About this file
This justification document and related federal contract opportunity outline requirements for a sole source acquisition of a brand name Brillians clinical support software license with maintenance and technical support from SupraVista by the Department of Veterans Affairs VISN 17 Health Care Network. The justification cites the proprietary nature of the Brillians source code which requires the software updates, security patches and technical support be provided only by SupraVista. The software provides required functionality including automated alerts and problem-centric reports at the point of care to maximize quality of care for Veterans. The period of performance for the 12-month base period and two 12-month option periods will allow access for an unlimited number of users to streamline documentation. Maintenance includes software updates, support for end-users to report issues, and resolution of application or configuration errors related to major updates.

Brillians SupraVista Software VA-23-00005617
With respect to the required maintenance and technical support, only Brillians has access to the proprietary source code necessary to provide the required software updates, security patches and technical support. Since the software is proprietary, a legal restriction is placed on access to the software code that is required to develop updates and patches to the software. Without this access, it is impossible to modify the software code as necessary to provide the required patches and updates.
Brillians is the only CSS software that can provide the necessary functionality and also integrate with VistA and CPRS. This functionality is required in order for providers to access healthcare data to maximize the quality of Veterans’ health care across the entire VA enterprise. Furthermore, it is the only product that provides automated alerts and problem-centric reports at the point of care. This not only saves search time for the clinician but also support staff time that would be spent developing data visualizations or entering in additional data. These required features are central to patient safety, quality of care, and provider productivity. The use of any other CSS software would require the redevelopment of interfaces to integrate with VistA and CPRS. The redevelopment of these interfaces are estimated to require a multi-year development effort and cost at least $2M. These estimates of duplicative costs and time are based on previous similar development efforts. These duplicative costs would not be recovered through competition.
Due to the limited amount of time that medical providers have to go through a large volume of patient data in Vista/CPRS, lack of a decision support tool that can interface with VistA to provide quick data visualization and analytics would not minimize risk of errors in patient care. Only the Brillians software can provide the required functionality that will help to prevent potential harm to patients and will assist providers to treat Veterans as quickly and efficiently as possible.
6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government’s requirements. There is no competition anticipated for this acquisition. In accordance with FAR 5.201, this action will be synopsized on the Contracting Opportunities Page. Any proposals received shall be evaluated.
7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed.
8. Market Research: The Government’s technical experts conducted market research in July 2022 by reviewing similar software to ascertain if other brands could meet VA’s requirements. Specifically, the Government’s technical experts conducted web-based research on alternative CSS software to include Turbonote and Medication Reconciliation. As a result of the market research, the technical experts confirmed that Brillians is the only source capable of providing the required CSS software as the source codes are proprietary. Additionally, no other provider of similar software can currently integrate with VistA and CPRS or the ability to provide automated alerts and problem-centric reports at the point of care. No alternative software can avoid the time and duplication of costs as outlined in Section 5 of this justification.
The Contract Specialist (CS) conducted market research in August 2022 utilizing National Aeronautics and Space Administration Solutions for Enterprise-Wide Procurement V Government-wide Acquisition Contract Provider Lookup Tool. The research revealed that there are no resellers of SupraVISTA/Brillians brand name products.
Lastly, on September 9, 2022, the CS contacted the OEM, SupraVISTA, to obtain confirmation that Brillians has no authorized resellers. Ms. Shirley Barrack, Manager of SupraVISTA, confirmed the same day that SupraVISTA is the creator, owner and sole seller of SupraVISTA/Brillians software. There are no other resellers that can provide the requested software and maintenance and technical support due to copyright and proprietary reasons.

12. Procuring Contracting Officer Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief.
Approval
In my role as procuring activity Advocate for Competition, based on the foregoing justification, I hereby approve the acquisition of a brand name Brillians software license inclusive of maintenance and technical support, on an other than full and open competition basis pursuant to the statutory authority cited in Section 4 above, subject to availability of funds, and provided that the property and services herein described have otherwise been authorized for acquisition.
