About this file
This document is a Justification and Approval (J&A) for Other than Full and Open Competition under FAR Part 13. The J&A describes a firm fixed-price supply purchase of 3.02 credits (acres) of Off-channel Shaded Riverine Aquatic (SRA) Habitat credits to offset adverse environmental impacts from the construction of the San Joaquin River Basin, Lower San Joaquin River, CA Project. The purchase is required to comply with a National Marine Fisheries Service biological opinion. The USACE consulted the RIBITS system and determined that Riparian Ranch, LLC is the only mitigation bank with the required SRA habitat credits located within the appropriate service area. The total estimated SRA habitat mitigation needed for the project is between 39,000 and 59,000 linear feet. The USACE awarded contract W9123824P0011 to Riparian Ranch, LLC for $604,000 on April 4, 2024.

Justification and Approval for Other than Full and Open Competition – FAR Part 13
REDACTED
1. Contracting Activity: US Army Corps of Engineers (USACE), Sacramento District, Contracting Division, Service and Supply Branch and Section.
2. Description of Action: This action is a firm fixed price supply purchase of mitigation credits to offset the adverse effects of construction of the San Joaquin River Basin, Lower San Joaquin River, CA Project (LSJR Project) on Shaded Riverine Aquatic (SRA) habitat. The purchase of SRA habitat credits complies with National Marine Fisheries Service (NMFS) biological opinion No. WCR-2015-3809, dated June 7, 2016.
3. Description of Supplies/Services: This action is to purchase 3.02 credits (acres) of Off-channel SRA Habitat credits (equivalent to 1,678 linear feet of SRA habitat). The habitat credits will be applied to the LSJR Project’s total compensation needs for adverse impacts to existing SRA habitat on the San Joaquin River, Calaveras River, French Camp Slough, and Duck Creek caused by construction of Phases C, D, and E of the Project. The total estimated SRA habitat mitigation needed for the LSJR Project is between 39,000 and 59,000 linear feet.
4. Authority Cited: FAR 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: The impact areas of the LSJR Project construction are in the Sacramento-San Joaquin Delta. Most of the Delta lies within Contra Costa, Sacramento, San Joaquin, Solano, and Yolo Counties. NMFS requires the Corps to purchase credits within the same general area (bank service area) as the construction impacts. This limits the choices and availability of credits. In this case, only one mitigation bank with SRA available habitat credits is located within the appropriate area.
6. Efforts to Obtain Competition: The USACE website RIBITS (Regulatory In-lieu Fee and Bank Information Tracking System) RIBITS was consulted to check availability of SRA habitat credits at other mitigation banks. Riparian Ranch is the only bank located within the required bank service area for the LSJR Project with SRA habitat credits available for purchase.
7. Actions to Increase Competition: There is only one current mitigation bank that has the type of credits needed, in the required location. Therefore, there are no other opportunities to increase competition.
8. Market Research: Confirmation of credit availability was verified through outreach to the bank listed above as well as through consultation of the USACE RIBITS website.
