4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The Boeing Company is the original designer, developer and manufacturer of the F/A-18 E/F and EA-18G aircraft and is the only source with the requisite knowledge, experience and technical expertise to provide the MSR to establish initial outfitting for organic repair capability of the F/A-18 E/F and EA-18G aircraft. The Boeing Company is the only company that has sufficient technical data, drawings, and trained technical personnel to manufacture these items. The Government procured a Level II drawing package under contract N00383-06-D-001J D.O. 0011, however, the drawings have not yet transitioned to the Navy. The drawings are anticipated to start transitioning in 2013. Once the data is received, the Navy will have to standardized and convert to usable United States Navy (USN) performance specifications or drawings, which can take in excess of six (6) months after receipt. Another source would need the proprietary data in order to develop the required MSR equipment.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted for this procurement using Google.com, Yahoo.com and Dogpile.com and Subject Matter Expert. Market research did not identify any other source that could provide flight surface repair tooling for the F/A-18 E/F and EA-18G aircraft other than The Boeing Company. No other source has the sufficient technical data, drawings, and trained technical personnel to manufacture these items. The primary synopsis period has elapsed with no inquiries received; however the Contracting Officer will evaluate any responses received prior to award.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. An Independent Government Estimate has been provided for this effort and the Boeing Company will provide a detailed cost and technical proposal which will form the basis for negotiations. A technical review will be performed by the cognizant technical personnel to verify that the proposed labor hours and skill levels are consistent with the effort to be accomplished; that the frequency, duration and destinations of any proposed travel are necessary to accomplish the effort, and that any material or subcontracts proposed are necessary to fulfill this requirement. A Certificate of Current Cost or Pricing Data will be obtained, as required, upon the conclusion of the negotiations.
