Section A: General Contract Information
Is this a Bridge Action as defined in the AF Bridge Action Reduction Plan? Yes No
Contracting Activity: FA7000 / 10 CONS/PKB
Project/Program Name: Alcon Centurion Phaco Machine
Purchase Request / Local ID Number: Form 1155# FM700010350323
Estimated Contract Cost (including Options):
Section B: Description of the Supplies/Services Required
10 MDG Opthamology requires an Alcon Centurion phacoemulsification machine and it must be this brand, Alcon Centurion Phaco Machine, to ensure standardization on the opthalmology operating room. 10 MDG Opthamology requires this machine to have the following features: active fluidics, which improves post operative IOP results; balanced energy, which eases use of Ozil hand pieces during phacomulsification, and a wireless footswitch and remote, for increased portability.
Dimensions:
Height: No greater than 165 cm (65 in) Width: No greater than 58.5 cm (23 in) Depth: No greater than 76 cm (30 in) AC Electrical Requirements:
Input Voltage: 100 ‐ 240 VAC 50 / 60 Hz Maximum Input Current: 10 A
Operating conditions: This equipment will be used to phacoemulcify the cataract or lens that patient develops as they age. This is accomplished using a micro hand piece that is inserted into the eye and that breaks up the cataract and is eventually aspirated out once small enough.
Section C: Rationale for Soliciting from a Single Source or Brand Name
Alcon, the manufacturer, provided documentation that O.R. Elder, Inc., a SDVOSB concern, is the only authorized supplier of the Centurion Phaco Machine. IAW FAR 19.1406 and FAR 6.302-5 (b) (6), contracting is authorized by statute to sole source to SDVOSB concerns under the Veterans Benefits Act of 2003, 15 U.S.C. 657f. There is not a reasonable expectation that offers would be received from two or more service-disabled veteran-owned small business concerns who are authorized by the manufacturer to sell or supply parts and service. The service-disabled veteran-owned small business concern has been determined to be a responsible contractor with respect to performance.
This same equipment was purchased by the VA from O.R. Elder, Inc. in December, 2020 and February, 2021 for the same price as that quoted to 10 MDG.
IAW FAR 19.1406, Sole source awards to service-disabled veteran-owned small business concerns:
(1) The contracting officer does not have a reasonable expectation that offers would be received from two or more service-disabled veteran-owned small business concerns;
(2) The anticipated award price of the contract, including options, will not exceed-
(i) $6.5 million for a requirement within the NAICS codes for manufacturing; or
(ii) $4 million for a requirement within any other NAICS code;
(3) The requirement is not currently being performed by an 8(a) participant under the provisions of subpart 19.8 or has been accepted as a requirement by SBA under subpart 19.8;
(4) The service-disabled veteran-owned small business concern has been determined to be a responsible contractor with respect to performance; and
(5) Award can be made at a fair and reasonable price.

In this instance, O.R. Elder, Inc. is the only SDVOSB authorized distributor of the required item. The anticipated award price will not exceed $4 million. The requirement is not currently being performed by an 8(a) participant. The service-disabled veteran owned small business has been determined to be a responsible contractor and the award can be made at a fair and reasonable price.
Section D: Efforts to Obtain Competition
A notice of intent to award a sole source contract will be posted on beta.SAM.gov for 15 days.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
This particular acquisition requires the same machine as the one that is currently in service to maintain surgical standardization.
The government will continue to conduct market research to determine potential future sources that are capable of providing future replacements for the phaco machine.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
