About this file
This document is a Justification and Approval (J&A) memo for a sole source contract modification for the USS GREEN BAY (LPD-20). The modification involves adding one new work item to replace High Frequency (HF) terminal equipment and a modernized Antenna Tuning Unit during the ship's Dry-Dock Selected Restricted Availability (DSRA) in Fiscal Year 2025. The Navy determined that only BAE Systems can perform this work without causing significant delays, as the ship is already located at their shipyard and undergoing major repairs. The work is critical for upgrading the ship's communication systems to modernize the BRSE operating system and ensure the vessel can effectively communicate with other fleet vessels during its upcoming deployment.
The total contract (N00024-25-C-4411) was originally awarded competitively to BAE on November 22, 2024, with this modification added via Request for Contract Change (RCC) 27N. The work is scheduled to be completed by November 6, 2026, which represents the last opportunity to upgrade the HF terminals during the ship's availability window. The Navy justifies the sole source approach by citing the tight production schedule, the impracticality of another company performing concurrent repairs, and the potential operational disruption if the communication upgrades are not completed in a timely manner.

N00024-25-C-4411
The statutory authority permitting other than full and open competition is 10 U.S.C. § 3204 (a)(2) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 this authority applies in those situations where only one responsible source and no other supplies or services will satisfy agency requirements and precludes full and open competition, and delaying in award would result in serious injury to the Government. This availability is the last opportunity to complete this upgrade during the ships availability window and this work is needed to fulfill required operational capability.
5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY.
Request for Contract Change (RCC) 27N was generated to replace High Frequency (HF) terminal equipment and a modernized Antenna Tuning Unit onboard the USS GREEN BAY. On October 31st 2024, representatives from the Naval Information Warfare center reported that the existing condition of HF terminals onboard the USS GREEN BAY could not accommodate upgrades to the BRSE, the operating system utilized on these terminals. The New Work/Late Add was not fully approved until February 7th, 2025. Since the contract was awarded was on November 22nd, 2024, it was too late to add the work item to the final work package. Representatives from NIWC reported that without replacing HF communications equipment tied to these terminals, upgrades to the BRSE designed to modernize the receipt and transmission of HF signals onboard the USS GREEN BAY cannot take place, thus inhibiting the efficiency with which the USS GREEN BAY can communicate with other vessels in the fleet. This in turn will disrupt the capacity of the USS GREEN BAY to carry out its operational role when the USS GREEN BAY departs on deployment. Representatives from NIWC reported that the period of time between completion of the USS GREEN BAY FY25 DSRA, and deployment of the vessel does not support modification of the HF terminal system after completion of the current CNO availability.
With the above in mind, timely modification of the HF terminals captured under the scope of RCC 27N in support of the USS GREEN BAY FY25 DSRA is vital to sustain the capacity of the USS GREEN BAY to fulfill its operational role.
During this window of the DSRA, no other source can satisfy the Agencys requirements without negatively impacting timely completion of the availability. With the USS GREEN BAY located at
, BAE is uniquely positioned to support receipt, and installation of elements of the Antenna Tuning Unit and HF terminal equipment onboard the USS GREEN BAY. Opening this requirement to competition would incorporate unnecessary delays into an increasingly tight production schedule as the awardee coordinates entry into the shipyard, receipt of materials required for equipment replacement, inspection of the repair area, the setup of temporary services, and the installation of the equipment with BAE, and its subcontractors. Following the incorporation of a 3-month delay to the commencement of the dry-docking period of the USS GREEN BAY FY25 DSRA via Contract Modification A00012, the production schedule for the USS GREEN BAY FY25 DSRA cannot accommodate further significant delays to production work. Time spent awarding and coordinating the execution of this requirement concurrently with the USS GREEN BAY FY25 DSRA meets the criteria of a significant delay.
If competed, the timeline for solicitation is projected as follows: Development of Requirements Package due to contracts by June 6th, 2025, Solicitation/Request for Proposal (RFP), Respond to Preproposal Inquiries (PPI) and submit required Solicitation Amendments (06 June -20 June 2025), Receipt and Evaluation of proposals by mid-July 2025 and execute Contract Award by August 2025. Thus, efforts to coordinate modification of the HF terminals with BAE could not take place
