This is a Justification and Approval (J&A) document for Other Than Full and Open Competition for a follow-on sole source contract to Northrop Grumman Systems Corporation (CAGE Code 1LTU5, Large Business) located in Warner Robins, Georgia for Common Munitions Built-In-Test (BIT)/Reprogramming Equipment (CMBRE) production, repair, engineering support, and Contractor Logistics Support (CLS).

The requirement office is AFLCMC/ROA and the contracting office is AFLCMC/ROKB under purchase request FD2060-26-30003. The acquisition will be a follow-on Requirements Indefinite Delivery Contract (IDC) with Firm-Fixed-Price (FFP), Cost Plus Fixed-Fee (CPFF), and Cost Reimbursable No Fee (CRNF) Contract Line Item Numbers (CLINs). The contract will include a one-year basic period, four annual 12-month options, and terms of FAR Clause 52.217-8 for option extensions at the task order level, with orders issuable from May 1, 2026 through April 30, 2031. The CMBRE system comprises the CMBRE Block II tester (CMBRE Plus), test set adapter units ADU-890 and ADU-891, cables, and associated components that support numerous munitions including AIM-9X, JDAM, JSOW, JASSM, PAVEWAY, WCMD, SLAM-ER, SDB, AMRAAM, and others for USAF, Navy, Army, Evolved Sea Sparrow Missile Consortium, and Foreign Military Sales customers. The J&A is justified under FAR 6.103-1 (Only One Responsible Source) based on NGSC's ownership of all proprietary CMBRE technical data and manufacturing processes, the Government's failed attempts to purchase technical data rights, obsolescence mitigation requirements, and the cost and schedule risks of reverse engineering or qualifying alternative sources. Market research conducted through a Sources Sought/Request for Information posted April 2, 2024 determined NGSC is the only capable vendor; two responding vendors were deemed not capable due to lack of access to proprietary CMBRE technical data. The estimated contract value is redacted but derived using historical data with escalation and obsolescence factors applied to out-year options. Funding sources include Air Force 3010/3020 Procurement and 3400 Sustainment, Air Force Reserve 0350 Procurement and 3740 Sustainment, Air National Guard 0350 Procurement and 3840 Sustainment, Navy 1506 Procurement and 1804 Sustainment, Army 2031 Procurement and 2020 Sustainment, and FMS 8242 Procurement and Sustainment. The J&A identifies CMBRE Cyber Enhanced (CMBRE CE) as the planned organic replacement system currently in production with Air Force fielding projected to complete by 2031, intending to eliminate future sole source requirements by that date.

The Requirement office is AFLCMC/ROA. The Contracting office responsible for this proposed contracting action is AFLCMC/ROKB. The purchase request number is FD2060-26-30003.

Due to the circumstances described herein, the activity requests authority to acquire the equipment and services listed in this Justification and Approval (J&A) using Other Than Full and Open Competition as prescribed by FAR , Only One Responsible Source and No Other Supplies or Services Will Satisfy

Agency Requirements. This action will result in award of a follow-on Requirements Indefinite Delivery

Contract (IDC), with Firm-Fixed-Price (FFP), Cost Plus Fixed-Fee (CPFF), and Cost Reimbursable No Fee

(CRNF) Contract Line Item Numbers (CLINs). The contract will be structured with a one (1) year basic period, four (4) annual 12-month options, and terms of FAR Clause 52.217-8, “Option to Extend Services” applicable at the task order level. Based on the projected contract award date, orders can be issued 1 May

2026 through 30 April 2031.

