About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a new seven-year sole source, Indefinite Delivery/Indefinite Quantity (IDIQ) contract to acquire non-personal services for the processing and analyzing of nuclear debris particle samples. The contracting agency is the U.S. Air Force's Air Force Technical Applications Center (AFTAC). The requirement is for services to improve the sensitivity, accuracy, efficiency and throughput of operational analytical techniques to support AFTAC's nuclear test ban treaty monitoring mission. The anticipated contract structure includes fixed-price CLINs for particle analysis services, commercial equipment, additional sample analysis, and travel, as well as cost-plus-fixed-fee CLINs for research & development and specialized equipment. Gryphon Scientific, a wholly-owned subsidiary of Mantech International, is the sole-source contractor due to the unique security, facility, licensing, and operational requirements. A sources sought synopsis was posted, with only the incumbent and one other firm responding. No further competition is anticipated due to the significant barriers to entry for this requirement.

Justification and Approval (J&A) for Other Than Full and Open Competition

March 2023 Page 3 of 9March 2023 Page 3 of 9

I. Agency and Contracting Activity.

The contracting agency and organizational activity responsible for the proposed contracting action are identified below:

a. Contracting Agency: US Air Force

b. Procuring Activity: AMIC DET 2 OL-A 1020 South Patrick Drive; Building 10989 Patrick Space Force Base, Florida 32925-3002

c. Requiring Activity: Air Force Technical Applications Center (AFTAC) 1020 South Patrick Drive; Building 10989 Patrick Space Force Base, Florida 32925-3002

II. Nature and/or description of the action being approved.

This document is a Justification for Other than Full and Open Competition under the authority of 10 U.S.C. 3204(a)(1), "Only One Responsible Source - No Other Supplies or Services Will Satisfy Agency Requirements" as implemented by FAR 6.302-1.

The requirement is for a new seven-year sole source (5 year base ordering period, 2 year optional ordering period), Indefinite Delivery/Indefinite Quantity (IDIQ) contract to acquire non-personal services for the processing and analyzing of nuclear debris particle samples to Gryphon Scientific, a wholly-owned subsidiary of Mantech International, Inc. The ordering period will be 1 November 2024 - 31 October 2031.

The anticipated CLIN structure is as follows:

0001 Particle Analysis Services (O&M) - FFP 0002 Research & Development (R&D) - CPFF 0003 Commercial Equipment - FFP 0004 Specialized Equipment - CPFF 0005 Additional Sample Analysis - FFP 0006 Travel - CR 0007 Data and Reports - Not Separately Priced

III. Description of supplies/services required to meet agency needs.

AFTAC requires a program to improve the sensitivity, accuracy, efficiency and throughput of operational analytical techniques to stay abreast of the latest developments in areas of interest to AFTAC. Data analysis support will be provided by the contractor for operational analytical techniques, including writing new programs, providing analytical aids, devising new methods for data reduction, and modifying existing software developed for automatic operation of instruments.

Services to be provided are non-commercial in nature.

The samples are environmental in nature and come in many forms. Samples provided to the contractor for analysis require execution of varying analysis techniques that range from general inspection to in-depth study. While some performance certainties can be identified using historical data such that reasonable estimates can be made about the types of analysis and number of samples that will need to be processed, the specifics of the analysis and exact volume of samples is subject to changing world conditions. Timely analysis response is critical to the success of this program.

This contract does not include acquisition of intellectual property (IP) or associated IP rights. For this acquisition, neither a life cycle sustainment plan, systems engineering plan, nor a test and evaluation master plan is required.

AFTAC/SDBA has determined that award to any other source will result in substantial duplication of cost to the government that cannot be expected to be recovered through competition and will cause unacceptable delays in fulfilling the Air Force's nuclear test ban treaty monitoring mission.

V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under

FAR 5.202 applies.

A Source Sought Synopsis, FA7022-24-R-AEMII, was posted on 10 Feb 2023 on SAM.gov, questions were due 1 Mar 2023 and responses were due 10 Mar 2023. The Sources Sought Synopsis invited firms to identify their capabilities, capacity, and experience with the tasks set forth in the draft PWS. Two firms responded to the AEM II sources sought: 1. Incumbent Gryphon/ManTech and 2. Jacobs Technology Inc.

Gryphon/ManTech (as novated) is the incumbent for the last 65 years and is fully capable of accomplishing the work outlined in the PWS.

VIII. Any other facts supporting the use of Other Than Full and Open Competition.

The facility required to perform this contract must have and retain a DoD SECRET level facility security clearance.

Communication capabilities must be at the DoD SECRET level. All personnel, including technicians, must have a minimum DoD SECRET security clearance before commencing work on any portion of the requirement. Any new hire must be able to be cleared to the DoD SECRET level and such paperwork must be submitted immediately upon hiring to be considered for work on the contract.

The contractor must possess, or show the capability to obtain, a US Nuclear Regulatory Commission (NRC) Radioactive Materials License (or an agreement state license/permit, as applicable for the facility where work will be performed), prior to performance start.

The contractor will be responsible for providing a suitable site totally dedicated to performance of contract requirements.

Due to the potential of contaminating mission samples, analysis equipment and areas of any facility used for analysis services, cannot be used for activities other than government work without the expressed written permission of the government program office and must be isolated from other facilities doing nuclear work.

IX. List of any sources that expressed, in writing, an interest in the acquisition.

See Section V above.

X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.

At this time, there exists little to no possibility of competition for this requirement without substantial government investment. Currently, there are no anticipated funds to support purchasing the required specialized equipment to open up competition. In order to perform this type of work, a contractor must possess or show capability to obtain a U.S. Nuclear Regulatory Commission (NRC) Materials license, prior to performance start. Awarding to a contractor without such a license will delay analysis up to a year while a contractor obtains the required license. A reasonable percentage of small business participation will be encouraged through subcontracting, however, significant portions of the requirement shall remain with the current prime contractor.

As required by DFARS PGI 206.304, the prior J&A was reviewed to determine if any plan of action to promote competition was implemented. Both J&As acknowledge that there are only currently two companies capable of providing these unique services and developing additional government sources is cost prohibitive. While the prior J&A contemplated the ability to compete requirements between the two companies, the timing of required sample analysis services do not lend themselves to a fair-opportunity process, as services are needed in a very expedient manner, and both labs are already operating at maximum capacity. The previous J&A is classified and will be made available via SIPR upon request.
