JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Amendment #1
1. Nature and/or Description of Action A Justification and Approval (J&A) for Other Than Full and Open Competition, dated 22 November 2017, for “Mobile Field Kit-Chemical Biological, Radiological, and Nuclear (MFK- CBRN) development and Support”, was executed by the Defense Threat Reduction Agency and provided authority to execute Contract HDTRA1-19-C-0006 with World Wide Technologies/Asynchrony Solutions (WWT/AS). The contract was initially awarded on 18 October 2018 with a base period of performance (PoP) of 19 October 2018 through 18 October 2019 and included three one-year options through 18 October 2022. The contract was awarded with an estimated value of $8,671,505.
The DTRA contracting activity proposes to modify the existing contract to increase the ceiling from $7,000,000 to $9,166,505.
2. Description of the Supplies/Services Required DTRA has equities in developing advance situational awareness (SA) software specifically tailored to the warfighters needs in CBRN environments. These needs not only include common SA tools, but also include requirements driven by the unique environments that CBRN threats pose.
The National Guard Bureau (NGB) has requested research and development support from DTRA under the National Guard’s Chemical, Biological, Radiological, Nuclear, Explosives Response Enterprise Information Management System 2018 (NG CIMS 2018) Program. NG CIMS 2018 is a three phase program to support requirements from the Joint Requirements Oversight Council and the House Armed Services Committee. NGB chose the DTRA technology MFK-CBRN to satisfy many of the requirements in all three phases of NG CIMS 2018.
NGB is currently in phase II and has fielding MFK-CBRN with NG-CIMS to 37 of 57 teams and will complete fielding by the end of FY20. Once MFK-CBRN is fully fielded, the capabilities provided by the current MFK-CBRN release must be continually available to NGB users and additional development of MFK-CBRN is required to maintain cybersecurity as well as meet the requirements in phase III development. Under the current contract Asynchrony is tasked to develop information management modules and interface these modules with the baseline capabilities of MFK-CBRN. These modules include personnel management, logistics and supply management, team and entry management, and reports management. They must also continue to integrate Tactical Assault Kit (TAK) software capabilities with MFK-CBRN to ensure CBRN response mission data is fully synchronized. They must refine the graphical user interface (GUI) for tablet and laptop systems and develop GUIs for vehicle platforms.
Additionally, they must further integrate NGB CRE directed sensors in MFK-CBRN.
As a part of the transition of the software from DTRA to NGB, units that regularly work alongside NGB have determined that MFK-CBRN would meet their existing CBRN Situational Awareness Gaps with minor modifications. The Joint Task Force for Civil Support (JTF-CS) has requested DTRA provide minor software modifications and testing and evaluation support to facilitate their adoption of the technology. As a result, DTRA requires an increase to the contract ceiling in the amount of approximately $165,000 for the remaining three contract years for a total increase of $495,000.
The J&A for this original effort was $7,000,000; the actual contract was awarded for $8,671,505.
At the original ISS the DTRA program office assumed a full contract ceiling of approximately $7,000,000 and the J&A was processed based on the ISS information. The ISS assumed a level of effort similar to previous Tactical CBRN Situational Awareness software development. The original IGCE of $7,000,000 was refined to the final IGCE amount of $8,450,159. One of the contributing factors for this change was the initial IGCE assumed lower labor rates than the final approved IGCE. The average difference in rates from the initial to final IGCE, across all labor categories, was approximately 23%.
The IGCE assumed many of the tasks in the SOW could be completed by integrating open-source software libraries and algorithms into the MFK code base. While this was true for some of the proposed modules, many required developing software translation libraries to ensure the final deployed system would be interoperable with all of the NG CIMS software and hardware.
The cost-difference from the IGCE to the contract award is largely due to increased level of effort for the Senior Software Engineer, Software Engineer, and Quality Engineer. The J&A was finalized in November 2017 and the IGCE was finalized in February 2018. The J&A was never readdressed after the finalized IGCE or the anticipated contract award.
3. Statutory Authority The statutory authority for this non-competitive action is 10 United States Code (U.S.C.)
2304(c)(1) or 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source.
