About this file
This document is a Single Source Justification form for a brand name procurement by the Department of Veterans Affairs (VA). The VA Network Contracting Office in Ridgeland, MS seeks to acquire a specific MAXISONIC XL Tabletop Sonic Irrigator (Model MAX-2) for the Veterans Health Care System of the Ozarks in Fayetteville, AR. The justification explains that this particular model is the only option meeting the facility's operational requirements, with unique capabilities to work with domestic/city water, deionized water, and reverse osmosis water without risking equipment corrosion or failure.
The procurement is being conducted as a firm fixed-price award limited to veteran-owned small businesses, following market research that confirmed multiple potential vendors. The justification highlights the critical nature of the equipment for instrument cleaning and sterile processing, emphasizing that alternative models could compromise surgical instrument preparation and patient care. The document is dated for implementation on 11/15/2024, with the acquisition falling under the Simplified Acquisition Threshold (SAT) of $250,000, and references sources sought solicitation 36C25625Q0865.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
Revision: 01 Effective Date: 11/15/2024 Page 1 of 2 Acquisition ID#
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source (& Brand Name) Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C256-25-AP-2042
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 16, 715 South Pear Orchard Road, Ridgeland, MS 39157, in support of Veterans Health Care System of the Ozarks 1100 N. College Avenue, Fayetteville, AR. 72703.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
This justification is for a limited-source procurement for a specific brand name product, the MAX-2, MAXISONIC Tabletop Sonic Irrigator. This action is conducted pursuant to FAR 6.302-1(c), which authorizes brand name acquisitions. The Fayetteville VA Medical Center has a need for a specific brand name product, the MAX-2 MAXISONIC Tabletop Sonic Irrigator to replace the current irrigators that are beyond life. The Max-2 irrigator is essential in proper cleaning of instrumentations using deionized water, and reverse osmosis water options.
3. Unique characteristics that limit availability to only one brand name, with the reason no other supplies or services can be used:
Brand Name: MAXISONIC XL Tabletop Sonic Irrigator Model/Version: MAX-2
This specific model is the only option that meets the facility’s operational, spatial, and infrastructure requirements without requiring costly modifications. It is the only model that currently fits with the existing connection at the medical facility and have the combination of Domestic/City water. Equivalent sonic washers have copper pipes and could not use deionized water in them. Additionally, the MAX-2 is compliant with the different combinations that are required, Domestic/City Water, Deionized Water (DI), Reverse Osmosis Water (RO). Equipment cannot have copper as the DI will react to the copper causing chemical reaction and corrosion.
Other brands do not support this type of water connection system, which increase the risk of premature equipment failure, higher maintenance costs, and potential disruptions to the instrument processing system. An alternative irrigator would introduce significant risks to the instrument washing and precleaning process, including infrastructure incompatibility, extended installation timelines, and potential warranty and support issues, all of which could negatively impact sterile processing operations. Any delay or malfunction in sterile processing equipment at the VA https://www.acquisition.gov/?q=/browse/far/13

4. Description of market research conducted and results or statement why it was not conducted:
Based on the market research conducted, the consideration of the NMR, the Buy American Act/Trade Agreements, and sources sought 36C25625Q0865, several veteran owned small businesses can provide the brand name equipment required.
Therefore, pursuant to FAR 6.302-1(c), this requirement will be a firm fixed price veteran owned limited-source award. This market research information is not more than 12 months old.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
