About this file

This justification and approval document concerns the award of a sole source contract to 3M Scott Safety for fifty-three Scott/3M Air-Pak X3 PRO self-contained breathing apparatuses. The Marine Corps Air Station Iwakuni Emergency Fire Rescue currently uses Scott/3M branded face masks, regulators, and air bottles that are only compatible with Scott/3M branded breathing apparatuses. The unit cannot mix equipment from different manufacturers or use older Scott/3M models that do not meet the current NFPA standards. Awarding this sole source contract will allow the Emergency Fire Rescue to maintain operational capability by ensuring the new breathing apparatuses can be used with their existing Scott/3M equipment inventory without requiring additional accessory purchases.

UNITED STATES MARINE CORPS

REGIONAL CONTRACTING OFFICE

MARINE CORPS INSTALLATIONS PACIFIC-MCB CAMP BUTLER

UNIT 35001

FPO AP 96373-5001

IN REPLY REFER TO:

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

M62613-FY20-SSBN-01

1. Contracting Activity.

Marine Corps Air Station Iwakui (MCASI), Regional Contracting Office (RCO)

2. Description of the Action Being Approved.

Award of a contract of Scott/3M Air-Pak X3 PRO which is the current Self Contained Breathing Appartus (SCBA) model and conforms to the NFPA 1981/1982, 2018 Edition. This SCBA is the newest Model produced by Scott/3M. MWSS-171 Emergency Fire Resucue (EFR) currently utilizes Scott/3M products such as Face Masks, Face Respirators, and Air Tanks. The current Scott/3M SCBAs in use are discontinued but the Face Mask, Face Respirators and Air tanks conform with the new Scott/3M Air-Pak X3 PRO. MWSS-171 EFR cannot mix match pieces with different brand names.

3. Description of Supplies/Services.

Scott/3M Air-Pak X3 PRO Product Code X8914025305303

Quantity 53.00

Funding is provided by unit fiscal year 2020 Operations and Maintenance, Marine Corps (O&MMC) funds.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), One source or limited sources.

5. Rationale Justifying Use of Cited Statutory Authority.

MWSS-171 EFR Currently utilizes Scott /3M Brand SCBAs and this procurement must be for Scott /3M Brand because the 65 Face Masks, Face Regulators and Air Bottles that EFR currently has in stock and currently use will only work with Scott/3M Brand SCBAs. EFR is not able to use any other brand of SCBAs with the equipment they currently have in stock. Scott/3M company has also certified MCAS Iwakuni Base Fire Dept. and MCAS Iwakuni Station Aircrraft Rescue and Firefighting (ARFF) and MWSS-171 EFR as a certified repair center for Scott SCBAs. EFR also has Scott Certified repair technicians in the unit. EFRs current Scott SCBAs are older models and are no longer within the NFPA 1981/1982, 2018 Edition.

The Scott/3M Air-Pak X3 Pro is the current model and conforms to the National Fire Prevention Association (NFPA) 1981/1982, 2018 Edition. These updated SCBAs will work with the current

J&A No. M62613-FY20-SSBN-01

Scott equipment that EFR already possesses, therefore reducing the need to buy new SCBA Regulators, Face Masks, and Air Bottles. If a different brand other than Scott SCBA is awarded, EFR would not be mission capable since they would not have the correct pieces to complete a full SCBA. EFR would have to order the Face Mask, Face Regulators, and Air Bottles to match the new equipment. Thie would result in an additional cost of more than $90,000 This would put EFR in a non-operational status until that order was completed.

Additionally, both MCAS Iwakuni ARFF and MCAS Iwakuni Base Fire Department utilize the Scott/3M Brand. This is significant in the fact that we are all able to use each other’s gear if needed in a mutual aid environment. In the event of a lifesaving situation such as a live fire incident if needed we can allow our fellow firefighter to hook into and breath off of our air-pack and get them to safety if that person’s air supply were to run out.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

On 28 August, the RCO posted a presolicitation notice with request for information on products that are compatible with the current Face Masks, Face Regulators and Air Bottles. The RCO received two responses interested in provided quotes for the name brand items. One of the offerors confirmed the requirement to be name brand only: that there are no other brands that can meet the Government’s requirement. The following is a quotes from the contractor:

“I note on your pre-solicitation request that you are seeking alternatives that must be compatible with the Scott/3M facepieces and cylinders that are additional components to make up a SCBA.

Unfortunately, it is not acceptable per NFPA standards and NIOSH to mix and match manufacturers' respiratory products. They must be the same manufacturer.”

7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

The contracting officer will determeine the prices to be reasonable in accordance with the Federal Acquisition Regulation

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5 and 6, MCIPAC has no plans at this time to compete future contacts for the types of supplies/services covered by this document. The requirement to procure the current modiels will remaint until the NFPA and National Institute for Occupational Safety and Health (NIOSH) standards are changed, or the Government procures entirely new equipment.
