About this file

This document is a Justification and Approval (J&A) for the use of other than full and open competition to procure the inspection, repair quote, and repair of 20 High Power Amplifier (HPA) assemblies for the Naval Information Warfare Systems Command (NAVWAR) Commercial Broadband Satellite Program (CBSP) Unit Level Variant (ULV) system.

The J&A identifies Communication & Power Industries Canada, Inc. (CPI) as the Original Equipment Manufacturer (OEM) and sole authorized technical representative qualified to conduct the required repairs. It states that introducing a non-Program of Record (POR) certified component would introduce incompatibilities and interrupt satellite communications services. The estimated value of the requirement is to be determined, and it will be funded using 100% Navy Working Capital Funds. The contract will be structured with three separate line items for inspecting all 20 HPAs, repairing the first 10 HPAs, and repairing the second 10 HPAs. Based on the rationale provided, the Contracting Officer has determined the anticipated cost to the government will be fair and reasonable.

Navy Marine Corps Acquisition Regulation Supplement APRIL 2018 (Change 18-24)

ANNEX 1 – JUSTIFICATION AND APPROVAL

J&A No. N102-24-R-4007

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

N102A Engineering Supplies and Services, Cyber Services Branch, Department of the Navy, Military Sealift Command Norfolk (MSC).

2. Description of the Action Being Approved.

This is a sole source justification for the use of other than full and open competition to procure the inspection, submission of repair quote, and full repair of the Naval Information Warfare Systems Command (NAVWAR) Program of Record (POR) approved Commercial Broadband Satellite Program (CBSP) Unit Level Variant (ULV) High Power Amplifiers

(HPA).

3. Description of Supplies/Services.

This requirement describes the inspection, submission of repair quote, and full repair of HPA assemblies (if requested by the Government) for QTY twenty (20) HPAs by Communication & Power Industries Canada, Inc. (OEM) and sole Authorized Technical Representative for the HPAs.

The estimated value of this procurement is: TBD This requirement will be funded using 100% NWCF.

The approved ITPR is # 388504.

The contract will be awarded with the following CLIN arrangement:

CLIN 0001 - Inspection of all of all twenty (20) HPAs CLIN 0002 – Repair of the first ten (10) HPAs CLIN 0003 – Repair of the second ten (10) HPAs

4. Statutory Authority Permitting Other Than Full and Open Competition.

This justification is prepared under the provisions of 10 U.S.C. 2304(c)(1), One source or limited sources, as implemented by FAR 6.302-1(a)(2). Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Communications & Power Industries Canada Inc. (CPI) is the OEM for the CBSP HPA. As OEM, CPI has certified that it is the only distributor and only authorized technical representative that is qualified to conduct repairs on the HPAs. Based on this, CPI is the only viable option to ensure MSC’s CBSP-equipped vessels remain operational and capable of supporting MSC and the warfighter missions.

MSC utilizes NAVWAR’s POR CBSP ULV system exclusively. The manufacturer identified is the manufacturer currently under contract to provide and service the CBSP ULV HPAs for NAVWAR, the CBSP System POR Program Manager. Introducing a non-POR certified component would introduce incompatibilities as well as interruption of Satellite Communications (SATCOM) services and off-ship connectivity. These HPAs are Naval Information Warfare System program of record approved items and the time necessary to get an alternative item approved would result in mission failure. MSC's Integrated Shipboard Network System platforms are built based on NAVWAR POR variants. The CBSP is a key POR component of the Commercial Satellite Communication (COMSATCOM) architecture.

It provides both secure and non-secure voice and IP services to more than forty USNS vessels (T-AKE, T-AOE, T-EPF, AS, and T-AH ship class). One of the most critical components of the CBSP architecture is the Tri-Band, Traveling-Wave-Tube (TWT) High Power Amplifier (HPA). The TWT-HPA is a transmitter that amplifies RF signals, allowing more output power to drive the CBSP antenna. This gives the ship the ability to send email, phone calls, message traffic, fax, tactical chat, and video (teleconferencing) information off-ship. When the HPA fails to operate, the antenna cannot transmit mission-essential data up to the satellite to receiving shore commands or coalition vessels at-sea.

Based on past performance historical data, along with a high rate of HPA-related C3/C4 Casualty Reporting (CASREPS), the TWT-HPA is considered a HIGH-FAIL item. MSC is currently unable to respond to associated CASREPS in a timely manner, and only has three

(3) working HPAs in the warehouse to support forty (40) MSC vessels. MSC currently has thirty-seven (37) defective HPAs on the shelf in need of repair.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

MSC utilizes NAVWAR’s CBSP ULV system only. The manufacturer identified is the manufacturer currently under contract to provide and service the CBSP ULV HPAs for NAVWAR, the CBSP System POR Program Manager. Introducing a non-POR certified component would introduce incompatibilities as well as interruption of SATCOM services and off-ship connectivity. Because of this, no other sources were sought. Additionally no vendors have expressed interest in response to previous years J&A and Combined Synopsis/Solicitation notices.

A review of market research, purchase order contract N3220521P2291 and service order contract N3220523P2331, established both requirements were awarded on a sole-source basis to CPI, the OEM and sole authorized technical representative. Further marker research conducted on new HPA purchase orders from 2020 through 2023 also confirmed CPI as the

OEM.

In accordance with FAR 6.302-1, while an RFI is not needed for this requirement due to the Government’s knowledge of the requirement and previous contracts, a copy of the combined synopsis/solicitation along with a copy of this J&A will be posted to SAM.Gov, stating the Government’s intention to award this service order to CPI on a sole-source basis.

7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, MSC has no plans at this time to compete future procurements for the type of service covered by this document. If another potential SATCOM system emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
