About this file

This justification and approval document authorized a sole source bridge contract award to DynCorp International LLC for continued contractor logistics support services. The bridge contract provides organizational, intermediate, and limited depot level maintenance as well as logistics support for F/A-18C/D/E/F, EA-18G, MH-60S, E-2C/D, and F-16 A/B aircraft located at Naval Air Station Fallon, Nevada. The services under the current contract were to be transitioned to an organic maintenance organization approach, but delays in standing up that capability and in awarding a task order under the USAF Contract Field Team multiple award contract necessitated this bridge contract to ensure uninterrupted support. The eight month bridge contract with a six month option period carries an estimated total value of between $32 million to $51 million and was awarded on January 28, 2021 under NAICS code 488190 to the incumbent contractor DynCorp International LLC, the only company capable of continuing the required services without disruption.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD

2. Description of the Action Being Approved.

This Justification & Approval (J&A) authorizes and approves the award of a sole source, Indefinite Delivery, Indefinite Quantity (IDIQ) bridge contract utilizing firm fixed price task orders for aircraft maintenance and logistic services in support of the Naval Air Warfighting Development Center (NAWDC) to DynCorp International LLC, Fort Worth, TX.

3. Description of Supplies/Services.

This contract action will provide a bridge for continued Contractor Logistics Support (CLS) for Organizational, selected Intermediate, limited Depot level maintenance and logistical support services for Navy F/A-18C/D/E/F, EA-18G, MH-60S, E-2C/D, and F-16 A/B aircraft located at Naval Air Station (NAS) Fallon, NV and multiple Continental United States (CONUS) detachment operations sites. This acquisition, in support of Naval Air Systems Command (NAVAIR) Specialized & Proven Aircraft Program Office (PMA-226), Adversary Program, is to provide full life cycle acquisition and sustainment support for the Department of the Navy (DoN) Adversary assets.

The ordering period for issuing task orders on this bridge contract is anticipated to be for up to eight (8) months (01 February 2021 through 30 September 2021), with the option to extend services up to six additional months pursuant to FAR Clause 52.217-8. The total estimated value of this contract action, inclusive of the 52.217-8 option, is and is anticipated to be funded as set forth in the below table.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), one source or limited sources and Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements

5. Rationale Justifying Use of Cited Statutory Authority.

DynCorp is the only responsible source that can provide the continuity of services required without experiencing unacceptable delays in fulfilling the agency’s requirements.

DynCorp was competitively awarded current contract N00019-15-D-0001 on 11 December 2014 which includes the provision of CLS for Organizational, selected Intermediate, limited Depot level maintenance and logistical support services for Navy F/A-18C/D/E/F, EA-18G, MH-60S, E-2C/D, and F-16 A/B aircraft.

The Government has changed its strategy for the procurement of F/A-18C/D/E/F, EA- 18G, MH- 60S and E-2C/D aircraft maintenance services. These services will be converted from a CLS approach, under contract N00019-15-D-0001, to an organic maintenance organization approach at NAS, Fallon, NV. The Government will augment its organic capabilities by utilizing the United States Air Force (USAF) Contract Field Team (CFT) Multiple Award Contract (MAC) to acquire augmenting contractor maintenance personnel. The requirement for the F/A-18C/D/E/F, EA- 18G, MH-60S and E-2C/D aircraft maintenance services has been delayed due to NAWDC not standing up the organic capability in time to support these Type/Model/Services (T/M/S) aircraft. Additionally, the USAF CFT task order competition has been delayed by a major scope change for increased F-18E/F/G support and long term F-18C/D support. The USAF’s updated pre-award schedule of the CFT task order currently reflects an award date of 01 July 2021 with full performance beginning 01 September 2021, accounting for a sixty (60)-day transition period.

Additionally, the portion of the current DynCorp CLS contract supporting the NAWDC F-16A/B aircraft has recently been consolidated into a separate, new Adversary Aircraft CLS task order with F-5F/N aircraft under the Contracted Maintenance, Modification, Aircrew, and Related Services (CMMARS) MAC. The CMMARS task order was awarded on 29 May 2020 and was protested. Corrective action was taken and it was re-awarded on 13 November 2020. Additional protests were filed on 07 December 2020. The F-16A/B aircraft, supported by the current DynCorp CLS contract, will not have coverage after 31 January 2021 due to the protests filed on 07 December 2020. Therefore, a CLIN for F-16A/B support will also be included in the bridge contract.

DynCorp already has an experienced workforce available and on-site, with the understanding of the contractual requirement, platforms, and processes required to maintain performance at NAS Fallon.

DynCorp is already familiar with and is performing the desired Ready for Tasking (RFT) metric.

This bridge contract is necessary to ensure that NAWDC can continue to support operational requirements and various tactical flight-training missions to provide an adequate number of trained pilots for scheduled deployments. Awarding this sole source bridge contract to the current contractor ensures that uninterrupted performance will continue.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The proposed contract action was synopsized on the Beta SAM website on 26 March 2020 in accordance with FAR 5.201(b)(1)(ii).

The Government received no responses.

No additional market research was conducted because it is not practicable, for the reasons discussed in section 5 above, for any company other than DynCorp to provide the required supplies and services. A class waiver of the DoD Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance and Information (PGI) 206.302-1(d), Request for Information/Sources Sought requirement for Bridge contract actions was approved on 9 June 2015.

7. Determination of Fair and Reasonable Price/Cost.

In accordance with FAR 15.402(a), the Contracting Officer shall ensure that all supplies and services provided are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with sufficient information to support the accuracy and reliability of the estimate. The proposal will be reviewed by experienced technical analysts, cost analysts, and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize cost analysis as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

As noted in paragraph 5, this bridge effort is to ensure contractual coverage until the USAF can award a competitive Task Order under the CFT MAC, which is anticipated to occur in July 2021.

As noted in Section 5 above, this effort also ensures coverage for F-16 until resolution of the CMMARS protest is completed.