This requirement is for the production, repair, engineering support, and Contractor Logistics Support (CLS) for the Common Munitions Built-In-Test (BIT)/Reprogramming Equipment (CMBRE) for the Automated Test Systems (ATS) Programs. The following National Stock Numbers (NSNs) and associated items support the CMBRE system: AN/GYQ-79 CMBRE Plus (NSN 6625-01-535-4586/6625-01-654-1986/ 6625-01-688-5456), ADU-890/E (NSN 6625-01-533-0798), ADU-891-(V) 1/E and ADU-891-(V) 3/E (NSN 6625-01-543-8090 and 6625-01-561-0677 respectively), W-23 Cable Assembly (6150-01-557-2538) CMBRE initial spares kits, and assorted items for the CMBRE configuration.

This requirement is comprised of CMBRE Block II tester (CMBRE Plus), test set adapter units ADU-890 and ADU-891, and all associated cables. Munitions supported include, but not limited to: the Air Intercept Missile (AIM)-9X, Dual Mode Laser Guided Bomb (DMLGB), Miniature Air Launched Decoy (MALD), Joint Direct Attack Munition (JDAM), Joint Standoff Weapon (JSOW), Joint Air-to-Surface Standoff Missile (JASSM), Precision Avionics Vectoring Equipment (PAVEWAY), Wind Corrected Munitions Dispenser (WCMD), Standoff Land Attack Missile-Expanded Range (SLAM-ER), Small Diameter Bomb (SDB) I and II, Advanced Medium Range Air-to Air Missile (AMRAAM), Advanced Anti-Radiation

Guided Missile, AGM-142 (Foreign Military Sales (FMS) only), Massive Ordnance Penetrator (MOP), Joint Air-to-Ground Missile, Multi-Stage Super Sonic Target, Bomb Rack Unit (BRU)-61, and Joint Strike Missile. The CMBRE Plus consists of three cases: 1) Test Adapter Unit (TAU) case; 2) Controller Unit Test Set case; and 3) the CMBRE Accessory Kit case. In addition, the ADU-891 consists of two cases: one case houses a switch box and munitions unique interface cables, and the other case holds the remaining munitions unique interface cables. The ADU-890 is a single case containing a switch box and the munitions unique interface cables.

This requirement supports the United States Air Force (USAF), Navy, Army, Evolved Sea Sparrow Missile Consortium and FMS. Letters of Acceptance will be submitted by the FMS countries source-directing the USAF to procure from NGSC, as required.

The overall program acquisition strategy for future sustainment is to establish Open Architecture configuration(s) with the development of the organic CMBRE CE, which will be supported through competitive acquisition. This J&A is to provide sustainment for the current CMBRE Plus system until it can be replaced by CMBRE CE.

The agency's minimum needs can only be satisfied by the unique supplies or services available from NGSC. NGSC is the vendor identified on the design requirements and source-controlled drawings. The CMBRE system is highly specialized. It is comprised of CMBRE Block II tester CMBRE Plus, test set adapter units ADU-890 and ADU-891, and all associated cables. CMBRE is a common piece of highly specialized support equipment used to interface with weapon systems to initiate BIT, report BIT results, and upload/doROload flight software. The CMBRE system represents the first munitions support equipment developed as a "common" system for multiple munition platforms.

The current CMBRE sole source contract to NGSC for production, repair, and CLS is FA8533-21-D-0001.

The contract was awarded 30 October 2020 and expire April 2026. Therefore, this acquisition will be a follow-on contract for the continued production of highly specialized equipment and the continued provision of highly specialized services.

Alliant Techsystems, Inc was the Original Equipment Manufacturer (OEM). They developed, manufactured, and maintained the CMBRE system beginning in 1996. In 2015, Alliant Techsystems merged with Orbital Sciences Corporation and formed Orbital Alliant Techsystems, Inc. located in Northridge CA. In January 2019, Orbital Alliant Techsystems, Inc. was purchased by Northrop Grumman Corporation, forming Northrop Grumman Systems Corporation. All of the CMBRE depot-level support

CUI August 2023 Page 13 of 17 equipment and technical data that is needed to produce, repair, and retest all of the sub-assemblies is oROed by NGSC. Since CMBRE development, there have been numerous proprietary manufacturing processes developed by the OEM. These processes are not part of the drawing packages but are critical to the sustainment of the CMBRE. These processes are used to facilitate the repair, test, and manufacture of the CMBRE system. Production and repair of the CMBRE system is supported through the knowledge and expertise of NGSC.

