About this file
This is a Justification and Approval (J&A) document for a non-competitive contract action issued by the U.S. General Services Administration (GSA) Public Buildings Service.
GSA is extending the ordering period for 43 existing legacy Region 9 (R9) Construction Indefinite Delivery/Indefinite Quantity (IDIQ) contracts by six months, from August 15, 2026, through February 15, 2027. This is a no-cost modification with no additional funding obligated, and the $50M Maximum Ordering Limitation (MOL) for each contract remains unchanged. The extension is necessary to maintain construction capability and prevent critical gaps while GSA completes competitive follow-on IDIQ procurement evaluation and award, estimated for January 2027. The extension covers four zonal areas: Zone 1 (AZ/NV), Zone 2 (Northern CA), Zone 3 (HI), and Zone 4 (Southern CA). The J&A cites FAR 6.103-1 authority under "Only One Responsible Source" (41 U.S.C. 3304(a)(1)), asserting that legacy R9 incumbent contractors are the only reliable source capable of executing FY26 BA54 (Basic Repairs and Alterations) projects and anticipated BA80 projects during this critical bridge period. Market research conducted in April 2026 demonstrated that Zone D national IDIQ contractors cannot serve as a viable sole ordering vehicle due to limited interest in small projects under $350K, reduced geographic capacity concentration within legacy R9 states, and insufficient operational experience in the region. Legacy R9 contractors demonstrated high interest (4.3 of 5.0 rating) in small projects and average concurrent project capacity of 11.5 projects, compared to Zone D contractors' 3.2 interest rating and 8.6 average capacity spread across 14 western states. All 43 incumbent R9 IDIQ contracts are held by small businesses, supporting GSA's socioeconomic goals. Task orders will be competed among multiple eligible contract holders within their respective zones to ensure competitive pricing under established option year four rates. The document was approved by the Contracting Officer and is posted to SAM.gov in accordance with FAR 6.301.
