About this file
This is a Justification and Approval (J&A) document for a sole source contract award by the Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, New Jersey. The document authorizes award of a contract to Hydraulics International, Inc. (HII), CAGE Code 56529, located in Chatsworth, California, for 13 Diesel Portable Hydraulic Power Supply (PHPS) units (Part Number 111025-100, NSN 4920-016-18-8809). The procurement comprises nine units for CMV-22 aircraft and four units for MV-22 aircraft to fulfill fleet deficits in support equipment. The Diesel PHPS is a single system hydraulic pumping unit rated at 50 gallons per minute at 3,000 PSI and 32 GPM at 5,000 PSI, designed to power aircraft hydraulic systems for operational maintenance and testing without starting aircraft engines. The acquisition will be funded with Aircraft Procurement Navy (APN-1) and APN-7 appropriations with an estimated total dollar value of approximately $3 million for fiscal years 2022–2024.
The sole source award is justified under 10 U.S.C. 3204(a)(1) because HII is the original equipment manufacturer and only responsible source capable of meeting the V-22 aircraft's unique requirement for instantaneous hydraulic system startup at 5,000 PSI at 32 GPM, which cannot be achieved with common Navy support equipment. The Government lacks the full technical data package necessary to compete the procurement. Development of an alternative solution would cost an estimated $1,343,728.90 plus an additional $354,500.00 for a new Integrated Logistics Solution, totaling $1,698,228.90, costs not expected to be recovered through competition. Market research was conducted through FPDS.gov, WBParts.com, and PartTarget.com, with HII identified as the only supplier. A Request for Information published August 29 through September 28, 2022, received three responses, but only HII confirmed capability as the OEM. A presolicitation synopsis posted March 23 through April 7, 2023, received a challenge from Chant Engineering; however, their alternate product did not meet environmental and electromagnetic interface standards. A second presolicitation synopsis posted February 23 through March 11, 2024, received a response from A&P proposing diesel and gas-powered units requiring modifications. The Contracting Officer has determined the anticipated cost will be fair and reasonable, and NAWC-AD Lakehurst has no current plans to compete future contracts for this equipment.

DEPARTMENT OF THE NAVY
NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION LAKEHURST
ROUTE 547
JOINT BASE MDL NEW JERSEY 08733
J&A No: 24-0035
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity:
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ
2. Description of the Action Being Approved:
This justification and approval authorizes and approves award of a contract on a sole source basis to Hydraulics International, Inc. (HII), Commercial and Government Entity Code 56529, located in Chatsworth, California, for the Diesel Portable Hydraulic Power Supply (PHPS) to satisfy Support Equipment requirements for both the MV-22 and CMV-22 aircraft variants.
3. Description of Supplies or Service:
The Diesel PHPS (Part Number (P/N) 111025-100, National Stock Number (NSN) 4920-016-18-8809) is a single system hydraulic pumping unit with a rated capacity of 50 Gallons Per Minute (GPM) at 3000 Pounds Per Square Inch (PSI) and 32 GPM at 5000 PSI designed to power the aircraft hydraulic systems for operational maintenance and testing of aircraft hydraulic components while on aircraft, delivering hydraulic fluid at controlled pressures without the necessity of starting the aircraft engine(s).
This procurement is for a total quantity of 13; nine (9) each for CMV-22 and four (4) for MV-22. The quantities are required to fulfill fleet deficits for both the MV-22 and CMV-22 aircraft variants. The acquisition will be funded with Aircraft Procurement Navy (APN)-1 and APN-7 appropriations as set forth in the table below.
Estimated Dollar Value
4. Statute Authority Permitting other than Full and Open Competition:
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
FY22-24
Total
APN-7 (CMV) $2
APN-1 (MV) $1
Total $3M
J&A Number: 24-0035
5. Rationale Justifying Use of Cited Statutory Authority:
HII is the only source of supply for the Diesel PHPS as it is the original equipment manufacturer (OEM). The Navy contracted with HII for the design, development and manufacture of the Diesel PHPS that meets the unique maintenance requirements of the V-22 aircraft. The Government does not possess a full technical data package necessary to compete the procurement. The V-22 aircraft has a requirement for instantaneous start-up of the aircraft hydraulic system for aircraft maintenance.
External Hydraulic power must be provided at 5000psi @ 32 GPM, which cannot be achieved with the common support equipment solution provided by the Navy.
A significant deficit exists for the Diesel PHPS Peculiar Support Equipment for the MV-22 and CMV- 22 aircraft. The Diesel PHPS from HII P/N 111025-100 (NSN 4920-016-18-8809) is the only available Diesel PHPS that can meet the specific requirements of the V-22 program. Developing an alternative solution to meet the current needs of the program would cost an estimated total of $1,343,728.90. The estimated costs are derived from past actuals that the program has paid.
Additionally, an alternative solution would require a new Integrated Logistics Solution to be developed, furthering the cost by $354,500.00. The cost of $1,698,228.90 to procure an alternate solution is not expected to be recovered through competition.
6. Description of Efforts made to Solicit Offers from as Many Offerors as Practicable:
Market research was conducted and assessed using FPDS.gov by P/N and NSN (no results) and nomenclature using FPDS, WBParts.com, and PartTarget.com where HII was the only supplier and manufacturer known. Diesel PHPS is the only unit found capable of meeting all MV-22 and CMV-22 requirements.
A Request for Information (RFI) required by Defense Federal Acquisition Regulation Supplement 206.302-1(d) was published as N6833522RFI0317 on the SAM.gov website on 29 August 2022 through 28 September 2022. Three responses were received from Wilson Fluid Power Solutions, Test Fuchs Corporation, and HII. All three said they could make the PHPS. HII confirmed interest in proposing to the subject RFI and did not provide any other information as HII is the OEM of the fielded PHPS units. However, Wilson Fluid Power Solutions and Test Fuchs Corporation did not provide a P/N in their response as an alternative to the P/N nor were any other items specified. The Government Lead Engineer deemed that neither Wilson Fluid Power Solutions nor Test Fuchs Corporation would be able to manufacture the PHPS without a complete drawing package and no other alternative P/N was proposed.
In accordance with FAR 5.201(b)(1), this requirement was synopsized as N6833523R0137 on the SAM.gov website on 23 March 2023 and closed on 07 April 2023 with one (1) challenge received from Chant Engineering. The Government technical team reviewed the alternate product data provided by Chant and determined that the product does not meet environmental, nor electromagnetic interface standards required to be considered for this effort. On 10 April 2023, a response was provided to Chant. No further correspondence has been received.
An additional pre-solicitation synopsis, N6833524R0008, was posted on the SAM.gov website on 23 February through 11 March 2024. One response was received from A&P introducing a current series of Diesel and Gas Powered Hydraulic Power Units that would require modifications in order to be
J&A Number: 24-0035 considered for future solicitations. Although Chant did not respond to this posting, the Government team contacted Chant to see if environmental testing had been conducted on the alternate product since the initial data was provided in response to synopsis, N6833523R0137. Chant confirmed that no testing has been completed since the previous synopsis. The technical team determined this procurement should not be delayed to qualify additional sources. Responses were provided to A&P and Chant on 04 April 2024. A&P confirmed acknowledgement with no further correspondence. No further correspondence has been received by Chant. The information provided by Chant and A&P will be taken into consideration during market research of future requirements.
No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than HII to provide the required supplies.
7. Determination of Fair and Reasonable Cost:
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition:
For the reasons set forth in Paragraph 5, NAWC-AD Lakehurst has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAWC-AD Lakehurst will assess whether competition for future requirements is feasible.