AFLCMC/ROA has determined that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the Government's requirements.

The Government has requested NGSC sell the technical data rights for the entire CMBRE system on multiple dates. In all cases, NGSC responded they are not willing to sell the rights to the CMBRE proprietary data to the Government or its competitors. Quotes to sell the technical data were requested in 2018, 2019, and 2020 from Orbital Alliant Techsystem/NGSC. In June 2021 when asked, they stated that they would be willing to discuss selling proprietary data but didn't have pricing available at that time. In June 2024, the Government requested a rough order of magnitude estimate to purchase the Level III technical data package (TDP) for the current CMBRE. NGSC responded they were interested in beginning exploratory dialogue to determine if it would be of mutual interest to NGSC and the Government to sell the data. If they were willing to sell the data, the Government would issue a formal Request for Proposal.

NGSC has not yet agreed to sell the data, so no action has been taken in pursuit of buying the data. To pursue that course of action to support this instant requirement would cause significant unacceptable risk of delay for continuation of sustainment support of CMBRE.

In November 2022, Northrop Grumman did provide a cost estimate of to purchase the data for a replacement CMBRE system, which would require an additional cost to the Government of to implement. The program office determined the purchase of their replacement system was not cost effective, as the organically developed replacement tester, CMBRE CE, was already nearing completion.

Development of CMBRE CE was completed in 2023. The production has begun with fielding projected to be complete for the Air Force customers by 2031. The CMBRE requires continued sustainment until the CMBRE CE fielding is complete.

NGSC is the only capable vendors with the knowledge to design, develop, integrate, test, produce and prepare associated documentation, fabricate, integrate, provide logistic support, provide technical support, provide training, and develop technical manuals to support CMBRE sustainment. Critical sub-components of the CMBRE are the Digital Computer System Assembly (DCSA) and ADU-890. Technical data for both is proprietary to NGSC. The DCSA is considered the most essential sub-component of the CMBRE Plus.

The DCSA is a highly specialized, self-contained, ruggedized computer that provides system central control, unique system-operational information processing capabilities, and the required system interfaces to external resources. The DCSA computer design is proprietary to NGSC and was not developed under a Government contract; therefore, the Government does not oRO the CMBRE DCSA data rights.

Moreover, NGSC has made multiple product improvement capability updates to the DCSA computer through the company's oRO Independent Research and Development efforts. Additionally, due to the maturity of technology in the CMBRE system, a high degree of obsolescence issues is experienced.

Numerous parts within the DCSA are no longer procurable, such as the 1553 communication Circuit Card

Assembly (CCA), software libraries associated with the obsolete 1553 CCA, 3.5inch floppy disc accessories, the current keyboard, etc.

Since NGSC oROs all data to the DCSA, they are the only qualified source to be the CMBRE integrator. A reverse engineering effort of CMBRE Plus is estimated to cost approximately in development cost and a minimum of two years for qualification. Development of a full Level III technical data package is estimated to cost an additional . These estimates are based on the CMBRE Cyber Enhanced (CE) that has been developed by the 516th SWES at Hill AFB. In addition, subcomponents awarded to any other source would result in first article testing of the entire CMBRE system to include adapters and cable. Cost and delay would be incurred during the first article qualification of a new CMBRE system, adapters, and all associated cables. In addition, a new vendor would be required to invest in development of test programs and fixtures for both TAU and W2, W3, W4, W6, W9, W19, W20, W21, and W23 cable assemblies; TAU vibration and Thermal ESS Fixtures; Leakage Current Test Fixtures; Calibration Test Fixtures; and TAU Holding Fixture. This is estimated to cost based on the current value of NGSC contract acquired property that supports CMBRE. Further, there would be a significant learning curve and additional start-up costs for a new vendor to develop the capability to analyze cables and test assets during the repair process.

