About this file
This justification document outlines a sole source contract award for network redesign support services. The Department of Defense Washington Headquarters Services Acquisition Directorate requires these services from NetCentrics Corporation on a bridge contract basis to ensure continuity of support for the Office of Military Commissions. A competitive acquisition is ongoing for a long-term solution, with an anticipated award by the end of the third quarter of fiscal year 2020. No other vendors responded to the pre-solicitation notice to challenge this sole source bridge contract. Historical pricing from the current contract will be used to determine fair and reasonable pricing for the follow-on non-competitive effort while competition is pursued.

4. AUTHORITY CITED: This action is authorized under provisions of 10 U.S.C. 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements”
5. REASON FOR AUTHORITY CITED: Federal Acquisition Regulation (FAR) 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements”. OMC is responsible for the court proceedings for the detainees held in GTMO. Within OMC, the MCDO requires Network Redesign Support Services to maintain a separate command structure to help ensure fairness and independence of the legal proceedings at the Naval Station Guantanamo Bay.
Failure to issue a sole source bridge contract to the incumbent, NetCentrics Corporation will create an unacceptable lapse in service of providing Network Redesign Support Services to maintain a separate IT Infrastructure for the OMC MCDO. NetCentrics Corporation is currently providing Network Redesign Support Services to the OMC. Implementing a new vendor to provide these services could result in unnecessary delays, interruptions in services, increased costs, and unnecessary hardship for OMC and their mission to provide secure court proceedings for the detainees held in GTMO. Therefore, a bridge contract to NetCentrics Corporation is required to ensure continuity of support for these essential services while the Government is working a competitive acquisition.
6. EFFORTS TO OBTAIN COMPETITION: On May 20, 2020, Washington Headquarters Services (WHS)
Acquisition Directorate (AD) issued a “Notice of Intent to Sole Source” this requirement to NetCentrics Corporation on beta.sam.gov. The Notice of Intent was posted for two days and closed on May 22, 2020. No vendors responded to the notice to challenge the bridge contract to NetCentrics Corporation.
A competitive acquisition to procure Network Redesign Support Services on a long term basis is currently ongoing.
7. FAIR AND REASONABLE COST DETERMINATION: The Government will make a determination of fair and reasonable pricing, using the procedures in FAR 15.404-1- Proposal Analysis Techniques;
specifically, FAR 15.404-1(b)(2)(ii) “Comparison of proposed prices with independent Government cost estimates.” Since this requirement will be solicited to the incumbent vendor, historical prices paid from the current contract were used to develop the Government estimate and will be utilized to determine fair and reasonable pricing.
8. MARKET RESEARCH: Market research has been limited to the pre-solicitation notice described under efforts to obtain competition. The Notice of Intent to Sole Source was posted for two days on beta.sam.gov. No vendors challenged this bridge effort.
WHS/AD will solicit this effort as a follow-on bridge contract in order to maintain continuity of support to the Joint Service Provider and the Office of Military Commissions. The bridge contract will be issued as the most logical and cost effective strategy and solution to the Government which will avoid unacceptable delays in fulfilling the agency’s requirement and a potential gap in performance of critical services while a competitive acquisition is being procured.
