JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: N102A IT/Engineering Supplies and Services; Department of the Navy, Military Sealift Command Norfolk (MSC).
2. Description of the Action Being Approved: This is a brand name justification for the use of other than full and open competition for a IDIQ purchase order for the NAVWAR Program of Record (POR) Commercial Broadband Satellite Program (CBSP) Unit Level Variant (ULV) High Power Amplifier (HPA) procurement.
3. Description of the Supplies/Services: This procurement is for Compact Tri-band amplifiers (Qty. 7). MSC has an urgent requirement to procure new NAVWAR POR CBSP ULV HPAs utilizing Original Equipment Manufacturer (OEM) brand parts from the Original Equipment Manufacturer (OEM) of the CBSP ULV HPAs. The following items are being purchased:
Compact Tri-band amplifier covering the 5.85 to 6.425/7.9 to 8.4/14.0 to 14.50 GHz frequency ranges, P/N T01T0B0SAA000F04 (qty 7).
4. Statutory Authority Permitting Other Than Full and Open Competition.
This justification is prepared under the provisions of 10 U.S.C. 2304(c)(1), One source or limited sources, as implemented by FAR 6.302-1(a)(2). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Communications & Power Industries Canada Inc. (CPI) is the Original Equipment Manufacturer (OEM) for the CBSP High Power Amplifier. As the OEM, CPI has certified that it is the only distributor of the required HPAs. Based on this, CPI is the only viable option to ensure MSC’s CBSP-equipped vessels remain operational and capable of supporting MSC and the warfighter missions.
MSC utilizes NAVWAR’s POR CBSP ULV system exclusively. Manufacturer identified is the manufacturer currently under to contract to provide the CBSP ULV HPAs for NAVWAR, the CBSP System POR Program Manager. Introducing a non-POR certified component would introduce incompatibilities as well as interruption of SATCOM services and offship connectivity.
USNS MERCY is currently on mission in Los Angeles providing emergency aid and hospital services during this global pandemic. Given the severity of the COVID-19 pandemic it is paramount that MSC move forward with HPA procurement as quickly as possible to prevent further delays in addressing CBSP CASREPS. CBSP must be maintained on MSC ships in order to ensure mission critical communications and sealift support operations. MERCY does not have a spare ULV HPA onboard.
MERCY’s Medical Treatment Facility (MFT) staff rely solely on CBSP bandwidth services to provide satellite communications for Video Teleconferencing, X-ray/Imaging, Telemedicine, Medical Messaging Service (MMS), Theater Medical Information Program (TMIP) and many others.
MSC's ISNS platforms are built based on NAVWAR Program of Record (POR) variants. The Commercial Broadband Satellite Program (CBSP) is a key POR component of the Commercial Satellite Communication (COMSATCOM) architecture. It provides both secure and non-secure voice and IP services to more than 30 USNS vessels (T-AKE, T-AOE, T-EPF, and T-AH ship class). One of the most critical components of the CBSP architecture is the Tri-Band, Traveling-Wave-Tube (TWT) High Power Amplifier (HPA). The TWT-HPA is a transmitter that amplifies RF signals, allowing more output power to drive the CBSP antenna. This gives the ship the ability to send email, phone calls, message traffic, fax, tactical chat, and video (teleconferencing) information off-ship. When the HPA fails to operate, the antenna can not transmit mission-essential data up to the satellite to receiving shore commands or coalition vessels at-sea.
Based on past performance historical data, along with a high rate of HPA-related C3/C4 CASREPS, the TWT-HPA is considered a HIGH-FAIL item. MSC currently is unable to respond to associated CASREPS in a timely manner.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
MSC utilizes NAVWAR’s CBSP ULV system only. Manufacturer identified is the manufacturer currently under to contract to provide the CBSP ULV HPAs for NAVWAR, the CBSP System POR Program Manager. Introducing a non-POR certified component would introduce incompatibilities as well as interruption of SATCOM services and offship connectivity. Because of this, no other sources were sought.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine that the price for the supplies/services covered by this J&A will be fair and reasonable pursuant to FAR Part 13.106-3 prior to issuance of purchase order.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, MSC has no plans at this time to compete future procurements for the type of supply covered by this document. If another potential SATCOM system emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
