JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY (BRAND NAME)
Joint Enabling Capabilities Command (JECC) Emergency Power Station Preventative Maintenance Services

1. In accordance with (IAW) Federal Acquisition Regulation (FAR) 13.106-1(b)(1), I hereby determine that the JECC Emergency Power Station Preventative Maintenance Services is available from only one source, and competition is precluded for the reasons indicated below.
There are no substitutes available.
2. This acquisition is restricted to the following source:

3. The JECC Emergency Power Station Preventative Maintenance Services is for a 1-year base period and two 1-year option periods (1 January 2021 through 31 December 2023) for a total estimated value of and a place of performance of Building X-132 on the Naval Station (NAVSTA) Norfolk, VA.
The JECC Emergency Power Station Preventative Maintenance Services is to acquire quarterly and annual preventative maintenance service and inspection on Caterpillar (CAT) emergency power generation system, one Uninterrupted Power Supplies (UPS) unit, Automatic Transfer Switches (ATS), and switchgear/circuit breakers. These systems are managed by JECC and are located at building X-132 on NAVSTA at Norfolk, VA.
The specific equipment to be serviced under this contract is as follows:
1. CAT Engine/Generator, Model Number 3412 (800 Kilowatt serial number 9EP02081
2. ATS, Automatic Switch Company (ASCO) 7000 (Series ATS) serial number 191016
3. CAT UPS (300kVA) serial number CPZ00306
4. Specific characteristics of the Emergency Power Station Preventative Maintenance Services that limit the availability to a sole source (brand name) are due to the systems being Caterpillar proprietary with Carter Machinery Company, Incorporated, as the only authorized maintenance provider in the Hampton Roads, Norfolk, VA area to service these systems. Due to their locality, their services and emergency response is a vital component towards maintaining back-up power capabilities in an area where weather, environmental conditions and spikes in power consumption pose habitual threats to the JECC mission. An internet search at https://www.cat.com/en_US/support/dealer-locator.html of authorized Caterpillar dealers near Norfolk, VA found that Carter Machinery Company is the closest authorized dealer. Carter Machinery Company is less than six miles away and the next dealer, which is also Carter is 86 miles away. The closest non-Carter dealer is 190 miles away (in NC); which would take 3.5 to 4 hours to drive, which does not take traffic delays into account. If there were a catastrophic emergency, the service and diagnosis would not be completed in the four hour window required.
