About this file

This document is a Justification and Approval (J&A) for the procurement of assessments and repairs for the AN/DSQ-50A system under a sole-source contract with Micro Systems, Inc. (MSI). The J&A states that a competitive procurement would result in a significant 12-18 month delay, which would negatively impact fleet readiness and weapons certifications. The government determined that MSI is the only source currently capable of satisfying the requirement, based on a market survey and a Request for Information that received no responses. The contract for these assessments and repairs is expected to be a one-time buy, with no plans for future competition. The Contracting Officer has determined the anticipated cost to the government will be fair and reasonable.

The related federal contract opportunity is an award notice for a Firm-Fixed-Price and Cost-Plus-Fixed-Fee indefinite-delivery, indefinite-quantity contract with MSI to provide production, spares, and repairs for the System for Naval Target Control (SNTC) and the AN/DSQ-50A system. This contract was not competitively procured pursuant to 10 U.S.C. 3204(a)(1).

Text version

J&A 23-0268 will result in an over two (2) year delay. Specifically, 12-18 months for the competitive procurement of the requirement and an additional nine (9) months to qualify the selected source for the assessment and repair of the AN/DSQ-50A. If AN/DSQ-50A MDSs are not assessed and repaired in a timely manner, ranges would be forced to cancel or reschedule operations and at-sea Fleet warfare/weapons certifications would not be completed for critical deployments. As such, the estimated timeframe associated with a change in source to other than MSI would significantly impact Fleet readiness and lead to an unacceptable delay.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

PMA-208 maintains a constant survey of the industry market and has identified no other source currently capable of satisfying the Government's requirements. A Request for Information (RFI) was released via the System for Award Management (SAM) website on 18 April 2023 that covered the assessment and repair of the AN/DSQ-50A MDS requirement; no responses or inquiries were received.

In accordance with FAR 5.201, the proposed IDIQ contract for the assessment and repair of the AN/DSQ- 50A MDS was synopsized via the SAM website on 31 May 2023 and notified Industry of the Government’s intent to solicit and negotiate with only one source under the authority of FAR 6.302; no responses or inquiries have been received to date. In the event a contractor other than MSI expresses interest, the Procuring Contracting Officer (PCO) will evaluate any responses received prior to contract award.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVAIR has no plans to compete future contracts for the types of supplies/services covered by this document. The procurement of AN/DSQ-50A MDS assessments and repairs is anticipated to be a one-time buy and additional AN/DSQ-50A MDS units will not be procured.
