DEPARTMENT OF THE NAVY
NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION
IN REPLY REFER TO:
J&A_19-0370
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ 08733.
2. Description of the Action Being Approved.
This Justification and Approval authorizes and approves on a sole source basis a Firm Fixed- Price contract with The Boeing Company (CAGE: 0PXV4), 6200 JS McDonnell Blvd, Saint Louis, MO, 63134-1939. This contract is for sustainment support of the Airborne Electronic Attack (AEA) Intermediate level (I-level) Operational Test Program Sets (OTPS) and the RF/High Speed Ancillary Set.
3. Description of Supplies/Services.
This procurement is for sustainment support of the EA-18G AEA I-level OTPSs and the RF/High Speed Ancillary Set for the Consolidated Automated Support System (CASS).
Sustainment support for the AEA I-level OTPSs and RF/HS Ancillary Support Equipment (SE) is required for the EA-18G aircraft I-level maintenance and repair for the AEA suite of Weapon Replaceable Assemblies (WRAs); support of engineering investigations and fleet inquiries; on-site verifications; support of logistics data; and transition to organic capability.
Estimated Dollar Value in Thousands
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The Boeing Company is the prime integrator of the EA-18G aircraft, and the original designer, developer and manufacturer and the only source with the requisite knowledge, experience, technical expertise and technical data of the AEA I-level OTPS and RF/ High Speed Ancillary Set and therefore, the only known source that can provide support for these SE end items. The Government does not possess the drawings/technical data for the AEA I-level OTPS and the RF/High Speed Ancillary Set to support a competitive acquisition. Any other source would need to possess the drawings/technical data to be able to perform this requirement.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The F/A-18 E-G Aircraft I-level conducted Market Research and internet searches. The Federal Procurement Data System, Dynamic Small Business Search, Haystack, Google, Yahoo, and Bing internet search engines were queried for potential sources and the only result returned was the Original Equipment Manufacturer (OEM) The Boeing Company. U.S. Navy subject matter experts (SMEs) were queried in an attempt to identify alternative sources. The SMEs confirmed that without the proprietary data, no other firm would be capable of successfully satisfying this requirement. This confirmed the F/A-18 E-G Aircraft Depot Level team’s assessment that the OEM is the only known source capable of the sustainment support of the AEA I-level OTPS and the RF/High Speed Ancillary Set.
A Request For Information was posted on 20 March 2020 through 27 March 2020 to the BetaSam web portal. One respondent, Deltek Inc., responded requesting the associated incumbent contractor and incumbent contract number. The Government responded, “There is no incumbent contractor or contract number that I would be able to provide. I will direct you to stay tuned for the upcoming Synopsis which will provide more information on how the Government intends to move forward. The Boeing Company has been identified as being the most likely/possible Sole Source for this requirement. In the meantime, if you have documentation/pamphlets of company capabilities (etc... as requested in the RFI) that you want to provide on behalf of Deltek, please do so”. No further inquiries were received. The synopsis required by FAR 5.201 was published on the Federal Business Opportunities website on 27 March 2020 through 13 April 2020. No responses were received.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. An analysis of The Boeing Company’s proposal will be performed by technical analysts and contract specialists, with the assistance of Defense Contract Management Agency (DCMA) and Defense Contract Audit Agency (DCAA) auditors as needed. The Contracting Officer will analyze the various cost elements that are presented in the proposal, as well as review the actuals from previous procurements, if applicable. The Contracting Officer will use Government expertise, including DCMA, DCAA, and other Government resources, to evaluate the proposed material, labor, and subcontracts. A detailed report, developed as part of the Government evaluation, will be utilized to establish a NAVAIR position. As discussed in this paragraph, the Contracting Officer will use cost and price analysis as the basis for negotiating a fair and reasonable price for the supplies and services covered under this J&A.
8. Actions to Remove Barriers to Future Competition.
If another requirement emerges and potential sources for that requirement are identified, NAVAIR will assess whether competition for future requirements is feasibl
