About this file

This is a Justification and Approval (J&A) document for other than full and open competition to award a fourth bridge contract to Professional Analysis, Inc. (PAI) for Worldwide Logistics Support Services for the Department of the Navy's Military Sealift Command (MSC).

The bridge contract N3220525P2140 will provide commercial Worldwide Logistics Support Services in Special Material Logistics Type Desk support and Acquisition Life Cycle Support, specifically for Medical/CBRD/ATFP/Safety of Life at Sea and Damage Control material for MSC platforms. The contract has a base period of 5 months (December 20, 2024 - May 18, 2025) with a potential 6-month option period. The sole-source award is necessitated by a bid protest filed with the Court of Federal Claims, with PAI being the only responsible source capable of continuing services without interruption. The total estimated value for the 11-month period will be funded by FY25 Navy Working Capital Funds and Transportation Working Capital Funds. Future requirements are anticipated to return to full and open competition after the COFC litigation process concludes.

J&A No. N10225P2140

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Ship Support and Services Division (N102).

2. Description of the Action Being Approved: The action is a Justification and Approval (J&A) to award a fourth bridge contract on sole source basis for Worldwide Logistics Support Services to Professional Analysis, Inc. (PAI), Suite 400, 2121 Eisenhower Ave, Alexandria, VA 22314.

3. Description of Supplies/Services: MSC requires commercial Worldwide Logistics Support Services in the functional areas Special Material Logistics Type Desk support and Acquisition Life Cycle Support, while providing internal program management support services to assist the Special Material Type Desk for centrally-managed Medical/CBRD/ATFP/Safety of Life at Sea (SOLAS) and Damage Control (DC) material, for all Military Sealift Command (MSC) platforms (GOGO & GOCO). The total estimated dollar of the bridge contract, inclusive of all options, for eleven months is $XXXXX and will be funded by FY25 Navy Working Capital Funds (NWCF) and FY25 Transportation Working Capital Funds (TWCF).

4. Statutory Authority Permitting Other Than Full and Open Competition: 41 U.S.C. § 1901(a)(2), and as prescribed by the procedures in FAR subpart 13.5.

5. Rationale Justifying Use of Cited Authority: The above statutory authority permitting other than full and open competition applies to the subject contract action due to the fact that there has been a bid protest filed to the Court of Federal Claims (COFC) XXXXXXXXXXXX. Consequently, PAI XXXXXXXXXXXXXXXXX, is the one responsible source known to be capable of continuing to provide those same services to MSC without causing the potential for interruption XXXXXXX now XXXXXX.

The fourth bridge contract N3220525P2140 will commence on 20 December 2024 and will have a base period of five (5) months (20 December 2024 until 18 May 2025) and an up to six (6) month option period if the Option to Extend Services clause is used to its maximum extent (FAR 52.217-8).

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The protested contract under solicitation N3220523R4140 was competed as full and open competition. Due to a bid protest filed to COFC, the Government intends to post a notice for this J&A at the Government Point of Entry, SAM.gov website, to notify industry that Worldwide Logistics Services for N44S Special Material Logistics Type Desk will continue as a sole source effort during this current time period.

7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A to be fair and reasonable in accordance with FAR Part 13.5.

8. Actions to Remove Barriers to Future Competition: The foregoing contract to this one—Contract N3220524P0044—was not competed. The contracting officer has retained and reviewed the additional documentation required by DFARS 206.303-2 as required by DFARS 213.501, which is the previous J&A No.

10224P0044. To recap, that J&A cited that Contract N3220524C4140 was awarded, after going through a full and open source selection competition, on XXXXXXX. XXXXXXXXXXXXX. Thus, as the previous J&A was solely in support to prevent a lapse in mission critical services and any action taken due to a protest is tied to that previous competition, so too is this J&A. After receipt of the protest giving rise to the previous J&A, XXXXXXXX. Thus, the Government fulfilled all of the requirements of DFARS 206.303-2 and 213.501, and this J&A should be approved. This J&A is solely in support to prevent a lapse in mission critical services during the COFC litigation process. Future requirements for Worldwide Logistics Services are anticipated to be competed using full and open or other competitive procedures.