4. Applicability of Authority World Wide Technologies/Asynchrony Solutions (WWT/AS) under contract HDTRA1-19-C- 0006 is responsible for developing, and supporting testing of MFK-CBRN for the NG CIMS program. This contract was entered into under the authority of Justification and Approval (J&A) for Other Than Full and Open Competition, dated 22 November 2018, for “Mobile Field Kit- Chemical Biological, Radiological, and Nuclear (MFK-CBRN) development and Support,” executed by the Defense Threat Reduction Agency. The contract was awarded with a period of performance from 19 October 2018 through 18 October 2022.
The requested contract ceiling increase addresses the operational needs identified by the Joint Task Force for Civil Support (JTF-CS) for CBRN Situational Awareness tool development. This will include human/computer interface engineering, software design and development, and field testing.
The cost of another performer to gain a functional understanding of the MFK software is expected to be exceed the benefit of competitive competition. For new performers to develop successful software for JTF-CS, the performer’s software engineers, design engineers, and quality advocate engineer must develop a functional understanding of the core MFK-CBRN software. This is anticipated to cost approximately $300,000 over a six to twelve month period.
The work required by a new performer to meet the requirements of JTF-CS would be a duplication of effort and the cost if this effort are not expected to be recovered through competition. Additionally, the delays associated with a new performer will prohibit JTF-CS from fielding this capability by the end of fiscal year 2022. This is the time constraint that an alternative vendor cannot meet and would result in unacceptable delays in meeting the Government's requirements.
5. Effort to Solicit Potential Sources
A Federal Business Opportunities (FedBizOpps) notice of the proposed action will be published as required by FAR 5.2. As part of this notice, all responsible sources will be invited to submit a capability statement which shall be considered by the Government.
6. Fair and Reasonable Costs The anticipated cost/price of this contract action to the Government will be determined to be fair and reasonable based on inputs and evaluations from the DTRA Program Office, analysis of cost and pricing data, field pricing support from the Defense Contract Audit Agency and/or Defense Contract Management Agency (DCMA), and an analysis of the historical software development and test and evaluation support.
7. Market Research A review of the historical acquisition information revealed that WWT/AS has a significant history of over 10 years and has performed as the prime contractor for the development of the Mobile Field Kit-CBRN.
An RFI was published in FedBizOps (solicitation number: HDTRA1-J9NTD-20170719) on 19 July 2017 with a response deadline of 09 August 2017 in order to reach a large performer base.
A total of four responses were received that addressed the RFI. Responses received from Dynamis and TRX proposed the use of the Cobra 2020 platform and TRX mapping tools, respectively, as replacement technologies to meet the NG-CRE and JPdL-RND user needs.
Adoption of these tools and modifications to the software to meet the user needs would be cost prohibitive and add additional time to the program. Both Enlighten IT and Asynchrony responses addressed the NG CRE needs for information management tool development. The Enlighten IT product includes tools that could be adapted for NG CRE use. The tools would require significant modifications for use by CRE elements, as well as production into an MFK- CBRN plugin. The Asynchrony response fully addressed the requirements presented in the RFI.
Asynchrony has demonstrated the ability to perform software development for MFK-CBRN from day-one with no risk. Dynamis, Enlighten IT, and TRX have demonstrated the ability to develop software for CBRN situational awareness and information management; however, there is significant cost and time risk with their ability to adapt their products to meet the needs of DoD CBRN operational users within the MFK-CBRN architecture.
The DTRA program office continues to evaluate potential performers through the Nuclear Detection Division Broad Area Announcements. In the 2019 call for submission, NTD requested proposals for C-WMD and consequence management operations software development. The work was requested in topic NT-19-DET-02 (Enabling Algorithms for Nuclear Threats Analysis and Mapping). Twenty-three proposals were submitted to phase I. Of the 23 phase I proposals, 19 included algorithm development that would later require inclusion in MFK-CBRN. Four proposals included new situational awareness tools to replace MFK-CBRN.
There were no proposals identified that include development that directly supports the needs of DTRA users or JTF-CS.
8. Interested Sources None
9. Subsequent Actions It is anticipated DTRA will continue to develop software modules for MFK-CBRN as the DoD user base grows. DTRA will investigate requirements that the MFK-CBRN software move to an open “plug-in” based architecture where clear interfaces are specified that allow competition for specific capabilities to be added to the software without effecting the operational capability in the software. This may allow for competition to additional capabilities, but is not likely to allow for competition on the core software.
