About this file
This document is a FAR Part 16 Exception to Fair Opportunity Justification for a U.S. Army Mission and Installation Contracting Command (MICC) procurement at Fort Eisenhower. The Cyber Center of Excellence (CCoE) requires brand name IT components from NVIDIA, Cisco Systems, and VMware for the Brant Hall IT fit-out, with an estimated contract value of $6 million and a planned delivery date of 15 October 2025.
The procurement includes extensive hardware and software components such as NVIDIA Grid Virtual PC licenses, Cisco UCS servers, networking equipment, server components, and VMware software licenses. The acquisition will be conducted through the Army's mandatory Computer Hardware, Enterprise Software and Solutions (CHESS) ITES-3H contract vehicle. The justification emphasizes that these specific brand name items are critical for completing the IT infrastructure of a $22 million facility, ensuring compatibility with existing network architecture, and supporting the Army's training capabilities for Multi-Domain Operations in Large Scale Combat Operations.

4. Authority Cited: FAR 16.505(a)(4) – Restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer).
5. Reason for Authority Cited:
a. The Cyber Center of Excellence (CCoE) requires the brand name purchase of IT components to complete the IT fit out and back-end network for the Brant Hall Phase 1 renovation project to ultimately provide an IT training capability. The Army’s Computer Hardware, Enterprise Software and Solutions (CHESS) is a mandatory source for commercial-off-the-shelf (COTS) hardware and software, commercial IT hardware, software, services, and tactical/operational hardware requirements in accordance with Army Federal Acquisition Regulation Supplement (AFARS), Part 5139, Acquisition of Information Technology and AR 25-1, Army Information Technology. CHESS contracts provide IT products and services that comply with U.S. Army Network Enterprise Technology Command, Army and Department of Defense (DOD) policy and standards.
The equipment listed in the tables in paragraph 3 was developed in coordination with the Fort Eisenhower Network Enterprise Center (NEC) and the CCoE’s G6 as the enterprise service providers and the only approved solution for the current network architecture. Multiple ITES-3H contract holders are interested in providing the equipment identified in paragraph 3. Any deviations from the approved solution would result in significant delays in bringing facilities online and having them available for student training.
The approved solution was developed to work with numerous cyber security processes, utilize software on the software authorized products list, employ equipment on the security authorized products list compatible with existing deployed solutions, and take advantage of existing Army enterprise agreements. A key characteristic of this equipment is its designed integration with an already installed network, compatibility with currently installed infrastructure, and planned Army level initiatives. Failure to acquire the software and licensing will result in the Army rebuying and redeploying this software as Army level efforts are deployed across the force. This software licensing supports a Virtual Desktop Infrastructure (VDI) which affects training throughout the CCoE’s campus and impacts nearly 200 training environments, both classrooms and labs providing nearly 1,000 seats being unable to meet new Army security requirements. Failure to acquire the hardware will result in the inability to integrate with current automated processes and security procedures that will significantly add costs to the sustainment of the environment.
The programmed network settings and configurations have already reduced contractor support personnel needed for sustainment by 75% and a further reduction of 14 Contract Manpower Equivalent (CME)’s are estimated over the next FY with the deployment of the additional management nodes. Any changes to the approved solution would result in requirements for new Security Controls Assessment Validations at an estimated cost of $500 thousand, the delay to a renovated $22 million facility which impacts the CCoE’s force generating requirement, the phase 2 renovation of a $40 million dollar effort and an increased contract cost estimated at $750 thousand annually for the maintenance of legacy equipment, and an increased operational risk to multiple enterprises. The existing CCoE network uses similar equipment across the CCoE campus. Utilization of the approved solution will allow for the use of existing army enterprise agreements thereby reducing long-term costs with regards to maintenance and sustainment.
b. Alternatives. Alternative solutions were examined at the start of this effort but due to enterprise service providers’ cyber security requirements alternative solutions were unable to be approved for implementation.
c. Additional Supporting Information:
1) Failure to acquire these brand name items will result in a new facility valued at approximately $22 million being initially unusable for its intended training mission.
2) The facility is unclassified, but the backend licensing will apply to both unclassified and classified networks ergo the Cyber Security findings, and authorized products list for some networks are classified but the appropriate examination of alternatives was conducted via meetings.
3) Impact if justification not approved: If these specific items are not approved, the IT infrastructure for the Brant Hall facility will not be operational to absorb the CCoE student training requirements. Not procuring this brand name IT requirement disaggregates and desynchronizes the $1 billion Army effort and priority to transform and modernize the CCoE Campus, so it has the necessary capabilities to train and educate Soldiers to support Multi Domain Operations in Large Scale Combat Operations.
6. Actions to Increase Competition: This effort utilizes the Army’s mandatory source of supply and will be open to vendors capable of providing the brand name items listed in paragraph three (3) above on the ITES-3H vehicle. The notices required by FAR 5.201 will not be posted due to the exception at FAR 5.202(a)(6). Subcontracting Competition: A subcontracting plan is not required at the task/delivery order level. The contractor will be required to obtain as much competition as possible if any part of the requirement is subcontracted and give maximum opportunity to small businesses.
7. Market Research: Market research was performed within the CHESS program and multiple companies can provide these requirements. All ITES-3H contract holders that offer the brand name items in paragraph 3 above will be eligible to compete for this requirement. Multiple ITES-3H vendors have expressed verbal interest during the market research. Market research was performed by the requiring activity from
November 2023 – November 2024. The contract specialist conducted market research February – March 2025. Market research revealed that the requirement could be fulfilled through the mandatory source CHESS. The Army CHESS program is a mandatory source program for the purchase of COTS software, IT equipment (e.g.
routers & servers), services, etc., regardless of dollar value. This requirement will be given fair opportunity under Army CHESS ITES-3H as a brand name requirement.
8. Other Facts: This acquisition will use the mandatory source of supply. There is no available procurement history for these items.
