About this file

This document is a Justification and Approval (J&A) for the use of other than full and open competition to award a sole source purchase order to Quality Refrigeration Company Inc. for AC condenser parts for the USNS COMFORT (T-AH 20) hospital ship. The parts are required to support the upcoming fiscal year 2024 regular overhaul and dry-docking of the vessel. The total estimated value of the parts is , with an option to purchase additional parts valued at in fiscal year 2025. The J&A cites the statutory authority under 10 U.S.C. 3204(a)(1) that only one responsible source, Carrier Marine and Offshore, can provide the required proprietary parts, and no other supplier can satisfy the agency's requirements. Quality Refrigeration is the only authorized distributor for Carrier Marine and Offshore parts in the San Diego, California delivery area. The purchase of compatible replacement parts is necessary to meet the overhaul timeline, and Quality Refrigeration has access to the required technical data.

J&A No. N10424Q2108

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC), Norfolk.

2. Description of the Action Being Approved: Award of a purchase order on a sole source basis to the authorized provider of the Carrier Marine and Offshore AC Condenser Parts, Quality Refrigeration, for use on-board the USNS COMFORT (T-AH 20). Other than full and open competition will be utilized as only one, Quality Refrigeration Company Inc., vendor has been approved as authorized parts providers, for the delivery area of location, and is able to provide the exact required items to fulfill this requirement.

3. Description of Supplies/Services: Provide USNS COMFORT (T-AH 20) AC Condenser Parts to ensure the items are available for maintenance of the USNS COMFORT (TAH 20) during the upcoming fiscal year 2024 Regular Overhaul/Dry-Docking. The estimated dollar value of three condenser parts to be purchased using 2024 Navy working capital funds is, . The option to purchase the same three additional condensers parts, when exercised will be an estimated dollar value of , using fiscal year 2025 Navy working capital funds. The estimated combined dollar value is .

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C.

3204(a)(l) Only one responsible source, and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Authority: The Original Equipment Manufacturer (OEM) is Carrier Marine and Offshore, which owns the proprietary drawings, technical manuals and design information for the AC Condenser onboard the T-AH Class Vessels. Due to this information, only Carrier Marine and Offshore can provide the necessary details to the authorized distributor, Quality Refrigeration, to provide replacement parts for the AC Condenser onboard. Carrier Marine and Offshore only uses Quality Refrigeration to sell to the Government for procurements slated to delivery within San Diego, California. MSC, and all Government entities, are required to utilize Quality Refrigeration to ensure OEM parts are provided. Carrier Marine specifically stated to MSC that Quality Refrigeration, Inc. is the only Carrier Marienauthorized source to distribute parts in question. Quality Refrigeration has worked direct with Carrier to ensure proper parts were sourced and to be quoted.

MSC N7 Engineering Director lists standardization and brand name, as well as form, fit, and function as reasons for the direct use of Carrier brand AC Condenser unit parts. The purchase of replacement condenser parts consisting of end bells, end plates, and water boxes must be compatible with the installed condenser shells and tubes. Use of alternate parts will require engineering design development which do not support the upcoming overhaul timeline. Quality Refrigeration has the ability to access Carrier Marine and Offshore drawings, and technical data to be able to accurately provide the required material to the Government.
