About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the procurement of 20mm, 25mm, 30x113mm Light Weight 30 (LW30) and 30x173mm Medium Caliber Cartridges.
The J&A cites 10 U.S.C. 3204(a)(3) and FAR 6.302-3(a)(1) as the authority, stating that full and open competition is not required as it is necessary to award to the only two known domestic producers, Northrop Grumman Defense Systems (NGDS) and General Dynamics Ordnance and Tactical Systems (GD-OTS), in order to maintain critical industrial capabilities. The projected contract value is estimated at $. The contract type will be Indefinite-Delivery, Indefinite-Quantity (IDIQ) with Firm-Fixed-Price contract line items. Five of the 33 cartridges will be sole source awards to either NGDS or GD-OTS due to their unique technical requirements. The J&A outlines plans to increase competition for three of the cartridges in the future as Government Purpose Rights are obtained. The Army, U.S. Air Force, U.S. Navy, U.S. Marine Corps, and U.S. Special Operations Command will utilize the contract.

DEPARTMENT OF THE ARMY
JUSTIFICATION AND APPROVAL FOR OTHER
THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Army Contracting Command - Rock Island (ACC-RI), Rock Island Arsenal, Rock Island, IL 61299-8000.
2. Description of Action: The Project Manager, Maneuver Ammunition Systems (PM MAS) request approval of multiple award contracts for the 20mm, 25mm, LW30 (30x113mm), and 30x173mm medium caliber cartridges. The period of performance is
The contract type is Indefinite-Delivery, Indefinite-Quantity (IDIQ) with Firm-Fixed-Price (FFP) contract line items numbers (CLIN). Awards will be made to Northrop Grumman Defense Systems (NGDS), Plymouth, NM and General Dynamics Ordnance and Tactical Systems (GD-OTS), Marion, IL. NGDS and GD-OTS are the only known domestic (U.S. and Canada) medium caliber producers.
Procurement Appropriations from the Army, U.S. Air Force (USAF), Naval Air Systems Command (NAVAIR), U.S. Marine Corps (USMC), Air Force Special Operations Command (AFSOC), and Naval Sea Systems Command (NAVSEA) will be utilized.
3. Description of Supplies/Services:
a. The 20mm, 25mm, LW30, and 30x173mm medium caliber family consists of the tactical and training cartridges included at Appendix A but is not limited to this listing as other medium cannon caliber items may be added during the life of this contract. Due to the projected contract award date being
. Utilizing the Government's funding and requirements projections, along with the anticipation of walk-in orders and Foreign Military Sales (FMS) historical averages, the Joint Program Executive Officer Armaments and Ammunition (JPEO) estimated the total value of this procurement is
This acquisition also includes support to various special engineering projects related to design changes and product improvements. To support these projects, the Government may require engineering analysis to diagnose, trouble shoot problems and to perform failure analysis or require replica components that are procured by the prime contractors. These engineering projects will be incidental to the cartridges being procured and are estimated -
b. This Justification and Approval (J&A) is for the restriction to the two known domestic medium caliber producers and will utilize a multiple step evaluation and award process as described below.
c. In the solicitation, quantity ranges will be provided, and the Government will request FFPs for Ordering Period (OP) 1 and NTE prices for OPs 2-5 for an initial group of items. Section M, Evaluation Factors for Award, of the solicitation will set forth the price evaluation for all CLINs on the IDIQ base contracts, award of the guaranteed minimum, and the award process of all future delivery orders in OP1, which will serve as Fair Opportunity notification. The initial FFP delivery orders will fulfill the guaranteed minimum awards under the IDIQ contracts. With the exception of the sole source items detailed in paragraph 5(g), delivery orders for additional quantities in OPs 2-5 will be competed between the two awardees in accordance with FAR 16.505, Ordering, unless a sole source action is necessary and appropriately justified, as further discussed below. When awarding the individual delivery orders for the various cartridges, the Government will evaluate factors in accordance with FAR 16.505(b)(1 )(v), in addition to price and the impact to the domestic industrial base to ensure capabilities for Load, Assemble, and Pack (LAP); mechanical fuze assembly; high explosive press operations; projectile trace; and projectile metal parts for 20mm, 25mm, LW30 and 30x173mm medium caliber cartridges are maintained by each producer. This will be accomplished by either splitting requirements for a particular cartridge if quantities allow or by ensuring that 100% of the requirements for a particular cartridge are awarded to one producer. Awards will be made to prevent scenarios where one of the producers would not be maintaining the necessary capabilities to remain as a viable producer of all 20mm, 25mm, LW30, and 30x173mm medium caliber cartridges.
