About this file

This document is a Brand Name Justification and Approval (JA) for a Federal Contract Opportunity to procure a renewal of Oracle Database software licenses and support for the Utah Army National Guard. The acquisition is being conducted under the authority of FAR 6.302-1(c) as a brand-name total small business set-aside. The estimated period of performance is October 29, 2024 to October 28, 2025. The JA cites the complexities and costs associated with switching to a competing database as the justification for the brand-name procurement. The total small business set-aside will be posted on SAM.gov, with award based on lowest price technically acceptable evaluation criteria. Vendors must be registered in SAM and provide pricing, small business certifications, and other required information in their quotes, which are due by 0800 AM MST on October 21, 2024.

BRAND NAME JUSTIFICATION and APPROVAL

Purchase Requisition# 12200902

Organization/Line Office: Utah Army National Guard, JFHQ G6-DPI

Description of Action being approved: New contract, Firm-Fixed price

Description of Product, Supplies or Services required to meet the Agency’s needs: Oracle Database Renewal

An identification of the statutory authority permitting other than full and open competition: This acquisition is being conducted under the authority of Federal Acquisition Regulation (FAR) 6.302-1(c).

Identification of the Justification Rationale:

1. With the complexities and scope of this software, switching to a competitor database software at this time is not reasonable or cost-effective and would create an interruption in regular software database operations.

Any competitor software would require a similar level of design, configuration, tuning and customizing, training and maintenance.

2. The Oracle Database software provides version updates, security, and stability patches as well as technical support and access to the online knowledge base and documentation. This will help ensure timely routine maintenance and timely critical problems. The Oracle Database software provides patches for all server systems running the database software to keep each of these servers and entire system stable and secure.

3. The Oracle Database software is already owned and operated by the UTARNG G6-DPI. It would be cost prohibitive to attempt to replace our network platforms with a different vendor. Standardization to a single device/brand simplifies training, maintenance, and logistical support of the systems we operate.

Fair and Reasonable Price Determination: Award issued under this individual limited source justification represents a fair and reasonable price as the agreed to pricing will be based upon competitive quotes received from authorized retailers of the brand in a competitive environment. Price analysis will be performed on all quotes received. Therefore, the price paid will represent the best value and result in the lowest overall cost to meet the needs of the Utah National Guard.

Actions to Increase Competition: This requirement was originally limited to the vendors within the Army’s IT mandatory source CHESS, IAW AFARS 5139.101-90(a)(1), AR25-1, and DA PAM 25-1-1. However, a CHESS Statement of Non-Availability (SoNA) was obtained indicating this requirement cannot be fulfilled through CHESS.

Therefore, this requirement will be posted on SAM.gov as a Total Small Business Set-Aside.

Market Research conducted: Reviewed publicly available information on CHESS and in the marketplace, including FPDS.gov. Conducted additional market research from prior year contracts awarded from our agency and other government agencies. Market research revealed there is a reasonable expectation of receiving two (2) or more small business quotes that are competitive in terms of fair market prices, quality, and delivery IAW FAR 19.502-2(a).

Technical Cognizance: As the technical or requirement personnel, I certify that the supporting data under my cognizance, which are included in the justification are accurate and complete to the best of my knowledge and belief.
