About this file
This is a Justification and Approval (J&A) document for a sole-source procurement by the Federal Bureau of Investigation.
The FBI, through its Finance and Facilities Division and Architectural Engineering Service Unit, is seeking to award a sole-source contract to KI (Krueger International) for replacement seating components for 800 fixed seats in the B5 classrooms at FBI Academy Quantico. The procurement includes all labor, parts, delivery, installation, and associated execution costs. The justification for limiting competition to KI is based on system compatibility and proprietary design constraints—only KI manufactures seating components compatible with the existing fixed KI bases. The document notes that using non-KI components would require complete replacement of the entire seating system, which would exceed budget constraints and cause unacceptable disruption to ongoing training operations. Market research confirmed that KI is the only source capable of providing compatible replacement components, with other manufacturers including Sedia Systems evaluated and found incompatible. The procurement is authorized under 41 U.S.C. 3304(a)(1) and FAR Subpart 6.103-1 for situations where only one responsible source exists. KI is noted as the only qualified source holding proprietary specifications for the installed seating and is essential to maintain warranty integrity and ensure proper installation. The FBI indicated future competitive procurement opportunities may be explored during comprehensive classroom renovations or full seating system replacements.

JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN
FULL AND OPEN COMPETITION
Attachment M – J&A
Procurement Section Format Update: 06/22/2026
Justification for Other than Full and Open Competition in Accordance With 41 U.S.C. 3304(a)[(1)] Only one responsible source
Title: Replacement seating components for fixed existing KI seating systems Date: 9/14/2026
1. Identification of the agency and the contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Architectural Engineering Service Unit, has prepared this Justification for Other than Full and Open Competition for replacement seating components for the fixed seating system on behalf of the Finance and Facilities Division.
2. The nature and/or description of the action being approved, i.e. sole source, limited competition, establishment of a new source, etc.
The FBI intends to award a sole-source procurement to KI (Krueger International) for replacement seating components for the fixed seating system installed in the B5 classrooms. This procurement includes all labor, parts, delivery, installation, and associated execution costs.
This document provides justification for limiting competition based on system compatibility, proprietary design constraints, and mission-critical operational requirements.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value)
Replace fixed seating components on 800 seats in the B5 classrooms at FBI Academy Quantico. Includes all required parts, installation, delivery, and labor.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.103-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate that the proposed contractor’s unique qualifications or the nature of the acquisition requires using the authority cited.
Only KI manufactures seating components compatible with the existing fixed KI bases. Proprietary engineering and design limitations prevent other manufacturers from supplying suitable replacement parts.
Using non-KI components would require full replacement of the entire seating system, exceeding budget constraints and causing unacceptable disruption to ongoing training.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will not be publicized as required by Subpart 5.1 and, if not, which exception under 5.101 applies.
• Compatible in form, fit, function with existing KI bases
• Proprietary design limits competition
• Direct replacement components required
• Warranty and structural integrity rely on KI components
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
Using non-KI components would require full replacement of the entire seating system, exceeding budget constraints and causing unacceptable disruption to ongoing training.
8. A description of the market research conducted and the results.
Market research confirms supplies are available through the FSS and that KI is the only source capable of providing compatible components. Sedia Systems and other manufacturers were evaluated but found incompatible.
9. Any other facts supporting the use of other than full and open competition.
KI retains proprietary specifications for the seating installed in B5 and is the only qualified source for compatible replacement components. Their support is essential to maintain warranty integrity and ensure proper installation.
10. A listing of any sources, if any, that expressed a written interest in the acquisition.
Other manufacturers were evaluated but found incompatible. KI is the only source capable of providing compatible components.
11. A statement of any actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
The FBI will explore competitive options during future full classroom renovations or full seating system replacements, which may permit competitive procurement. The customer will continue due diligence to reduce constraints on competition where possible.