d. If new, additional medium caliber ammunition requirements are identified, which are not listed as budgeted requirements in Appendix A, market research will be performed to ensure a new manufacturer is not being excluded from the opportunity to compete within the medium caliber program. Pending a determination, no vendor other than NGDS or GD-OTS is capable of producing the item, FFP/NTE pricing will be solicited from the two contract holders and those prices will be evaluated. Upon determination that the prices offered are fair and reasonable, those items will then be added to the basic contract via contract modification and fixed price awards will be made using delivery order competitions in accordance with FAR 16.505 and as detailed in the paragraph above. If new, additional medium caliber ammunition requirements are identified that cannot be competed between the two contract holders, a J&A will be approved to support a sole source award to one of the two contract holders.
e. The Army's Single Manager for Conventional Ammunition (SMCA) must have flexibility to immediately respond to changing requirements and budget fluctuations. The need to protect the U.S. interests to the ever changing and dynamic global conflicts has demonstrated the need for flexibility through the increased and varied use of each service's ammunition.
f. As engineering support is needed throughout these , the Government will conduct delivery order competitions in accordance with FAR 16.505, which will result in FFP awards. As previously stated, if new, additional medium caliber ammunition engineering requirements are identified that cannot be competed between the two contract holders, a J&A will be approved to support a sole source award to one of the two contract holders.
4. Authority Cited: 10 U.S.C. 3204(a)(3) as implemented by FAR 6.302-3(a)(1 );
Industrial Mobilization; Engineering, Developmental, or Research Capability; or Expert Services.
5. Reason for Authority Cited: As described in FAR 6.302-3(b)(1 )(i), full and open competition need not be provided for when it is necessary to award the contract to a particular source or sources to keep vital facilities or suppliers in business or make them available in the event of a national emergency.
The Army, as the SMCA, is responsible for ensuring there are critical and affordable industrial capabilities to meet current and future requirements and is also responsible for acquiring and maintaining the capability to produce 20mm, 25mm, LW30, and 30x173mm tactical and training ammunition.
a. The ability to manufacture these tactical and training cartridges requires specialized equipment, skills, and processes used in LAP, mechanical fuze assembly, high explosive press operations, projectile trace, and projectile metal parts production which are not readily available in the commercial market. The manufacturing process for these various 20mm, 25mm, LW30, and 30x173mm medium caliber family cartridges includes, but is not limited to manufacturing of projectiles, fuzes, propellant, cartridge cases; flash tube loading; cartridge case priming and loading with propellant; projectile insertion; case crimp; and LAP of the completed cartridges. Given the explosive nature of these cartridges and associated component items, highly specialized facilities, equipment, and skills are required for LAP.
i. The LAP facilities must be specially designed and fabricated to meet Department of Defense (DoD) hazard/safety standoff requirements to mitigate the risk of propagation in the event of an unintended initiation of explosive materials. In most cases the production processes dealing with high explosives and fuzes must be performed remotely. A ballistic test range must be available to perform First Article Acceptance Testing (FAAT), Lot Acceptance Testing (LAT), and in-process testing on these cartridges to ensure contractual specifications such as pressure, velocity, action time, and dispersion are met. Specialized equipment at these test ranges consists of dispersion test fixtures, flash x-ray, high speed video and still cameras, and Doppler radar. These test ranges must meet the Bureau of Alcohol, Tobacco & Firearms requirements as well as the necessary permits to operate.
ii. The LAP equipment includes: propellant and explosives handling, storage, and loading; fuze, primer, and booster handling, storage, and insertion; case crimping;
marking; linking; and packaging. Sophisticated test and inspection equipment unique to each caliber is required to ensure the final products comply with Government requirements. This equipment consists of projectile extraction force, projectile torque, waterproofness, and automatic vision inspection for critical defects.
iii. The personnel at a high-volume LAP facility require a wide range of specialties and skills to include not only the operators but mechanical engineers, electrical engineers, chemical engineers, chemists, metallurgical engineers, systems engineers, design engineers, quality and calibration specialists, program management, supply chain management, configuration management, as well as ballistic technicians.
Additionally, the LAP personnel must be specially trained to work with explosives.
