About this file
This is a Justification for Other Than Full and Open Competition (FAR 6.103-2) for a one-time buy of spare parts by the Defense Logistics Agency (DLA) Weapons Support.
The acquisition involves 11 different valve components (regulating, linear directional control, flow control, and safety relief valves) with quantities ranging from 8 to 109 units per item. All items are classified under FSC 4820 with varying NIINs. The contract type is Firm-Fixed Price, and the supplies are required to meet the using activity's needs for spare parts that are form, fit, and functionally interchangeable with those currently used on the supported end item or weapon system. The estimated contract value falls in a range requiring Competition Advocate approval, and DLA determined that Leslie Controls, Inc. (CAGE 35795) is the sole approved source known to have the capability of meeting the Agency's urgent need. The acquisition is restricted to this single source based on design control approval and the requirement for interchangeable parts. Market research including general internet searches and procurement history review yielded no alternative suppliers capable of meeting the technical requirements. DLA conducted price analysis on each NSN to establish fair and reasonable pricing, with the main objective of negotiating a Formula Price Agreement (FPA) effective July 23, 2026 to reduce profit on the 700+ procurement line items currently in progress. The anticipated cost to the Government was determined to be fair and reasonable based on this price analysis and FPA negotiations. The award will include an unspecified delivery period, with the Contracting Officer to submit a Determination and Finding for SPE approval post-award.
