JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

This is a Justification and Approval (J&A) document for a non-competitive bridge contract action issued by the Department of the Navy's Naval Research Laboratory (NRL) dated September 10, 2026. The document justifies a six-month bridge modification extending Task Order N0017321F2015 to Arcfield (formerly dba Arcfield) under Multiple Award Contract N0017316D2009. The bridge action extends performance from September 24, 2026 through March 23, 2027 to maintain continuity of specialized "High Assurance Computer Systems Security" services supporting NRL's Center for High Assurance Computer Systems (CHACS), Code 5540. The incumbent contractor has assembled a highly specialized team with requisite security clearances and subject matter expertise that would be impractical to reconstitute with a new contractor within the remaining contract performance period. The estimated dollar value covers the full six-month period and will be incrementally funded using Fiscal Years 2026 and 2027 Research, Development, Test and Evaluation (RDT&E) funds.

The statutory authority for non-competitive procurement is Title 10 U.S.C. 3204(b), justified under FAR 6.103-1 for Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Government conducted a pre-solicitation notice on SAM.gov on August 24, 2026, receiving three responses; two proposals were deemed not technically capable and one was a general company introduction expressing interest in future full and open requirements. Cost reasonableness will be determined using an Independent Government Cost Estimate (IGCE) combined with comparison to historical prices, with certified cost or pricing data required. A new competitive follow-on contract (N0017325RML01) is currently in progress with award expected during the bridge contract period. All required certifications and approvals were obtained between September 16-23, 2026.

J&A6.103-1-26-SD01

6. Description of Efforts Made to Solicit Offerors from as Many Offerors as Practicable

No effort was made to pursue other potential sources due to the unacceptable delays and disruption in critical program and projects. However, in accordance with FAR 5.201, a pre-solicitation notice was posted on SAM.gov on 24 August 2026. Three responses were received. Two responses included proposals that were formally evaluated by the Contracting Officer’s Representative and determined not technically capable. The third response was a general company introduction that included a statement of interest in future full and open requirements for Code 5500.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.404-1(b)(5), the Government will use the Independent Government Cost Estimate (IGCE) in combination with FAR 15.404-1(b)(2), comparison of proposed prices to historical prices paid, to determine whether the proposed cost/price is fair and reasonable. In accordance with FAR 15.403-3, certified cost or pricing data will be required in support of the proposed costs.

8. Actions to Remove Barriers to Future Competition.

A new competitive award is currently in progress, and award is expected to be made during the performance period of the bridge contract. This bridge action is a temporary measure to prevent a break in critical IT and research and development support to NRL during the time required to award a competitive follow-on contract. Moving forward, the Government will seek to begin pre-award work for recompete contracts sooner in order accommodate for any protest-related delays.