These specialized personnel all work together to develop and fabricate tooling, loading equipment, inspection processes, gages, as well as debugging production issues and determining root causes while trying to maintain a delivery schedule to deliver ammunition.
iv. NGDS and GD-OTS, the two known domestic 20mm, 25mm, LW30, and 30x173mm LAP producers, currently have all of the above described facilities, equipment, and personnel skills.
b. NGDS and GD-OTS are the only current proven domestic producers of 20mm, 25mm, LW30, and 30x173mm ammunition with the necessary expertise and capabilities to produce and deliver these cartridges. Even with each contractor's past experience there have been learning curves and production challenges with some items, which have required engineering and testing resources that only these two experienced ammunition producers have the insight to solve.
d. There is no domestic commercial market for these 20mm, 25mm, LW30, and 30x173mm medium caliber family cartridges.
e. Although it is the DoD's policy to use reliable foreign suppliers, it is also the DoD's policy not to accept foreign vulnerability, which poses risks to national security.
f. Acquisition Data Availability: The Government owns the Technical Data Packages (TDPs) for all items being procured to Detail Specifications, as well as all cartridge Performance Specifications for all of the cartridges listed in paragraph 8. All TDPs for items being procured to Detail Specifications are either Distribution "A" (Distribution is Unlimited) or Distribution "D" (Distribution is authorized to the DoD and U.S. DoD contractors only). All TDPs for items being procured to performance specifications are contractor proprietary. However, all performance specifications are either Distribution "D" or Distribution "A".
g. For 28 of the 33 cartridges listed in Appendix A as budgeted requirements, competitive, mature TOP/Performance Specifications exist and can therefore be successfully produced by NGDS and GD-OTS. The remaining five cartridges require further restriction to either NGDS or GD-OTS as detailed below.
(i) Four of the 30x173mm cartridges listed in Appendix A: XM1182 High Explosive Airburst with Trace (HEAB-T) and its ballistic trainer, XM1173 Target Practice with Trace (TP-T), and XM1170 Armor Piercing Fin Stabilized Discarding Sabot with Trace (APFSDS-T), and its ballistic trainer, XM1172 Target Practice Discarded Sabot with Trace (TPDS-T), are being further restricted to either NGDS or GD-OTS as only one contractor is capable of meeting the Government requirements due to the unique and highly specialized key technology requirements for each set of tactical and target practice cartridges.
The following details the current status of each of these four new cartridges and the justification for the continued restriction to a single producer under this new procurement:
NGDS:
XM1182 HEAB-T: The cartridge is under development with qualification starting in 3QFY22, Milestone C in 4QFY23, and Full Materiel Release in
- upon the successful completion of Live Fire Test and Evaluation and three successful production lots. NGDS (awarded May 2020) and GD OTS (awarded April 2020) were each awarded an Other Transaction Agreement (OTA) for development of the XM1182 HEAB-T and the XM1173 TP-T. Only NGDS' design was successful. A license agreement has been signed with NGDS declaring that upon the purchase of XM 1182 HEAB-T rounds and- XM1173 TP-T rounds, through any Government contract vehicle, the U.S. Government will receive Government Purpose Rights to the XM1182 HEAB-T Technical Data. The fuze design is currently proprietary to NGDS. The Government expects to meet the XM1182 HEAB-T quantity of-cartridges in-The Government will compete the XM1182 HEAB-T amongst both contractors as soon as possible, with a current milestone of- due to the time necessary to create the TOP after receiving Government Purpose Rights.
XM1173 TP-T: The cartridge is under development with qualification starting in 3QFY22, Milestone C in 4QFY23, and Full Materiel Release prior to-· NGDS (awarded May 2020) and GD-OTS (awarded April 2020) were each awarded an OTA for development of the XM1182 HEAB T and the XM1173 TP-T, in order to keep the development of the tactical round and the corresponding trainer with the same contractor. Only NGDS' design was successful. The Government expects to meet the XM1173 TP-T quantity of-cartridges in-. The Government will compete the XM1173 TP-T amongst both contractors as soon as possible, with a current milestone of_, which is one year earlier than the XM1182 since Government Purpose Rights are already owned on the XM1173 TP-T. The TOP can be available once, per the license agreement described above, the minimum quantity of both the XM1173 and the XM1182 are purchased, which is planned for-
J&A 22-053, citing FAR 6.302-1, is currently being routed for approval to the Senior Executive Service, Senior Contracting Official to procure the XM 1182 H EAB-T and the XM 1173 TP-T, under the existing medium caliber IDIQ with NGDS, W52P1 J-18-D-0092. It is necessary to buy an additional quantity of the two rounds under the current contract, prior to the- buy under the next IDIQ, as the XM1182 and XM1173 TP-T are forecasted for award in spring of FY23 in support of thealllli fielding schedule for Infantry Carrier Vehicle Double V Hull A1 - 30mm.
