JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Identification of Agency and Contracting Activity.
Naval Research Laboratory, 4555 Overlook Avenue, SW, Washington, DC 20375-5000.
2. Nature/Description of Action.
This request seeks approval to modify Task Order NOO 173-19-F-2009 with Excet, Inc., to extend the Period of Pe1formance (PoP) to 31 July 2020 and to increase the task order ceiling value by an estimate of The PoP extension and the estimated ceiling increase are required to provide continuity of Research and Development (R&D) support for the Naval Research Laboratory's (NRL's) Chemistry Division, while the Contracts Division process the re-compete of the replacement follow-on task order.
3. Description of Supplies/Services.
The scope of the task order is to provide R&D support services for system design, analysis, and optimization; hardware and software integration; and research on the underlying phenomena and interactions that can be leveraged for improved system performance, durability, and reliability. The goal is to develop knowledge and techniques to improve the performance of power and energy system components and systems. For the proposed PoP extension and the Level of Effort (LOE) increase, the incumbent Contractor, will continue to provide all the required personnel, material, engineering support, and other resources to support electrochemical energy system integration, power system electronics design and development, controls and data-system development, and system simulation and optimization.
The estimated LOE required for the bridge support is The effort will be funded by Fiscal Year (FY) 2020 Research, Development, Test & Evaluation (ROT &E) funding.
4. Identification of Statutory Authority.
The statutory authority permitting other than full and open competition is Title 10 U .S.C. 2304( c) ( 1 ), Only one responsible source, as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

9. Any Other Supporting Facts.
As stated at Paragraph 5 above, without the continuation of support from Excet during the bridge period, the Chemistry Division's ability to fulfill its mission will be greatly hindered and put at risk.
A break in support will halt ongoing R&D efforts and prohibit NRL from transitioning key technologies that are presently being suppo1ted by this task order, to include NetWarrior project, advancement of fuel cell technology and development of battery safety protocols for the fleet.
10. Listing oflnterested Sources.
No interested source has expressed interest for this bridge effort.
11. Actions Taken to Remove Barriers to Competition.
RFP for the follow-on task order was released on 10 February 2020 in SeaPort NxG. This extension is a stopgap solution to ensure continuity of support and prevent a break in support, therefore, no further action was taken to remove barriers to competition. The follow-on award is being competed on SeaPort NxG as a I 00% Small Business (SB) set aside. Further, a notice was posted to sam.beta.gov on 13 February 2020, announcing the Government's intent to extend the task order PoP and increase the ceiling value. The notice stated that the Government will consider all responses to the announcement. To date, no response was received.
12. Statement of Delivery Requirements.
The Contractor will continue to deliver all the required deliverables set forth in the task order. No additional delivery requirements will be added for the bridge period.
13. Reference to the Approved Acquisition Plan (AP) or Equivalent Documentation.
The Basic IDIQ Contract AP was approved on 12 April 2013. There was no requirement for an AP to be approved for each individual task order against an internal NRL IDIQ contract.
14. Explanation of all actions attempted to make the immediate acquisition competitive and the cost /benefit analysis reflecting costs associated with obtaining competition and anticipated benefits.
The proposed task order modification is to prevent a break in critical support and to allow time to award a follow-on task order. It is unrealistic and not beneficial to expend resources on making the immediate acquisition competitive. The modification is to ensure continuation of work provided by the incumbent contractor until a competitive follow-on task order can be awarded.
