About this file

This document is a Justification and Approval (J&A) for use of other than full and open competition, issued by the Naval Air Warfare Center Aircraft Division (NAWC-AD) in Patuxent River, MD. The document authorizes a sole-source contract action with CASS Professional Services (CPS) to provide Air-to-Air Refueling (AAR) safety training services for Navy fleet pilots. The total estimated contract value is $35M, with funding coming from Foreign Military Sales, USAF O&M, USAF RDT&E, Navy O&M, and Navy RDT&E across fiscal years 2025-2031.

The contract will modify CPS's existing Indefinite Delivery/Indefinite Quantity (IDIQ) contract under the AAR Multiple Award Contract (MAC) N00421-21-D-0033. CPS will provide services including Boom, Boom Drogue Adapter (BDA), and Multi-point Refueling Systems (MPRS) "Probe-and-Drogue" type AAR services to aircraft receivers for pilot initial qualifications and readiness training. The justification highlights that CPS submitted an unsolicited proposal with a unique and innovative pilot training concept, and is currently the only contractor capable of delivering these specific services. The current IDIQ contract was competitively awarded in July 2021 and has a total potential ordering period of nine years if the option period is exercised.

J&A 24-0256

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In accordance with FAR 5.202(a)(8), the proposed contract action was not synopsized because the action results from the acceptance of an unsolicited proposal and publication of any notice would improperly disclose the originality of thought or innovativeness of the proposal.

The DFARS PGI 206.302-1 requirement to post a Request for Information (RFI) or sources sought notice, has been waived by the Director, Procurement Group for PEO(T) on 24 September 2024.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

The current AAR CAS Indefinite Delivery/Indefinite Quantity (IDIQ) contract was competitively awarded to CPS on a full and open basis in July 2021. The current IDIQ MAC has a base ordering period of four (4) years 364 days, and one (1) four (4) years 364 days option ordering period for a total ordering period of nine (9 years 364 days, if the option period is exercised. CPS is currently in their third year of contract execution. For the reasons set forth in Paragraph 5, NAWCAD has no plans at this time to compete future contracts for the type of services covered by this justification. If another potential source emerges, NAWCAD will assess whether competition for future requirements is feasible.
