DEPARTMENT OF THE ARMY
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. CONTRACTING ACTIVITY: The contracting activity is the Army Contracting Command- Detroit Arsenal (ACC-DTA), MI.
2. DESCRIPTION OF ACTION: ACC-DTA proposes to award a Firm Fixed Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) contract to Design & Production, Inc. (D&P) 7110 Rainwater Place, Lorton, VA 22079-1521 CAGE: 4D421. Fiscal Year 2023 Operation and Maintenance, Army (FY23 OMA) funds will be obligated to fund the initial task order.
Each subsequent task order will be funded with OMA funding of the appropriate fiscal year.
3. DESCRIPTION OF SUPPLIES/SERVICES: The National Museum of the United States Army (NMUSA) has a requirement to install a major exhibit commemorating the 250th
Anniversary of the Revolutionary War. This is in line to support the 250th Rev War Commemoration led by CMH. Headquarters Department of the Army (HQDA) Executive Order (EXORD) 231-1 (250th Commemoration of the American Independence) was published in October, 2021 and lists this exhibit in section 3.B. The exhibit will be installed in the Museum’s Special Exhibition Gallery on the 2nd Floor. The total estimated dollar value of the proposed action is . This estimate is based on the Independent Government Estimate provided by Center of Military History (CMH) for this action.
4. AUTHORITY CITED: The statutory authority permitting other than full and open competition is 10 United States Code (U.S.C.) 3204 (a)(1), as implemented by Federal Acquisition Regulation (FAR) 13.501(a)(2)(ii), Sole Source Acquisitions.
5. REASON FOR AUTHORITY CITED: The justification for citing FAR 13.501(a)(2)(ii) is to utilize a single contractor for all exhibit design, fabrication, and installation work is paramount to attaining exhibits with an exceptional quality suitable for a national museum at the Smithsonian Institution level. There are thousands of components required to create an exhibit for the National Army Museum. Consistent workmanship throughout the exhibit is only possible with a single fabricator. Given the already established design and aesthetics established by D&P in the development, construction, and installation of the museum’s main exhibit wing, it’s imperative to continue this established criteria with the Revolutionary War exhibit. The goal is to remain consistent with the level and quality that already exists within the museum’s permanent galleries.
The last contract scope to build the museum’s permanent galleries was awarded based on the design/fabrication process (i.e. detailing, submittals, prototypes, cast figure, artifact mounts, artifact cases, scenic elements) rather than location. The
D&P Inc.- D&P provided responses to all 8 questions from the Sources Sought. D&P also provided a response to the additional question asked.
They have the knowledge and experience to design, fabricate, and install a major exhibit in a large national level museum. As the main fabricator for the NMUSA, they are very familiar with the landscape, personnel, and processes in developing a large-scale exhibit with a variety of components to include archival artifact cases, mounts, cast figures, graphics, audio-visual systems, and archival-quality lighting systems. D&P has a proven track record of engineering and fabricating exhibit components that last 20 years or more. This durability will be critical for the long-term use of this project’s components by the Museum. Therefor D&P is the recommend contractor for this large-scale exhibit project at NMUSA.
Additionally, D & P has the project management skills that are required to design, fabricate, and install a major military exhibit. Their previous work at NMUSA, where they established a high bar when it comes to design and fabrication, needs to be maintained with this new exhibit.
Moreover, their recent work with major institutions like the Smithsonian, highlights their commitment to excellence in establishing themselves as the leader in exhibit, design, and fabrication. No other company comes close to the high-quality work they provide. Also, their connections with some of the top exhibit designers in the country gives them a distinct advantage over other companies. This experience coupled with their ability to manage large-scale exhibits, is what makes them the ideal company for Rev War 250th exhibit.
Although other sources have been identified, no other source has the necessary experience or knowledge with the current NMUSA requirements. D&P is the only known contractor with the experience and expertise needed to provide the highly specialized required services within the constraints specified in paragraph 5 above.
