Justification and Approval (J&A) for Other Than Full and Open Competition
[ ] Page 2 of 3
I. Contracting Activity.
118th MSC 240 Knapp Blvd Nashville, TN 37217
II. Nature and/or description of the action being processed.
This brand name or equal justification is for the purchase of Origin laptops.
III. Description of supplies/services required to meet agency needs.
The computers to be purchased support a Joint Special Operations Command (JSOC) specific requirement. When procured, these machines will replace existing laptops that have passed their service support expiration date. The existing laptops are no longer refreshed or supported by JSOC, and that represents an unacceptable risk to 118th Operations Group missions, and the supported unit..
IV. Statutory authority permitting Other than Full and Open Competition.
10 USC 2304(c) (1), as implemented by FAR 6.302-1, “Only one responsible brand name or equal source will satisfy agency requirements” to be compatible with existing products installed at higher command requirements.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The Origin or equivalent laptops required to support the JSOC requirement have specific performance specifications, and limited approved vendors. The performance requirements specifically supporting onboard graphics acceleration, processing power, high speed memory and suitable security protocols eliminate the possibility of procurement via full and open competition. Among the essential activities performed on these machines by aircrew and mission support personnel:
a. Primary IP-based voice communications with Joint Terminal Attack Controller
b. Real-Time Common Operating Picture and Tactical Situation Display.
c. Enclave specific, mission essential MiRC.
d. Enclave specific full motion video from airborne assets.
e. Enclave specific network access supporting full range of planning products and documents.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
This solicitation will be posted on Beta.Sam.gov along with this brand name or equal justification. All vendors meeting or exceeding the minimum salient physical, functional and performance characteristics may compete.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
This product is used in existing operations. Since the product is currently used, the Government has sufficient cost data to evaluate costs provided under this action. In addition, pricing data is available via contract vehicles for comparison. If needed, additional (other than certified cost and pricing) data will be utilized in determining the price fair and reasonable.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was conducted and multiple vendors sale brand name or equal laptops in the industry. It is expected sufficient competition will be received.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
Brand name or equal specifications will be used to increase competition.
X. List of sources, if any, which expressed interest in the acquisition.
Origin PC and Alienware
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
