Justification and Approval (J&A) for Other Than Full and Open Competition

I. Contracting Activity.
Department of the Air Force, Air Force Life Cycle Management Center - Operating Location Hanscom Air Force Base, Operational Contracting Division, 16 Eglin Street, Hanscom Air Force Base (HAFB), MA 01731
II. Nature and/or description of the action being processed.
The purpose of this J&A is to increase the ceiling on the current Multiple Award Contract for Small Purchase Orders (MACSPO), Indefinite Delivery/Indefinite Quantity (IDIQ) Contract by $4M to ensure a continuation of services.
Increasing the ceiling of this contract will provide Hanscom AFB enough contract value to compete current year projects, as well as providing enough time to complete a source selection for the new MACSPO IDIQ, which should be awarded after the end of the fiscal year.
III. Description of supplies/services required to meet agency needs.
The MACSPO IDIQ Contracts; FA2835-19-D-0001, FA2835-19-D-0002, FA2835-19-D-0003, FA2835-19-D-0004, FA2835-19-D-0005, FA2835-19-D-0006, FA2835-19-D-0010, FA2835-19-D-0011, and FA2835-19-D-0012 were awarded on 27 September 2019, as a Firm Fixed Price, Small Business Administration (SBA), 100% Small Business Set-Aside, in accordance with FAR Subpart 19.5. The Basic ID/IQ Contract was awarded with a three (3) year task order ordering period and a maximum contract ceiling total of $3.5M.
This IDIQ is in place to streamline the acquisition of small construction services projects, with a maximum/not to exceed amount for each task order of $250,000. The intent of the MACSPO IDIQ contract is for the contractor to furnish all requirements including but not limited to materials, labor, plans, tools, equipment, transportation, supervision, management, and quality assurance for a broad range of commercial services, supplies and maintenance, repair, alteration, and minor construction projects on real property at the following locations: Hanscom Air Force Base (HAFB), MA; Sagamore Hill Electronics Research Annex - Hamilton, MA; Fourth Cliff Recreation Annex - Humarock, MA; and Cape Cod Air Force Station - Sagamore, MA.
The current MACPSO awarded contract value is already above $3M and almost all executed in FY20. With 2 years remaining on the contract, there is only about $200k of ceiling value that remains. The MACSPO IDIQ contract has proven to be very successful and our customers have many more actions forecasted to be completed using this contract vehicle in FY21 alone; currently 125 ranging in size from $5k to $250k.
there are still over 100 projects slated for our customers to be completed this fiscal year.
There are several factors that led to the unanticipated usage of the MACSPO IDIQ in the first year. First, in FY19 Hanscom launched a "Workplace Improvement Initiative" that was meant to help members of Hanscom AFB and allow members of the base the ability to submit requests to Civil Engineering to improve their workplace. The types of work for this initiative included renovation of workplace bathrooms, renovate offices, fix/replace water fountains, painting and carpets etc.. Many of these actions fell under the SAT and were executed using the MACSPO IDIQ and funded by the base. Also, in FY19 AFMC created an initiative called "AFMC We Need", which is similar to the Workplace Improvement Initiative. This initiative was set forth to help members of AFMC complete their mission more efficiently and effectively, which includes a satisfactory workplace and work environment. Members are able to submit requests, through Civil Engineering, to AFMC to improve their working conditions and AFMC will fund these projects. The type of work for these projects also includes renovations to a workplace, renovations to a bathroom, replace a carpet etc. Unlike the Workplace Improvement Initiative, these are all larger dollar projects not executed using the MACSPO IDIQ, but caused other projects not initially slated for MACSPO to be awarded using this vehicle. These two initiatives, along with Civil

Engineering's workload for FY20, led to the MACSPO IDIQ executing a lot more projects than originally anticipated.
IV. Statutory authority permitting other than full and open competition.
The statutory authority for permitting other than full and open competition for the scope of work defined in Section III above is 10 USC 2304(c)(1), as implemented by FAR 6.302-1(a)(2), which states that when the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The current contractors, furnish all requirements including but not limited to materials, labor, plans, tools, equipment, transportation, supervision, management, and quality assurance for a broad range of commercial services, supplies and maintenance, repair, alteration, and minor construction projects on real property at the following locations: Hanscom Air Force Base (HAFB), MA; Sagamore Hill Electronics Research Annex - Hamilton, MA; Fourth Cliff Recreation Annex - Humarock, MA; and Cape Cod Air Force Station - Sagamore, MA. During source selection process, vendors were evaluated based on past performance, performance relevancy, geographic proximity and price. Originally the IDIQ was going to consist of five vendors, but it was determined that nine vendors were competitively acceptable. The contracts in place were competitively awarded on 27 September 2019 and the vendors have been very successfully performing this work for over one year.
The current MACSPO IDIQ contract is necessary to maintain current operational Civil Engineering workload requirements until a new follow-on IDIQ contract can be solicited and competitively awarded, which is not anticipated to be awarded until FY22. Even though there is time remaining on the current contract, not increasing the ceiling would cause significant/ unacceptable delays to current fiscal year projects. Once current ceiling is reached and no more orders can be placed on the IDIQ contract, the PZI contracting team would have to perform and complete full and open competitive source selections for each one of these actions. Each of these actions would take well over a month to complete, taking into account at least 30 days to solicit, as well as time for proposal review and execution. This is compared to an average of a 20 day turnaround under the current IDIQ contract, where our average solicitation lasts 14 days. And as mentioned above, with already 100 projects slated for this fiscal year, it would be impossible to meet our customer's FY21 goals. This would not be in the best interest to the Government, as the 66 ABG/CE will be delayed in providing the capabilities needed to Hanscom AFB; Sagamore Hill Electronics Research Annex - Hamilton, MA; Fourth Cliff Recreation Annex - Humarock, MA; and Cape Cod Air Force Station - Sagamore.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Based on the rationale in Section V above, it is not practicable to solicit additional sources for this immediate requirement.
This IDIQ ceiling increase will continue to provide fair opportunity for the current nine (9) vendors in the MACSPO IDIQ pool to bid on upcoming projects. All task orders will continue to be solicited to these vendors and the award of these task orders continues to be selected on a Lowest Price Technically Acceptable (LPTA) basis.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Costs are determined to be fair and reasonable on a task order by task order basis. The Government provides fair opportunity to the nine (9) vendors in the IDIQ pool to bid on each task order. Adequate price competition between competitors in the IDIQ pool allows the Government to determine costs to be fair and reasonable. The Government will continue to utilize this technique to determine fair and reasonable price for future task orders.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was not conducted for the ceiling increase because, as stated in paragraph V, it was determined that awarding this effort to any other contractor would not be in the best interest of the Government and would lead to unacceptable delays. However, increasing the ceiling will continue to allow for the same level of fair opportunity to all of the current nine (9) vendors to compete on future task orders. Also, market research will be conducted for the follow-on effort and because the type and scope of work will remain the same, it is more than likely that the current MACSPO vendors will compete on this contract
IX. Any other facts supporting the use of Other Than Full and Open Competition.

X. List of any sources that expressed, in writing, an interest in the acquisition.
The Government published a notice of contract action (NOCA) in Beta.Sam.Gov from April 8-23, 2021. There were no responses for expressed interest.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The Government is going to adequately perform a competitive source selection for the next iteration of the MACSPO contract, with an anticipated award to be made in FY22.
