About this file
This Justification and Approval (J&A) document authorizes a sole source contract modification for the USS HARPERS FERRY (LSD-49) with National Steel and Shipbuilding Company (NASSCO). The modification adds a new work item (150-11-020) for bulkhead repair at a firm fixed price of $169,046.92, funded by FY25 OPN (TYCOM funds). The repair is necessary due to water intrusion damage discovered after the original 100% package lock, with work to be accomplished during the ship's Selected Restricted Availability (SRA) from 28 July 2025 through 16 October 2026, estimated to take 25 days.
The contract is being awarded sole source under 10 U.S.C. 3204(a)(1) because NASSCO is uniquely positioned to perform the work without significantly impacting the maintenance schedule. A sources sought notice published on 13 July 2025 received four inquiries, but the government determined that only NASSCO can efficiently integrate this repair with ongoing scheduled maintenance. The sole source justification cites potential cost avoidance of approximately $48,000 and risks to mission readiness if another contractor attempts the repair, with additional potential rework costs estimated at $25,000 if the work is not integrated into the current repair schedule.

1. CONTRACTING ACTIVITY
The Naval Sea Systems Command, Southwest Regional Maintenance Center (N55236), Contracting Department Code 430A, 3755 Brinser Street, Suite #1, San Diego, CA 92136-5299. Contracting ACO:
Jonathon Mata, jonathon.f.mata.civ@us.navy.mil.
2. DESCRIPTION OF THE ACTION BEING APPROVED:
Sole source contract action is to add one (1) New Work Item at a Firm Fixed Price to National Steel and Shipbuilding Company (NASSCO) under N00024-25-C-4422, USS HARPERS FERRY (LSD-49) Fiscal Year 2025 (FY25) Selected Restricted Availability (SRA).
Work Item to be incorporated:
150-11-020; Bulkhead; repair
3. DESCRIPTION OF SUPPLIES/SERVICES:
a. New Work Item 150-11-020; Bulkhead; repair
b. Total Estimated Value: $169,046.92. Funding will be FY25 OPN (TYCOM funded).
c. The window of opportunity to accomplish the work is 28 July 2025 through 16 October 2026.
The USS HARPERS FERRY (LSD 49) FY25 SRA start of the availability begins 28 July 2025 with a Delivery Date of 16 October 2026. Estimating a total of 25 days to accomplish the work.
d. The Government’s minimum needs have been certified as complete and accurate by the technical and requirements personnel.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 – this authority applies in those situations where the supplies or services required by the agency are available from only one responsible source, or, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. This availability is the last opportunity to complete this upgrade prior to deployment and this work is needed to fulfill required operational capability.
5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY.
Request for Contractor Change (RCC) 4N was written in order to accomplish the repair of Bulkhead located in 03 Level Deck, Weather Deck, Frames 13.25, Port including the Troop Living Space (03-14- 0-L) and Dumbwaiter on 03 Level weather Deck.
Per the Structural Inspection Report, SWRMC Code 242 found holing on the 04 Level Weather Deck which resulted in significant intrusion to the 03 Level Troop berthing. Due to the water intrusion from the 04 Level, the 03 Level Troops Living Space was not available and personnel were displaced. If bulkhead in 03 Level Troops Living Space and dumbwaiter repair is not accomplished, the probability of the hole may enlarge and propagate into the 02 Level Overhead, which could lead to additional water intrusion into Troop Living Space (02-14-2-L) and water damage to the Dumbwaiter, creating a domino effect of subsequent repairs. Since the ship did not identify the need to repair the 03 Level Weather Deck Spaces until after 100% Package Lock, this work is not included in the basic work package. There is currently no scope for the repair within the USS HARPERS FERRY FY25 SRA work package and will be needed to be added as new work. Additionally, there was no CMAV opportunity to accomplish repair between the discovery of issue and the start of the DMP.
Completion of this work item will require scheduling and cooperation with existing work items and poses significant risk for financial injury to the Government due to additional costs with the duplication of support services such as the Project Management Office (PMO), supervision, temporary services, and other indirect or overhead costs. NASSCO is uniquely positioned to perform this work on the ship, and it is impracticable for another company to perform these support services.
NASSCO is currently scheduled to conduct repair of 04 Level Deck and Bulkhead and had scheduled in for the major repairs which includes significant interference removal and re-install. The Government had received four (4) responses from industry partners indicating that they could accomplish the work, it is in the Government best interest to sole source the work to NASSCO due to sequencing of work. The scale of planning and the complexity of the interferences and sequence of the work must be incorporated to the schedule. NASSCO had provided an estimate schedule to incorporate this work along with the current scheduled repairs and is planned to be accomplished in conjunction of the entirety of 04 Level weather deck. If this new work is solicited and competed, the removal of interferences directly tied to RCC 4N would be delayed, impacting preservation requirements. In addition to delaying surrounding work, the potential rework of interference removal and reinstall is estimated at $25,000.00 if work is not integrated within NASSCO’s schedule. Furthermore, since the current contract already have support services in place, it would result in a duplication of costs estimated at $23,666.57 or 14% of production costs and schedule conflict between different contractors.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY
OFFERORS AS PRACTICABLE:
The original contract was awarded competitively in which NASSCO was the selected awardee.
A sources sought notice was published to www.sam.gov in accordance with FAR 5.203 (a) on 13 July 2025 and remained published for (15) fifteen calendar days. Four (4) inquiries were received from Atlantic Fabrication & Boiler Service, Inc., BHPE LLC, Chae & Nam Universe Inc, and Southcoast Welding & Manufacturing. No other responses were received.
During this window of maintenance availability, no other source can satisfy the Agency’s requirements without a significant impact to the availability completion schedule. An impact to the availability schedule would pose a serious risk to mission readiness and war fighting capabilities of the USS HARPERS FERRY (LSD 49). NASSCO is uniquely positioned to perform the work as the ship is currently undergoing a major repair period, and it is impracticable for another company to perform these support service with other ongoing repairs as it would cost approximately $48,000.00 for someone other than NASSCO to complete this requirement.
7. DETERMINATION OF FAIR AND REASONABLE COST:
The Contracting Officer has determined that the anticipated cost to the Government of this acquisition will be fair and reasonable based on cost and price analysis to be conducted pursuant to FAR Part 15. In addition, technical analysis will be performed with the Project Manager to ensure the proposed labor hours, material cost, and subcontractor cost correspond with the expected cost.
8. ACTION TAKEN TO REMOVE BARRIERS TO COMPETITION:
It was unanticipated that the discovery of this work would become immediately necessary after 100% Package Lock. However, during the next maintenance availability, a contract of this nature will be awarded by providing for full and open competition, so long as full and open competition is appropriate for the circumstance. Any lessons learned will be implemented to ensure requiring activities become more pro-active in modifying solicitations prior to award to mitigate issuing a new work under a sole source environment.
