JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD

2. Description of the Action Being Approved

Award of a Firm-Fixed-Price contract on a sole source basis for IET Labs Inc. (CAGE Code 62015) Model Number (M/N) 1433-29, Decade Resistor. The M/N 1433-29 is manufactured by IET Labs, Inc. and available from IET Lab’s authorized distributor Boneal, Inc. Authority to act under this J&A shall be effective from the date of approval to the end of the contract term.

3. Description of Supplies/Services

The Naval Air Systems Command (NAVAIR) Metrology and Calibration (METCAL) Program has a requirement for up to a quantity of 190 M/N 1433-29 to support Naval Aviation Fleet Intermediate Calibration Activities, Fleet Training Activities, and Navy Calibration Laboratories.

The IET M/N 1433-29 will be procured with a base quantity of three (3) and an option to procure an additional quantity of 182 within 365 days of contract award.

The total estimated value of this acquisition is $698,789.60 and will be funded with Aircraft Procurement, Navy (APN) funds. The table below depicts the type of funding as well as the estimated amount per fiscal year.

The certifying technical and requirements personnel have verified the Government’s minimum needs.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirements as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(ii).

5. Rationale Justifying Use of Cited Statutory Authority

NAVAIR METCAL currently has at least 14,267 annual calibration workload hours on Decade Resistor M/N 1433-29 in support of digital multi-meters, Radio Frequency (RF) Power Meters, step attenuators, variable attenuators, load cell indicators and impedance meters. The M/N 1433- 29 is a form fit and function replacement for the IET M/Ns 1433-20 and 1433-22.

The IET M/N 1433-29 is used in at least 159 Instrument Calibration Procedures (ICPs). The procurement of an alternative Decade Resistor from a manufacturer other than IET Labs would require testing, verification, and revisions to the current ICPs. The estimated cost to develop each individual ICP if a Decade Resistor other than the IET Labs model was procured is $21,285. The ICP developmental costs would require an engineering analysis, engineering certification, interval analysis, publication, and database element support. The estimated cost for selecting an alternative calibration standard would be at least $3,384,315 (159 x $21,285).

In addition to the increase in procurement cost to develop new ICPs around a Decade Resistor other than the model 1433-29, a loss of time of approximately 318 man-months or 26.5 years to field within the fleet. Each Decade Resistor ICP will take up to four (4) months to progress from start to issuance, with only two (2) ICPs being created concurrently by at most two (2) engineers assigned as the resistance metrology subject matter expert(s). No more than two (2) engineers are assigned to write ICPs for low frequency standards within the US Naval Air Systems Command so preparation of ICPs for an alternative product cannot be done faster. That total time of 318 months is derived from each of the two (2) engineers having half the workload of creating ICPs which is 79 to 80 ICPs each (79.5 ICPs per engineer x 4 months per ICP = 318 months or 26.5 years to completion). It is not possible to generate more ICPs concurrently since all ICPs have unique requirements for required equipment used in each procedure and order of steps in the process to calibrate a particular item. Currently, there is not sufficient labor funds to have additional engineers assigned to write such ICPs.

Fleet impacts if this procurement is delayed so that award does not occur prior to February 2021 will include loss of capability to calibrate Radio Frequency and Auxiliary Power equipment used to support multiple aircraft platforms including but not limited to the F/A-18 G.H and V22, during the fourth quarter of Fiscal Year 2021.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The NAVAIR METCAL Subject Matter Experts in the field who support NAVAIR METCAL are current on the trade studies and the technology environment. The Subject Matter Experts maintain constant surveillance of the marketplace for these items, and to date are unaware of any other sources that are capable of satisfying the Government’s requirements.

A synopsis of the proposed procurement will be published in the Beta Sam website and in accordance with FAR Part 12; the Government has issued a Request for Proposal (RFP) for this sole source requirement for a period of 15 days with no proposals received.

7. Determination of Fair and Reasonable Costs

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contracting Officer will use price analysis, including commercial price lists and historical information to determine that the final price to the Government is fair and reasonable.

8. Actions to Remove Barriers to Future Competition

For the reasons set forth in Paragraph 5, NAWC-AD has no plans at this time to compete future requirements for the Decade Resistors covered by this document. If another potential source emerges, NAWC-AD will assess whether competition for future requirements is feasible.
