About this file

This document is a Simplified Acquisition Procedures (SAP) Determination Memorandum for a Sole Source Acquisition over the Micro-Purchase Threshold but not exceeding the Simplified Acquisition Threshold. The New Hampshire Army National Guard (NHARNG) is seeking to procure 134 pairs of Scarpa Inverno double lined plastic mountaineering boots on a brand name only basis. The requirement is justified as only one source (Scarpa) is reasonably available to meet the unique characteristics needed to ensure interoperability with the Vermont Army National Guard units the NHARNG company supports. The estimated amount is not provided. The government will post a 30-day solicitation on SAM.gov as a small business set-aside, with award to the lowest-priced technically acceptable offer. No other limitations on competition will apply.

The related federal contract opportunity is a combined synopsis/solicitation for the Scarpa Inverno mountaineering boots. The NAICS code is 316210 Footwear Manufacturing, a small business size standard of 1000 employees. Quotes must meet salient characteristics including an outer plastic structure, removable liner, and compatibility with various winter accessories. Quotes must be valid for 60 days, and all questions are due by July 15, 2024. The government intends to award a firm-fixed price contract.

_7_ PROVIDE A STATEMENT OF ACT_dWWFyKo3zgQ-e71MSrA2mA: The USPFO for NH will post a solicitation on SAM.gov for thirty (30) days where all qualified offerors may submit offers. The requirement shall be set-aside for small businesses (IAW FAR 19.6) and as a brand-name only requirement (IAW FAR 16.505(a)(4)(i) Items Peculiar to One Manufacturer). There will be no limitations on competition otherwise. Award will be made to the offerer who submits the lowest-priced quote that is considered technically acceptable by the requiring activity.
_5_ PROVIDE A STATEMENT OF ACT_xMsHeIbKfGYdZx*NQZBzkg: A search on SAM.gov revealed contract #W912LN-23-F0002 on 3/29/24 with the VTARNG for 525 pairs of Scarpa Inverno double lined plastic mountaineering boots at a cost of $321.80 per pair. This solicitation received 2 offers from small businesses.

Market research indicates 1 contract on GSA Advantage that offers Scarpa Inverno double lined plastic mountaineering boots for $371.74.

_4_ UNIQUE CHARACTERISTICS THA_fxPS18NzthbsRqqrY5h47Q: NHARNG requires cold weather mountaineering boots. The 86th IBCT headquartered in Vermont has already procured the Scarpa brand boots the Brigade and supporting units in the Vermont National Guard. C/3-172 IN (MTN) is a Company element that is supported by New Hampshire, but conducts operations with their higher headquarters in Vermont. To ensure the Company meets AR 670-1, they are seeking a brand name purchase of the Scarpa Inverno. Additionally, when the VARNG equipments its units with Skiis, the NHARNG Company needs to have interoperability with its higher headquarters. Another brand would hurt the NHARNG Company from conducting BN winter operations as C/3-172nd IN (MTN) would have its own unique gear.
