About this file
This justification and approval document awards a bridge contract to Amentum Services, Inc. to continue providing Enhanced Army Global Logistics Enterprise (EAGLE) services at Fort Campbell, Kentucky. The Department of the Army requires Amentum to provide maintenance, supply, and transportation logistics support services through the Fort Campbell Logistics Readiness Center while the Government Accountability Office adjudicates a protest to the recently awarded follow-on task order. The bridge contract has a base period of February 14, 2024 through June 13, 2024 valued at $9,424,313.03 plus three optional periods that could extend the award through February 13, 2025 for a total value of $28,272,939.09. Only Amentum as the incumbent is able to continue the highly specialized EAGLE services at Fort Campbell without disruption while the protest is resolved to avoid unacceptable delays in fulfilling the Army's critical requirements.

Department of Army Justification and Approval for Other than
Full and Open Competition
1. Contracting Activity: U.S. Army Contracting Command – Rock Island (ACC-RI) Rock Island Arsenal, Rock Island, IL 61299-8000.
2. Description of Action: ACC-RI, on behalf of Army Sustainment Command (ASC) requests a Cost-Plus-Fixed-Fee bridge modification to extend the Basic Ordering Agreement (BOA) W52P1J-17-G-0091 Task Order 0001 with Amentum Services, Inc.
(Amentum). ACC-RI projects award of the bridge extension by 13 February 2024 and will obligate fiscal year 2024, Operations and Maintenance, and/or Army Procurement funds.
In November 2011, the Principal Assistant Responsible for Contracting approved the Acquisition Plan for the entire EAGLE program in accordance with (IAW) Defense Federal Acquisition Regulation Supplement (DFARS) 207.103(d)(i)(B), Agency-head Responsibilities. On 1 September 2016, the Senior Services Manager, Deputy Assistant Secretary of the Army (Procurement) approved the extension of the EAGLE program and associated Acquisition Strategy and Plan to 27 September 2027.
BOA W52P1J-17-G-0091 Task Order 0001 is currently under a FAR 52.217-8 six-month extension, which expires on 13 February 2024. Efforts to conduct a competitive follow-on resulted in an award on 4 December 2023, but for reasons described in paragraph 5, the new contract will not be in place prior to expiration of the current order. This action is a bridge modification to ensure continuation of EAGLE services at FCKY for ASC until the protest has been resolved and the new awardee has transitioned.
3. Description of Supplies/Services: The Government has a requirement for Amentum to provide complete logistics support services at the FCKY Logistics Readiness Center (LRC). The LRC includes the Maintenance Division, the Supply Division, and Transportation Division. The Maintenance Division provides Field and Sustainment level maintenance support to tactical units and Government civilian activities. The Supply Division provides Supply & Services support to include Central Issue Facility operations, Ammunition Supply Point operations (Class V), Subsistence Supply Management Office operations (Class I), hazardous material, warehousing operations, retail supply operations through the installation’s classes of supply II, IV, VII, IX Supply Support Activity, and Installation Property Book Office operations. The Transportation Division provides Arrival/Departure Airfield Control Group operations, Personal Property Shipping Office operations, rail movement operations, container storage and repair operations, strategic and local materiel and personnel movement support, unit movement planning support and Transportation Motor Pool management for the installation.
The LRC currently supports the 101st Airborne Division (three Brigade Combat Teams and a Combat Aviation Brigade), 5th Special Forces Group, 160th Special Operations Aviation Regiment, 101st Sustainment Brigade, 52nd Explosive Ordnance Group, 86th Combat Support Hospital, and numerous additional tactical tenant organizations and Government civilian activities; supported units are subject to change during the course of this effort. Total Soldier population support is approximately 28,600.
The period of performance for this action includes a four-month base period, a four-month option and two two-month options as shown below. The current FCKY EAGLE contract W52P1J-17-G-0091/0001 is presently under a FAR 52.217-8 six-month extension, which is due to expire on 13 February 2024. Should the Government prevail in the protest of the follow-on, where a Government Accountability Office (GAO) decision is due no later than 23 March 2024, a three-month base period would leave the awardee with less than the solicited 60-day transition period, therefore a 4-month base period extension is the most appropriate. If the Government does not prevail, and ACC-RI is directed by GAO to take corrective action, the option periods would be exercised as needed. The estimated dollar value for the bridge extension is $28,272,939.09, including options, based on the Independent Government Estimate for the recently-awarded FCKY contract/task order.
Periods of Performance:
Base: 14 Feb 2024 – 13 Jun 2024 $ 9,424,313.03 Option Period 1: 14 Jun 2024 – 13 Oct 2024 $ 9,424,313.03 Option Period 2: 14 Oct 2024 – 13 Dec 2024 $ 4,712,156.52 Option Period 3: 14 Dec 2024 – 13 Feb 2025 $ 4,712,156.52 Total: $28,272,939.09
4. Authority Cited:
10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited:
As described at FAR 6.302-1(a)(2)(iii)(B) for DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements.
ACC-RI awarded BOA W52P1J-17-G-0095 Task Order W519TC24F0031 to Red River
Science & Technology, LLC on 4 December 2023 under EAGLE. On 15 December 2023
Gemini Tech Services, LLC (Gemini) filed a protest with the GAO, which was assigned case number B-422253.1. The GAO decision in this case is due by 23 March 2024.
