Justification for Other Than Full and Open Competition – Amendment 4

This document is a Justification for Other Than Full and Open Competition (J&A) for a non-competitive contract modification to extend support services for the Defense Threat Reduction Agency's (DTRA) Arms Control Enterprise System (ACES).

Contract Details and Services

DTRA seeks to award a contract modification to Peraton Inc. (Cage Code: 0HD54) for an extension of operations and maintenance (O&M) support services for ACES under existing contract HDTRA121C0057. ACES is a specialized Arms Control Treaty notification workflow and data management/reporting system that provides equipment tracking, workflow generation, official treaty reporting, and a repository for arms control data supporting conventional and strategic arms control treaties and agreements. The modification will extend the period of performance by 2.5 months, from June 15, 2026 through August 31, 2026, with new labor and travel CLINs (5001 and 5002) added to accommodate this extension. The extension is necessary to allow Peraton to complete ongoing upgrade activities, specifically involving system modifications that have been underway for several months and require additional performance time beyond the current contract end date. A Request for Information (RFI) was posted on January 8, 2026 with a closing date of January 22, 2026 for the follow-on effort.

Justification and Authority

The non-competitive award is justified under 10 U.S.C. 2304(c)(1) and FAR 6.103-1(b) (Only One Responsible Source), as Peraton is the sole responsible source capable of providing the unique and highly specialized support services necessary to operate and maintain ACES. Market research, including the RFI posting and review of historical acquisition information, previous contracts, DoD-wide contracts, and GSA schedules, determined that no other potential sources demonstrated the requisite arms control treaty automation expertise or treaty knowledge critical to supporting ACES requirements. The estimated cost for this requirement is derived from historical data from the ongoing ACES O&M effort, with the acknowledgment that a new performer would require significantly higher costs due to the lack of in-depth expertise in the system's coding, database structures, and complex chart printing functions. DTRA will implement a Support Transition Plan to ensure integration activities are fully documented to support future follow-on efforts and maximize future competition.

2026 through August 31, 2026. New labor and travel CLINs (CLINs 5001 and 5002) will be added to the contract to accommodate the extended period of performance.

The estimated value of the proposed extension is . When applied to the cumulative J&A value that was previously approved under the initial J&A, Amendment 1, Amendment 2, and Amendment 3, the new cumulative value will be .

The initial J&A was Approved on February 8, 2021 in the amount of .

Subsequently, an increase of was approved on June 10, 2021 under Amendment 1, to change to the intended awardee due to corporate acquisition and increase to the estimated value of the work since the Independent Government Cost Estimate did not include the cost of integrating the Inspection Planning Module (IPM) into the ACES platform. This omission resulted in the IGCE being less over a five (5) year period. Amendment 2 was approved on August 16, 2022 and added for programming and Information Technology services to achieve the full integration of the Inspection Planning Module (IPM) functions and Treaty Chart Printing (TCP) capabilities. When processing this addition, a third amendment was necessary to provide of ceiling to support additional labor hours related to the Chart Printing software’s integration and meeting exact international standards.

Furthermore, the Government’s estimate for this portion of the project did not incorporate the need for dedicated personnel to support Requirements analysis, documentation and testing, and database engineering and design work; which attributed to the need for additional ceiling.

Amendment 3 was ultimately approved on September 6, 2022.

Under Amendment 4, an increase of is sought, for a new projected total of

We are actively working with the contractor to reallocate unused ceiling to mitigate the impact of this amendment and to offset the value of this extension.

Exercising FAR clause 52.217-8, Option to Extend Services, will allow the performer to that are already in process and will provide the time required to complete and award a successful follow-on . The extension will be supported by fiscal year 2026 funding.

Historical Background:

HDTRA1-16-F-0012 – Awarded in 2016: This work was initially solicited under the GSA Alliant ID/IQ contract GS00Q09BGD0056 among 59 contract performers. A robust technical package was provided to all potential offerors to outline the technical aspects of the system;

however, only one (1) contractor (Northrop Grumman, whose work unit/team is now a part of Peraton Inc.) offered a proposal. As a result, the award was based on that competition and a task order HDTRA116F0012 was awarded on May 20, 2016.

HDTRA1-21-C-0057 – Awarded in 2021 (current contract): A Request for Information (RFI)/Sources Sought was posted for the current contract in December 2020 and that also did not yield any on-time and sufficient responses. Due to the results of the market research that was conducted at that time, the June 2021 follow-on effort (HDTRA1-21-C-0057) was awarded as a non-competitive action.

3. Statutory Authority

10 United States Code (U.S.C.) 3204(a), as implemented by FAR 6.103-1, Only One Responsible Source.

The statutory authority for this non-competitive action is pursuant to 10 U.S.C. 2304(c)(1) and FAR 6.103-1(b), which states that “when the supplies or services required by the agency are available from only one responsible source and no other type of supplies or services will satisfy agency requirements. For DoD, NASA, and the Coast Guard, this authority extends to situations where only a limited number of responsible sources can satisfy agency requirements.”

4. Applicability of Authority

Peraton Inc, (Cage Code: 0HD54) is the only responsible source that can provide the unique and highly specialized support services necessary to operate and maintain the ACES system.

Currently, Peraton is delivering a upgrade involving the

This has been on-going for several months and requires additional performance beyond the end of HDTRA121C0057 to complete all necessary tasks. In addition to regular performance tasks a new performer would have to learn and understand all the components and complexities of the current system, as well as create a development environment to support the on-going application framework upgrades.

5. Effort to Solicit Potential Sources

Potential sources other than the current performer will not be solicited for this extension. This extension is being sought subsequent to a long-term follow-on contract for this effort. A Request for Information (RFI) notice was posted on 8 Jan 2026 with a closing date of 22 Jan 2026.

6. Fair and Reasonable Costs

The anticipated cost/price of this contract modification will be determined “fair and reasonable” based on a comparison of proposed prices to the Independent Government Cost Estimate (IGCE), previous prices, historical data, and negotiations.

7. Market Research

In accordance with FAR Part 10, market research has been conducted for the follow-on effort.

The RFI was posted at SAM.gov titled "DTRA- Arms Control Enterprise System (ACES) Support." . After reviewing all responses, the PM determined none had the requisite arms control treaty automation expertise or treaty knowledge to be successful in supporting the ACES requirements.

The team reviewed historical acquisition information, previous contracts, publication of sources sought announcements, and personal knowledge in procuring services of this type, existing DoD-wide contracts, and GSA schedules.

8. Other Facts:

The estimated cost for this requirement is approximately and is derived from historical data from the on-going ACES O&M effort. Due to the lack of in-depth expert knowledge of the coding, database structures, etc. of the ACES and IPM systems; the supported treaties and the complex chart printing functions, the cost for a new performer would be significantly higher.

9. Interested Sources

As stated in Section 5 above, there were responses to the recent Sources Sought, however, none of the responses indicated they had the required expertise with arms control treaty automation and arms control treaty expertise which is a critical component of the required ACES support.

10. Subsequent Actions

DTRA will continuously monitor new developments in this field and incorporate a Support Transition Plan to ensure that integration activities are fully documented to help support follow-on efforts, in order to maximize competition in the future.