Further, use of other vendor products or services would void the NGSC's warranty of the CMBRE system.

The cost to qualify a new vendor system or components is not expected to be recovered through competition by 2030 when CMBRE CE is expected to be completely fielded because it is estimated that this effort would take a minimum of five years before a return on investment would start to be achieved.

The ADU-890 is another piece of vital equipment which is highly specialized, weapon-unique adapter unit, designed and developed by NGSC to provide signal and power control for BIT/ reprogramming of multiple miniature munitions and weapons carriage systems. NGSC oROs the detail design data for the ADU-890 and has stated they will not sell those rights to the Government or its competitors. In order to reverse engineer the ADU-890, another contractor would need to develop test procedures and assembly/ disassembly procedures for four (4) Commercial Off the Shelf CCAs. They would also have to develop drawings to fabricate the wiring harness and transit case. Additionally, the Government does not have source data for the ADU-890 firmware. The Government conservatively estimates it would take over eight

(8) months at a cost of . A reverse engineering analysis was not performed for production because the Government is planning a competitive replacement of the ADU-890. The current plan is to initiate the organic development of ADU-890 replacement in 2028 with production planned to begin in 2030.

ADU-890 requires continued sustainment until the replacement is complete.

NSN 6150-01-557-2538 has an RMS/RMSC code of “R2/G.” The Government invested to qualify NGSC as the W17 and W23 cable manufacturer. These cables are integral components of the CMBRE system. There are more than twenty cables associated with the CMBRE system, to qualify other sources to manufacture each cable would be cost and time prohibitive. Moreover, if the Government purchased cables from a non-qualified source, the CMBRE system's warranty would be voided, and NGSC would not accept responsibility for the system's performance. During the repair and production of CMBRE system components to include cables, there are many instances of class II modifications which are made due to material availability. These modifications require approval by NGSC engineering and updates to the CMBRE drawings in which NGSC still maintains design authority.

NSN 6625-01-683-6914 has an RMS/RMSC code of “R1/G”. This adapter unit and the kit's associated cables is an integral component for CMBRE system operations, so to qualify other sources to manufacture

CUI August 2023 Page 15 of 17 and repair this unit would be cost and time prohibitive. If the government were to purchase or source the units from a non-qualified source, the CMBRE system's warranty would be voided, and NGSC would not accept responsibility for the system's performance. Additionally, during the repair and production of the adapter units, there have been multiple instances of Class II modifications due to material availability and obsolescence. These modifications require NGSC engineering approval and updates to the adapter unit drawings, in which NGSC still maintains design authority.

Other components in the CMBRE system, such as the TAU, ADUs, numerous circuit cards, and power supplies have required investigation and obsolescence mitigation. Some obsolescence and diminished manufacturing sources issues were mitigated by NGSC through multiple lifetime buys, and through purchase of special tolling, dye and molds.

NGSC has continuously evolved the CMBRE system design in order to incorporate product improvements to rapidly support and meet the operational capability requirements of the Government. These include demanding environmental requirements for system use in support of worldwide DoD operations and ability to interface with the latest generation of munitions.

CMBRE CE supports resolution of obsolescence and maintainability issues, in addition to eliminating dependance on proprietary NGSC technical data. The current fielding of CMBRE CE is not expected to affect the requirements listed in this document; however, it will decrease any future sole source requirements. CMBRE sustainment is still critical for support of testing, programing and mission readiness of JDAM, WCMD, MALD, Paveway, JSOW, JASSM, SLAM-ER, SDB, BRU-61A, AIM-9X and AMRAAM munitions. Therefore, a production or support delay of the CMBRE would be unacceptable.

