About this file

This document is a Justification and Approval (J&A) for contracting without full and open competition to increase the shared ceiling amount on seven existing Agile Development & System Integration IDIQ contracts held by the Library of Congress (LoC). The LoC is prohibited from using a new $450M multiple award IDIQ contract for these services until it completes corrective action as recommended by the GAO. The J&A authorizes sole source awards to the seven current agile vendors to cover requirements needed until the new contracts can be issued. The ceiling increase of $10,207,833.82 is needed to avoid delays to critical LoC IT modernization and implementation projects, which could cause increased costs and potential funding lapses. The LoC plans to award the new multiple award IDIQ contract on 10/18/2023 to increase competition for these services.

Justification and Approval For Other than Full and Open Competition

Plan ID Number: 2024-CIO-0308

Form Updated 12/28/2022

Justification & Approval For Other than Full and Open Competition

As a legislative branch agency, the Library is subject to the competition and advertising requirements of 41 U.S.C. § 6101. Like the Competition in Contracting Act and the FAR, 41 U.S.C. § 6101 does not require competition when a contracting officer certifies that only one source or brand-name item is available, when dictated by public exigency, or when otherwise authorized by law.

This document sets forth the justification and approval for award of a contract or order by means providing for other than full and open competition per 41 U.S.C. § 6101, LCR 7-210, and, as applicable, FAR 6.302, FAR 13.106-1, FAR 8.405, and FAR 16.505. Contracting without competition shall not be justified on the basis of a lack of advance planning or concerns related to availability of funds.

This form shall be used to support instances where competition will be limited to a single source, a limited number of sources, including where a brand name product is required.

IDIQ

Estimated Value (Base and all options): $10,207,833.82 Shared Ceiling Increase Amount Period of Performance: from date of modification to September 2024.

The Library currently has seven IDIQ contracts for agile development and system integration. The ceiling amount has been reached on all of the IDIQ contracts. Therefore, the Library is creating a class Justification and Approval to increase the shared ceiling amount.

The shared ceiling amount for all the IDIQ contracts will be increased by $10,207,833.82. This class Justification and Approval shall increase the shared ceiling amount on the following Agile Development & System Integration IDIQ contracts:

1) Artemis Consulting, Inc. LCLOC20D0007 2669 Oakton Glen Dr. Suite 100 Vienna, VA 22181

Part 2 – Program Office Justification & Approval

4. Authority for Contracting Without Competition Over $250,000

For this requirement over $250,000, under FAR part 6, the basis for contracting without providing for full and open competition is:

There is only one responsible source and no other supplies or services will satisfy Library requirements.

41 U.S.C. § 6101(b)(2)(C); FAR 6.302-1.

There is such unusual & compelling urgency that the Government would be seriously injured if competition is not limited.

41 U.S.C. § 6101(b)(2)(B); FAR 6.302-2. Option years are not permitted.

5. Rationale for Contracting Without Competition

We are authorized to limit competition on the basis of the citation in section 4 because:

The new multiple award Agile software development IDIQ contract cannot be issued until corrective action has been completed.

Therefore, time is of the essence for the Library’s current agile software development, as delays will result in harm to the Library and the Library’s mission. The Library is awarding sole source awards to the Library’s seven current agile vendors to cover requirements needed until new multiple award contracts can be issued.

Without the ceiling increase, the Library will not be able to ensure the continued development of critical Library systems via its existing IT related task orders until GAO’s recommended corrective action is taken and new multiple award contracts are issued.

Without the ability to award task orders and modifications for extension of services under the existing Agile IDIQ contracts, a delay will occur in approximately five (5) ongoing IT modernization and implementation projects. The effects of this delay will impact project roadmaps and schedules, pushing critical software system deployment tasks into FY2025. This will cause increased costs due to the need to stop and re-start project development and the Library could potentially lapse funding on these programs appropriated for obligation in FY2024, for which future appropriations may not be available to replace.

Specifically, several IT modernization and implementation projects will be impacted if the existing multiple Agile IDIQ contract ceiling is not raised. Specific development initiatives in-progress include:

6. Actions to Overcome Barriers to Competition Before Subsequent Contract Is Required

To increase competition, we will award a new contract for Agile IT services.

A new multiple award IDIQ contract was awarded on 10/18/2023, with a shared ceiling amount of $450,000,000. However, the Library is prohibited from using the new IDIQ contracts until it completes corrective action as recommended by GAO. The new contracts assure the continued competition for and increases the pool of highly qualified firms eligible to compete for Library IT Development Services.

7. Program Office Certification

I certify that the description of the Government’s minimum needs, schedule requirements, and technical information that provide the basis for this justification are accurate and complete.
