About this file

This document is a Justification and Approval (J&A) for awarding an Indefinite Delivery, Indefinite Quantity (IDIQ) delivery order under the DHS FirstSource II (FSII) IDIQ contract to a single brand-name manufacturer, Cloudbees, Inc., for CloudBees software and maintenance support.

The requirement is for highly secure, automated, integrated, and reliable application environments (development, test, training, and production) to support ICE programs and offices. The 12-month base period of performance is from August 19, 2024 to August 18, 2025. The J&A cites FAR 16.505(a)(4) as the exception, noting that the CloudBees software is based on the Jenkins open-source automation tool which is mission critical and has no compatible alternatives that meet ICE's requirements. Market research found that competing products like CircleCI and TravisCI are incompatible with the existing Jenkins infrastructure. Switching to a new platform would be costly and disrupt ongoing operations. The anticipated cost is deemed fair and reasonable based on competition among FSII SDVOSB vendors. ICE will provide the J&A to all FSII SDVOSB vendors to increase competition for any subsequent acquisitions.

WHEN PLACED UNDER AN INDEFINITE DELIVERY INDEFINITE QUANTITY (IDIQ) CONTRACT

FAR 16.505(a)(4) and 16.505(b)(2)(ii)

J&A-24-00228

1. Agency and Contracting Activity.

The Department of Homeland Security (DHS), U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ) proposes to award an Indefinite Delivery, Indefinite Quantity (IDIQ) delivery order on behalf of the Office of the Chief Information Officer (OCIO)/Systems Engineering Division (SED)/Application Services Branch (ASB) resulting from a solicitation containing a brand-name specification.

2. Nature and/or description of the action being approved.

(a) Name of the ICE, DHS, or Multiple-Agency Multiple Award Contract that the delivery/task order or modification is being placed under. (Example: NITAAC CIO-

SP3):

DHS IDIQ - FirstSource II (FSII)

(b) If applicable, identify the functional category, size category, or other sub-section of awardees which will be provided a fair opportunity to be considered:

This procurement will be competed between the qualified First Source II vendors that are part of the SDVOSB Socio-Economic Category.

(c) Identify contract type and whether new action or modification: Firm Fixed Price; new action

(d) Dollar amount for this justification: $xxxxxxxxx

(e) Title of the required brand-name manufacturer and product:

Cloudbees, Inc., CloudBees Software and Maintenance Support

3. Description of Supplies/Services.

(a) ICE has a requirement to provide highly secure, automated, integrated, and reliable application environments (development, test, training, and production) for supporting ICE Programs and offices with leading edge technical computing solutions.

(b) The period of performance will consist of a 12-month Base period of August 19, 2024 through August 18, 2025.

(c) Include a table similar to the following for all actions:

Period Time Price Total Base 12 mos XXXXXX XXXXXX

4. Statutory Exception and Rationale.

Exception:

The specific exception for providing for brand-name awards under multiple award contracts is Federal Acquisition Regulation (FAR) Subpart 16.505(a)(4). An item peculiar to one manufacturer can be a particular brand-name, product, or a feature of a product peculiar to one manufacturer. A brand-name item, even if available on more than one contract, is an item peculiar to one manufacturer.

Rationale:

(a) OCIO has used the Jenkins Tool for over 10 years and the continued use of the Jenkins tools is mission critical. . It is currently used in the software development (Dev) and Operations (OPS) cloud environment. Alternatives for the Jenkins Tool did not meet OCIO requirements. The Jenkins Tool is the leading open-source automation server (Freeware) that is used for implementing continuous integration (CI) and continuous delivery (CD) pipelines in software development. It helps developers automate various tasks, such as building, testing, and deploying software, making it easier to achieve faster and more reliable releases. CloudBees is based on the enterprise version of Jenkins Tool and DevOps.

It is built on the Java Virtual Machine (JVM) which provides more than 1,800 plugins that extend Jenkins to automate with practically any technology software delivery teams.

OCIO will procure CloudBees software because Jenkins Tool alone will not improve the application development pipeline , this requires a software that is compatible. For years, OCIO has used the compatible Cloudbees software. Market Research was conducted between July 1, 2024, and July 15, 2024, to determine if other CI/CD software platforms can offer the same or addition functionality currently provided by Cloudbees. ASB researched competing products: Circle CI and Travis CI are similar to Cloudbees, but their infrastructure is not based on Jenkins, both software products are incompatible with Jenkins Tool currently in use .. OCIO’s platform is currently vested in Jenkins/Cloudbees; the cost and time needed to transition to a new tool (Circle CI and Travis CI) would not be beneficial to government at the present time. Based on the research, it was determined that the brand name CloudBees software platform is the best solution to maintain and improve a functional application development pipeline.

(b) If competing products were selected, there would be interoperability, compatibility, and interface issues which will negatively impact ICE applications, our customers, and DevOps application deployment pipeline process. The cost of switching to a different software platform would not be cost effective and would hinder the agency’s mission. It would require the DevOps process to be replaced, training of all DevOps developers/users (Government and contractors), and the physical transition from the current software (loading applications, user access, and security protocols). All of this would interfere with the continuing operation and development of mission critical systems and ongoing system modifications.

5. Determination by the contracting officer that the anticipated cost to the

Government will be fair and reasonable.

The contracting officer anticipates that prices will be determined fair and reasonable based on competition amongst FS II resellers that will result in the receipt of adequate price competition.

6. Any other facts supporting the justification.

None.

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.

As ICE continues to be proactive in integration and modernization of its information systems, and as improvements are made to technology, OAQ will increase competition by seeking and soliciting as many authorized resellers of Cloudbees Software Licenses as possible.

8. If the total dollar value of this action exceeds $30,000, OAQ intends to provide the justification and supporting documentation along with the solicitation to all (IDIQ) contract awardees under the FS II SDVOSB Socio-Economic Category in accordance with FAR 16.505(a)(4)(iii)(A).