GD-OTS:
XM 1170 APFSDS-T: The cartridge is under development with qualification starting in 3QFY23, Milestone C in - and Full Materiel Release in
- upon the successful completion of Live Fire Test and Evaluation and three successful production lots. The XM1170 APFSDS-T contains Depleted Uranium (DU) in the penetrator. NGDS (awarded June 2019) and GD-OTS (awarded September 2019) were each awarded an OTA for development of the XM1170 APFSDS-T and the XM1172 TPDS-T, in order to keep the development of both the tactical round and the corresponding trainer with the same contractor. NGDS notified the Government after OTA award that it would no longer produce rounds that contain DU, which led to GD-OTS being down-selected to proceed with development. NGDS further stated in its market research response that it will not compete on the XM1170 APFSDS-T for this requirement, therefore those requirements will be sole source to GD-OTS.
XM 1172 TPDS-T: The cartridge is under development with qualification starting in 3QFY23, Milestone C expected in - and Full Materiel Release anticipated in - NGDS (awarded June 2019) and GD OTS (awarded September 2019) were each awarded an OTA for development of the XM1170 APFSDS-T and the XM1172 TPDS-T, in order to keep the development of both the tactical round and the corresponding trainer with the same contractor. During the engineering and manufacturing development phase of the OTA, GD-OTS' design for the XM1170 and XM1172 were down-selected to proceed with development. The funding available did not support proceeding with XM 1172 TPDS-T designs by both contractors. The training round does not contain DU, and NGDS has the capability to produce the round; however, since the XM1172 trainer is ballistically matched to the XM1170 tactical cartridge it is advantageous to have a single contractor produce both cartridges and develop them concurrently. The Government expects that once the cartridge is through the Critical Design Review in FY22, and a finalized design is established, negotiations for Government Purpose Rights will occur. Since the terms and conditions of any such future agreement are unknown it is not possible to assign a timeline to future increased competition.
(ii) The fifth cartridge to be procured sole source is the 30x173mm Combat Mix that contains two PGU-14 D/B Armor Piercing Incendiary (API) and one PGU- 13D/B High Explosive Incendiary (HEI) cartridges. The PGU-14 within the Combat Mix contains DU in the penetrator. NGDS notified the Government in its market research response for this acquisition that it will no longer produce any items that contain DU. NGDS will not compete on the Combat Mix and therefore those requirements will be sole source to GD-OTS.
6. Efforts to Obtain Competition:
a. In accordance with FAR 5.202(a)(10), Exceptions, ACC-RI will not synopsize this action.
b. Market research was conducted via SAM.gov Contract Opportunities on 16 September 2021, for the 33 different 20mm, 25mm, LW30, and 30x173mm cartridges.
The results of the market research, which are further discussed in paragraph 8, showed that there are only two capable medium caliber producers in the U.S. and Canada.
The industry will be continuously monitored throughout this acquisition. Before adding new items, additional market research will be conducted to ensure a new manufacturer is not being excluded from the opportunity to compete within the medium caliber program.
c. GD-OTS and NGDS have historically sought competition, when practicable , for subcontracted component items to propose a competitive cartridge unit price to the Government. To be the successful awardee for the competitive delivery order competitions, both GD-OTS and NGDS are internally incentivized to continue to compete its component items. For the cartridges detailed above in paragraph 5(g), which will be acquired on a sole source basis, the resulting IDIQ contracts will contain FAR Clause 52.244-5, Competition in Subcontracting, which states that the contractor shall select subcontractors on a competitive basis to the maximum practicable extent.
7. Actions to Increase Competition: As noted in paragraph 6 above, market research will be performed each time a new medium caliber ammunition item is considered for addition to this competitive IDIQ. In addition, the Government anticipates increasing competition in the future for the following three rounds. The specific plans are outlined in paragraph 5 and are summarized below.
a. XM1182 HEAB-T: The Government intends to compete the XM1182 HEAB-T amongst both contractors in- once it has received Government Purpose Rights and created the TOP.
b. XM1173 TP-T: The Government intends to compete the XM1173 TP-T amongst both contractors in- once it has created the TOP.
c. XM1172 TPDS-T: Once the cartridge is through the Critical Design Review in FY22, and a finalized design is established, negotiations for Government Purpose Rights will occur. Since the terms and conditions of any such future agreement are unknown it is not possible to assign a timeline to future increased competition.
8. Market Research:
a. ACC-RI posted a sources sought notice (W52P1 J-21-R-MCFB) in SAM.gov Contract Opportunities on 16 September 2021 to identify potential sources capable of manufacturing the following 20mm, 25mm and 30mm cartridge configurations/ Department of Defense Identification Codes (DODIC):
