IN REPLY REFER TO:
J&A No. 25-0089
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Systems Command (NAVAIR) Headquarters
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes a contract action for the procurement of up to eight (8) sets of new production CFM56-7B27AE Stage 4 Stage 9 Physical Vapor Deposition (PVD) Erosion Coated High Pressure Compressor (HPC) Blades. These items will be procured on a sole source basis from the Original Equipment Manufacturer (OEM) of the engine, CFM International (CFM), 6440 Aviation WY, West Chester, OH 45069.
3. Description of Supplies/Services.
The Naval Air Systems Command (NAVAIR) PMA-290 requires up to eight (8) sets of new production CFM56-7B27AE Stage 4 Stage 9 Physical Vapor Deposition (PVD) Erosion Coated High Pressure Compressor (HPC) Blades to support an effort to reduce erosion and corrosion on compressor blades that operate in harsh environments and to determine fuel savings related to the coating. The blades will be incorporated into engines when they are sent to the depot for repair.
To support depot repairs, the required delivery date for all blades is not later than 30 September 2026. The estimated value and associated funding by fiscal year and type is indicated in the following table.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
CFM is the OEM of the CFM56-7B27AE engine (including the CFM56-7B27AE Stage 4 Stage 9 PVD Erosion Coated HPC Blades), which is the only certified engine for the P-8A. As the original designer, developer, and manufacturer of the CFM56-7B27AE engine, CFM is the only company that possesses the complete set of technical data and drawings to manufacture HPC blades for that engine. NAVAIR has inquired of CFM whether CFM would entertain selling the manufacturing data with requisite rights to the Government and CFM has declined. Therefore, the Government neither possesses nor has sufficient rights in the necessary manufacturing data to make it available to alternate sources. Pursuing alternate sources to fulfill requirements would, in essence, require the Government to replace the CFM56-7B27AE engine with an alternative engine. Based on historic engine development program experience, it is estimated that it would take over 5 years to independently certify a different engine for the P-8A resulting in unacceptable delays in meeting the aforementioned 30 September 2026 required delivery date to support depot repairs. Therefore, award to any other source would result in a failure to timely meet the requirements contemplated under this planned contract action. Note that, as indicated in Section 8 below, the previous contract action (which is the original contract) for new production CFM56-7B27AE Stage 4 Stage 9 PVD Erosion Coated HPC Blades was procured sole source from CFM.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A Sources Sought Notice was posted on the SAM website on 16 December 2024, for which no award a contract action to CFM was posted on the SAM website on 8 January 2025, for which no responses were received.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVAIR has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible. As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior J&A (J&A 23-0125) was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