Accordingly, NGSC is the only firm capable of providing supplies and services described in Section III above without the USAF experiencing substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

A Sources Sought (SS) / Request for Information (RFI) synopsis was posted on SAM.gov on 02 April 2024 with a response date of 01 May 2024 under Notice ID FA8533-24-R-CMBRE. The SS/RFI requested responses from interested vendors that possess the expertise, capabilities, and experience to meet qualification requirements for this effort. The following vendors responded to the SS/RFI:

Both vendors were evaluated for their capability and determined not capable based on not having access to the proprietary NGSC CMBRE TDP.

The requirement will be synopsized in in accordance with FAR 5.201. It is anticipated that sources having an interest in subcontracting may be identified through synopsis. Any source who responds to the Government as a result of this synopsis will be identified to the prime contractor as a potential subcontracting possibility.

The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.403-4, the contractor will be required to provide certified cost or pricing data to be used to support the Government's evaluation of the proposed cost. The proposed skill mixes of labor, labor hours, types and quantities of material and other direct costs, and direct and indirect rates will be negotiated by the Government based on recommendations from the Defense Contract Management Agency and expert technical personnel supporting the program. The contract price will be negotiated in accordance with the procedures in FAR 15 ensuring the ultimate cost to the Government is fair and reasonable.

Market research was conducted 25 March 2024 to 07 May 2024 in accordance with FAR Part 10.001 and

10.002. The Market Research Report was completed on 07 May 2024. The market research was revalidated on 6 January 2026 and the findings remain relevant. The market research techniques used are as follows:

As described in Section V above, a SS/RFI was posted to SAM.gov advising industry of the pending acquisition and soliciting inquiries from interested vendors. The SS/RFI was posted on 02 April 2024 under Notice ID FA5533-24-R-CMBRE. Two interested vendors responded to the SS/RFI. The vendors were evaluated for their capability and determined not capable based on not having access to proprietary

NGSC CMBRE TDP.

Queries were conducted using various internet searches (Google, Bing, ThomasNet.com) and using keywords “CMBRE”, “CMBRE Repair”, “CMBRE Production” and “CMBRE test set” to search for potential vendors. These searches only yielded results related to

A Small Business Administration Dynamic Small Business Search query was conducted using NAICS code 334515, Instrument Manufacturing for Measuring a Testing Electrical Signals with keywords CMBRE, Munition, tester, and test equipment. This query produced 17 potential vendors. The capability of the vendors found were evaluated and found to be unrelated business, and they do not have the proprietary data for the required services.

The CMBRE does not fit the definition of a commercial item as defined in FAR Part 2.101. This item is defined as military unique and is not customarily used by the general public or by non-Governmental entities. The Government requires parts that meet an exact form, fit, and function as determined by the specific mission. There are no other munitions tester products available in the commercial market to satisfy this unique military application.

The market research concluded NGSC is the only vendor capable of fulfilling the Government's requirement.

Numerous parts with the CMBRE system are no longer procurable due to obsolescence. The CMBRE Program office initiated the CMBRE Service Life Extension Program (SLEP), now knoRO as CMBRE CE, in 2015. The CMBRE CE was required to mitigate the risks for operational impacts due to the steady decline in system availability. This risk is attributed to limited procurement and availability or repair parts due to obsolescence and closed proprietary architecture.

Completion of CMBRE CE will allow for future competition of DCSA production and allow future CMBRE organic sustainment and/or competition, however the Government anticipates future sole source contracts to support CMBRE Plus production, repair, and CLS will be necessary. Requirements will be reduced due to declining number of CMBRE Plus systems remaining in the field as the Air Force continues to field CMBRE CE. With development complete for CMBRE CE, the Government oROs a complete Level III TDP so future production, repair, and engineering requirements can be competed.

The prior J&A plan to remove or overcome barriers to competition was to complete SLEP (i.e. CMBRE CE) by FY26. The development of CMBRE CE is complete and units are in production with fielding projected to be complete by 2031.
