification of the agency and contracting activity

This Justification and Approval (J&A) for Other Than Full and Open Competition is executed by the General Service Administration (GSA) Public Building Services (PBS) Great Lakes Region 5 Acquisition Management Division.

2. Nature of Action Being Approved & Description of Supplies or Services

This activity proposes to extend the period of performance for Janitorial and Related Services by two (2) months from January 31, 2025 to March 31, 2025 per FAR clause 52.217-8. Due to FAR clause 52.217-8 not being evaluated at the time of the contract award, this will be a non-competitive modification.

This activity also proposes to negotiation a non-competitive award (sole source) for this extension period. This extended period is to ensure GSA maintains continued performance of critical services to its facilities between the expiration date of the current contract and the award of the follow-on contract.

3. Estimated Dollar Value: The government estimate is $13,813.48 for two months.

4. An identification of the statutory authority permitting other than full and open competition (FAR 6.303-2(b)(4))

FAR 6.302-2 Unusual and Compelling Urgency 42 U.S.C. 253(c)(2) permits limiting the number of sources from which proposals are submitted in circumstances where unusual and compelling urgency justifies such a limitation.

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority (FAR 6.303-2(b)(5)) The statutory authority cited is FAR 6.302-2(b)(1) which states an unusual and compelling urgency precludes full and open competition; and FAR 6.302-2(b)(2) which states that a delay in award of a contract would result in serious injury, financial or other, to the Government. Due to unusual and compelling circumstances arising from multiple rounds of negotiations with a second 8(a) contractor for the new follow-on contract, this justification to limit competition for this project is required to protect the Government from a lapse in janitorial and related services while GSA finalizes award of the follow-on contract.

Without a janitorial and related services contract, the building would be unsanitary and unsafe for the employees and public who require access to the building. The resultant modification will help ensure the safety of the building.

The current contract is due to expire on January 31, 2025.

The Southern Services Contracting Team is in the process of evaluating an offer from a third contractor for the follow-on contract to maintain services at this location and services are expected to begin on April 1, 2025. The existing contract with the incumbent contractor, Professional Management Enterprises, Inc. (hereinafter PME) will be extended for two (2) months via modification in accordance with FAR 52.217-8 as a result of this sole source procurement. However, since pricing for this extension was not evaluated at time of award of the base contract, per FAR 17.207(f), this sole source justification is needed.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR

5.202 applies (FAR 6.303-2(b)(6) Due to the urgency of this situation and the need to avoid a lapse in services, this situation does not permit the solicitation of additional offers.

In accordance with FAR 6.305, this Justification for Other than Full and Open Competition will be posted within 14 days after the execution of the modification.

7. Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable (FAR 6.303-2(b)(7)) The Contractor did not request an increase to the monthly price from what was accepted in modification PS0016. Therefore, the price is fair and reasonable since it was evaluated and accepted in Modification PS0016.

8. A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8)) Due to the time constraints for this procurement, no market research was conducted due to unusual and compelling circumstances. The Government has determined that no other contractors are available to begin services by the current end date of performance. No other contractor possesses personnel with specific building knowledge or security credentials required to continue performance with this shortened period for execution.

9. Any other facts supporting the use of other than full and open competition (FAR 6.303-2(b)(9)) There are no additional facts to be reported.

10. A listing of any sources that expressed a written interest in the acquisition (FAR 6.303-2(b)(10)):

Not Applicable. Due to urgency, the services will continue to be performed by:

Professional Management Enterprises, Inc.

9245 N. Meridian St. Suite 210

Indianapolis, IN

46260

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated (FAR 6.303-2(b)(11)) A new procurement is already underway for a follow-on contract with a planned effective date of April 1, 2025. The extended period of performance will be to provide continued services while the procurement is being conducted. It is in the Government’s best interest to award a modification to extend services for the period of performance of February 1, 2025 to March 31, 2025 to Professional Management Enterprises, Inc.

12. CERTIFICATIONS

Contracting Officer: I certify that the above data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