The current FCKY BOA W52P1J-17-G-0091 Task Order 0001 is operating under a FAR
52.217-8 six-month extension which is due to expire on 13 February 2024. Should the
Government prevail in the above-referenced protest, the following milestones apply:
Event Milestone
Execute bridge modification 09 February 2024
Amentum continues providing services at FCKY 14 February 2024
GAO rules in favor of the Government 23 March 2024
ACC-RI reaffirms award to Red River
Science & Technology, LLC 29 March 2024
Transition-in begins for recompete awardee 12 April 2024
Four-month base period extension ends 13 June 2024
Transition-in ends/Full Operational Capability (FOC) 13 June 2024
As noted above, if the Government does not prevail in the protest, and ACC-RI is directed by GAO to take corrective action, the option periods would be exercised as needed. Option periods may be terminated early at the sole discretion of the
Government. Regardless of whether the GAO-directed corrective actions result in an award to a different contractor, or the original awardee, once transition begins the remaining option period(s) may be adjusted to allow for the originally solicited 60-day transition-in before FOC, but will not extend beyond 13 February 2025.
It is imperative that EAGLE Logistics Support Services are not interrupted at FCKY. This is especially critical at FCKY as units located there are critical to current Army overseas contingency operations and designated as first deployers in the event of further overseas contingencies. These units include the 101st Airborne Division (which recently assumed Immediate Response Force responsibilities, replacing the 82nd Airborne Division); the 5th Special Forces Group; 160th Special Operations Aviation Regiment; the 101st Sustainment
Brigade; the 52d Explosive Ordnance Disposal Group; and the 86th Combat Support Hospital. All of the identified units are currently engaged in overseas operations and staging out of Fort Campbell as well as preparing for additional operations. Amentum has performed EAGLE services at FCKY since August 2018. As the incumbent, only Amentum can meet ASC’s requirement for these critical services without unacceptable delays while the protest is adjudicated. Amentum is familiar with the missions currently supported at FCKY and has the skilled and trained personnel in place to continue mission essential services at FCKY. Amentum’s workforce already has installation access and security clearances to perform with proper systems access. ACC-RI estimates it would take 180 days to conduct a separate competition for the requirements encompassed by this justification. Further, it is anticipated to take at least 60 days to hire a new work force, obtain necessary security clearances, the specialized training, and the required certifications for a new contractor to assume this highly critical mission. Given that performance must continue, uninterrupted, when the current task order expires on 13 February 2024, it is not feasible to award to contractor other than the incumbent.
Additionally, the absence or interruption in logistics support services for maintenance, supply, and transportation operations would also negatively impact FCKY Base Support Operations. A lapse in maintenance support to FCKY tenant organizations would have a devastating impact on the Directorate of Emergency Services first responders, the Directorate of Public Works, and the Directorate of Planning Training and Mobilization.
Any interruption in EAGLE services to these FCKY tenant activities represents a substantial risk to life, health, and safety as well as overall mission accomplishment.
A disruption in EAGLE services at FCKY would have a substantial negative impact on the Army’s ongoing and potential contingency operations as well as base operations at Fort Campbell.
6. Efforts to Obtain Competition: ACC-RI shall publish the notices required by FAR
5.201. Because this is a sole source action, effective competition is not applicable. The Government will achieve subcontracting competition by including FAR 52.244-5, Competition in Subcontracting in the task order, which states that the contractor shall select subcontractors on a competitive basis to the maximum practicable extent.
7. Actions to Increase Competition: The Government awarded the competitive follow-on task order on 4 December 2023. However, a protest was filed with the GAO, which is currently being adjudicated by the GAO. Should the Government prevail in the protest, where a decision is due no later than 23 March 2024, the current milestone for beginning performance under the competitive acquisition is 12 April 2024.
8. Market Research: ACC-RI issued the Request for Proposals (RFP) for the follow-on FCKY task order under EAGLE in June 2023. ACC-RI received 12 proposals as a result of the RFP and awarded the follow-on task order on 4 December 2023. Additional market research performed within the last 12 months indicates that multiple contractors holding a BOA under the EAGLE Program have the capability to perform the work at FCKY. During the annual EAGLE BOA review in May 2023, multiple contractors demonstrated the capabilities necessary and expressed interest in performing the EAGLE mission at FCKY. Additionally, several recently competed and awarded EAGLE task orders (i.e. Schofield Barracks, HI – December 2023, Ft. Polk, LA – May 2023) show that there are multiple contractors interested in performing EAGLE task orders with similar mission sets. However, due to the complexity of the FCKY mission, it is not feasible for a new contractor to transition in less than 60 days. Therefore, posting a separate sources sought or request for information for this extension provides no additional benefit to industry or the Government. Accordingly, this Justification and Approval, approved by the Senior Executive Service (SES)/Senior Contracting Official (SCO) will also constitute SES/SCO approval to waive the requirement to post a sources sought or request for information as required by DFARS 206.302-1(d) and DFARS Procedures Guidance and Information (PGI) 206.302-1(d).
