About this file

This justification and approval document authorizes a sole source award of a five-year fixed price indefinite delivery indefinite quantity contract to Sierra Nevada Corporation for Automatic Carrier Landing System pedestals in support of the Naval Air Warfare Center Aircraft Division Webster Outlying Field Air Traffic Control and Landing Systems Division. The contract value is $43.5 million and was awarded on June 30, 2020 under solicitation N68335-20-R-0025. Sierra Nevada Corporation as the original equipment manufacturer is the only source able to provide the pedestals without extensive reverse engineering due to its technical expertise and data pertaining to the proprietary design. Market research found no other contractors capable of meeting requirements within cost and schedule constraints due to the need to replace obsolete precision approach and landing system components across aircraft carriers and training facilities by 2040.

DEPARTMENT OF THE NAVY

NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION

LAKEHURST. NEW JERSEY 07833

J&A Number:

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

I. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst, NJ.

2. Description of the Action Being Approved.

The NAWCAD Webster Outlying Field (WOLF) Air Traffic Control & Landing Systems (ATC&LS) Division is required to support PMA-213 Landing Systems Upgrade Program (LSUP) requirements to upgrade, procure, and install ATC&LS equipment at the following locations; United States Navy aircraft carriers, Naval Air Technical Training Center Schoolhouse; and the Patuxent River test bed. Each location requires a quantity of two pedestals.

This Justification and Approval authorizes and approves on a sole source basis the issuance of a five year Fixed Price (FP) Single Award Indefinite Delivery Indefinite Quantity contract with Sierra Nevada Corporation (SNC) for Automatic Carrier Landing System (ACLS) pedestals, part number AB-14251SPN-46(V). The orders will be issued on a Firm Fixed Price (FFP) basis.

3. Description of Supplies/Services.

The ANISPN-46(V) ACLS pedestals are components that hold and move the reflector dish to allow for tracking and guidance of the aircraft, ultimately providing precision landing information to air traffic controllers and pilots during final approach while landing aircraft aboard aircraft carriers. The ACLS also has the ability to automatically land aircraft aboard carriers if conditions require. The ATC&LS Division is the In-Service Engineering Activity and is required to ensure ACLS operability and maintainability through year 2040, as required by the Landing Systems Upgrade Program.

This action will procure the following hardware components for the ANISPN-46(V) ACLS: AN/ SPN-46(V) pedestals, part number, AB-14251SPN-46(V). The pedestals are a critical component of the ANISPN-46(V) that track and communicate with incoming aircraft to provide detailed landing systems data.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(C)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale JuStifying Use of Cited Statutory Authority.

SNC, as the Original Equipment Manufacturer (OEM) of the ANISPN-46(V) pedestals, part number AB-14251SPN-46(V), is the only source with the requisite knowledge, technical experience, and production-level data to produce these ANISPN-46(V) components without extensive and costly reverse engineering efforts.

The ATC&LS Division conducted research and determined if another vendor had to re-design the pedestal, it Would negatively affect cost and schedule as the estimated cost to produce and design an ANISPN-46(V) pedestal is estimated at . An estimated 24 month schedule slippage would occur and breach the already tight programmatic schedule to meet current fleet availabilities and require carriers to operate with failing equipment until the next shipyard availability. The estimated 24 months schedule slippage is based on the time to reverse engineer the pedestals, build prototypes, and perform acceptance testing to validate the design.

If the equipment is not fully operational, the fleet will be directly and adversely affected because the Government's capability to track and land aircraft aboard vessels will be severely restricted and render the vessels not mission capable which could lead to loss of life. The Precision Approach and Landing Systems (PALS) equipment is currently experiencing obsolescence issues and additional component obsolescence requirements are projected. The Government is unable to maintain the PALS equipment currently installed aboard the aircraft carriers and replacing the pedestals will replace the obsolete equipment.

6. Description Of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The ATC&LS Division conducted market research via Google searches and contacted various companies to ascertain their ability to provide the required components. The search for part number AB-14251SPN-46(V) provided SNC as the OEM. SNC was the only company identified as having the required experience, knowledge, data, and personnel with the skills to build the ANISPN-46(V) pedestals. Therefore, SNC is the only company that can provide the materials required to produce these components without significant cost and schedule impacts.

A Sources Sought/Request for Information for this requirement was posted via the Federal Business Opportunities website on 21 October 2019 and closed on 28 October 2019. No acceptable responses were received. A pre-solicitation synopsis was posted on 11 February 2020 and closed on 27 February 2020 with no responses received. Any subsequent responses to the synopsis will be evaluated by the Contracting Officer.

7. Determination of Fair and Reasonable Cost.

J&A Number:

This procurement will be negotiated on a FP basis. In Accordance With (IAW) FAR 15.402. the Contracting Officer shall ensure that the price negotiated is fair and reasonable. The Contractor will submit a formal price proposal with certified cost or pricing data as well as sufficient information to support the accuracy and reliability of the estimate for this procurement. Each proposal will be reviewed by experienced technical personnel at the ATC&LS Division and the cognizant Contract Specialist with assistance provided by Defense Contract Management Agency and Defense Contract Audit Agency analysts as deemed necessary. The Contracting Officer will utilize various cost and price analysis techniques IAW FAR 15.404-1, including a review of historical data, as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in paragraph 5, the ATC&LS Division has no plan, at this time, to compete future contracts for the types of supplies covered by this J&A. As the OEM, SNC is the only company that currently possesses the technical expertise and special tooling required to meet this requirement. There are no other sources for spare parts. If another potential source emerges, or the ATC&LS Division is capable of receiving the Technical Data Package required for repairs of the ATC&LS components and assemblies, the ATC&LS Division will assess whether competition for future requirements is feasible.
