About this file

This is a Justification and Approval (J&A) document for a 6-month bridge contract for dorm management services at the DHS Federal Law Enforcement Training Centers (FLETC) in Glynco, Georgia. The J&A supports awarding a sole source contract to T47 International Inc. of Clinton, Maryland for the period January 1 - June 30, 2025, due to unusual and compelling urgency following unsuccessful negotiations to extend the incumbent contract 70LGLY18CGLB00003 which expired December 31, 2024.

The bridge contract covers dorm management services for nine dormitories containing 2,093 rooms/2,957 beds, including project management, custodial services, desk clerk services, preventive/routine maintenance, locksmith services, and pool/cold tub maintenance. The sole source award to T47 International was justified because they currently hold other FLETC contracts, have vetted personnel with facility access, and can mobilize immediately to prevent disruption of services for approximately 1,780 current resident students. The follow-on competitive 8(a) solicitation 70LGLY24RGLB00001 is currently under GAO protest with a decision expected mid-January 2025. The contract type is firm-fixed-price using FY2025 operations and support funds.

Dorm Management Services Justification and Approval (J&A) Bridge Contract

(f) Year of funding: Fiscal Year 2025

(g) Solicitation number: None

(h) Background information about the requirement.

Documentation required to initiate the follow-on contract was received and solicitation 70LGLY24RGLB00001 commenced. A presolicitation notice was posted to SAM.gov on November 15, 2023 for this action and solicitation documents were released November 29, 2023 as a competitive 8(a) set aside with a closing date for receipt of proposals established for January 2, 2024. Award was anticipated for Mid-February 2024 to allow for a 30-day phase-in prior to the contract expiration in March 2024. Multiple protests were then issued against solicitation, 70LGLY24RGLB00001 with the latest pending a GAO decision by mid-January 2025 as discussed in paragraph 7 below.

Contract 70LGLY18CGLB00003 expired at midnight December 31, 2024. While the follow-on solicitation has been in process since January 2, 2024 with an award anticipated for mid- February 2024, extenuating circumstances have resulted in substantial delays for the new award as follows:

Solicitation 70LGLY24RGLB00001 was released November 29, 2023 with proposals due January 2, 2024. Proposals were received timely that included the following submissions:

Management & Technical proposal, Past Performance proposal, and Price proposal.

Evaluations for all submissions were completed February 7, 2024. A review of the evaluation reports determined award without discussion was not feasible. The evaluation delay resulted in the need for a 3-month extension to cover April 1, 2024 through June 30, 2024 to allow more time in the solicitation award process. That was finalized by Modification P00081 on March 15, 2024.

On April 18, 2024, a competitive range (CR) was established. On April 25, 2024 offerors were notified on whether each was included or excluded from the CR and those included were advised that the final proposal revision submissions were due on May 2, 2024. On May 13, 2024 an excluded offeror filed a Pre-award Protest because of their exclusion from the competitive range. Corrective action was taken by including that offeror into the competitive range, affording them the same opportunity as other offerors in the competitive range to submit a Final Proposal Revision. This resulted in in the need for a 3-month extension on the now expired contract to cover July 1, 2024 through September 30, 2024 to allow more time in the solicitation award process. That was finalized by Modification P00084 on June 7, 2024.

On July 9, 2024 due to the lengthy delay in award, offerors were requested to provide updated pricing for a revised base period to reflect a full 12-month pricing vice 6-months.

Final Price Proposals were received July 12, 2024. Award process was initiated and on August 6, 2024 Preaward Notices for Small Business Programs were issued.

Dorm Management Services Justification and Approval (J&A) Bridge Contract negotiations to further extend the current contract, the parties could not reach agreement on a price that the Government could determine fair and reasonable, leading the contractor to cease negotiations less than 2 full business days before the contract expiration. As a result, unusual and compelling is present due to the unforeseen and unexpected pending break in service with less than 2 remaining calendar day in the current contract’s period of performance. FLETC has determined that a sole source award with no possibility to resolicit for award using competitive procedures was imperative to preserve the integrity of its mission. Without this critical service, FLETC would be subject to a paralyzing situation that could permanently damage the reputation of not only FLETC, but Homeland Security as a whole. It will weaken the current operations and decrease the ability to properly train and maintain security measures for our student population at the expected level of our stakeholders.

The existing contract expired at 11:59PM (EST) on December 31, 2024, necessitating the removal of all contractor-furnished supplies. Given the inability to extend the current contract at a fair and reasonable price and the limited time available to secure a new contractor, FLETC was tasked with identifying a contractor that possesses readily available resources and immediate access to FLETC facilities.

T47 International has been identified as the sole contractor capable of meeting these requirements and commencing operations with less than 30 hours’ notice to prevent a disruption in these critical services.

T47 holds an existing contract with FLETC for functions aligned with NAICS 561720 and is certified as an 8(a) participant. Additionally, T47 has a partnership with subcontractor Resort Services (RSI), which would allow for the immediate transition of all linen and cleaning services during a vital 6-month bridging period. This arrangement is crucial to prevent the displacement of over 1,500 occupants into local hotels, potentially saving the Government more than $300,000 per night.

A lapse in contract support would present an unacceptable risk to FLETC Glynco Training Delivery Point (TDP). Should these critical services become unavailable, it could severely disrupt FLETC's ability to provide necessary training for approximately 100 federal agencies that collaborate with FLETC. During the bridge period, there are 750 classes scheduled for 20,731 students, not counting the 1,780 students currently housed at the center as of December 2024.

Furthermore, unless award is made to T47 that can begin performance immediately to prevent a lapse in services, the Government will be seriously injured financially and suffer irreversible damage. Displacing these students would create a financial burden for the Government in finding alternative accommodation, while also triggering additional costs and complications related to other critical services. Specifically, transportation, food services, and security cost would substantially increase at a rate that is not feasible for the government, strain the contractors’ resources and disrupt normal operations, and create a heightened threat level for safety of each individual while staying at multiple hotels within a 60-mile radius of FLETC.

The Government established timeline for period of performance is consistent with the projected resolution of the current protest. The Government allotted time for this bridge to cover the
