Justification and Approval for Other Than Full and Open Competition

This document is a Department of the Army Justification and Approval (J&A) for procurement of Chute, Ammunition, Flexible, 25MM (NSN: 1005-01-176-6086, Government P/N: 12328757-2, Manufacturer P/N: S255023-102) on an other than full and open competition basis.

Procurement Details and Rationale: The Army Contracting Command – Detroit Arsenal (ACC-DTA) proposes to award a new firm-fixed-price contract to Standard Armament INC (SAI), the sole authorized distributor for this item. The base contract quantity is 292 units with an option quantity of 292 units (584 total), valued at $1,622,690.72 at a unit price of $2,778.58. The justification cites 10 U.S.C. 3204(a)(1) and FAR 6.302-1(a)(2)(ii)(B), establishing that SAI is the only responsible source capable of meeting agency requirements. The primary barrier to competition is that the Government lacks the Technical Data Package (TDP) and intellectual property rights necessary for competitive procurement. The U.S. Army Combat Capabilities Development (DEVCOM) Armaments Center estimates 44 months would be required to reverse-engineer the item through contracted services, including reverse engineering, prototype development, testing, and TDP preparation. Market research conducted January 27 through February 6, 2025, including a Sources Sought Notice, yielded only two responses: SAI confirming it is the sole manufacturer and BPHE, LLC expressing capability to produce the item only with access to the TDP. Searches of mandatory sources (Ability One, GSA Advantage, UNICOR) and general market inquiries for ammunition chute manufacturers revealed no alternative suppliers. Procurement history demonstrates SAI has been the sole source since at least 2003, including prior contracts SPRDL1-18-D-0150 (awarded August 22, 2018 for $950,000) and W52H09-04-C-0100 (awarded March 30, 2004 for $436,800). The total estimated acquisition value including the base and option is $3,245,381.44. The Contracting Officer, supported by certifications from the Technical, Requirement, and Fair and Reasonable Cost determiners, approved the procurement on May 2, 2025, with the Alternate Command Advocate for Competition concurring on May 5, 2025.

CMO Control No: 2025-039

W912CH-25-R-0102

BPHE, LLC expressed interest in the Sources Sought Notice stating they have the capability and can produce Government P/N: 12328757-2, Manufacturer P/N: S255023-

102. However, even though they state they have the capability to produce the item, without the TDP they would not be able to produce it.

The Contract Specialist conducted further market research on 06 February 2025.

Mandatory sources, Ability One, GSA Advantage, and UNICOR were checked, and no results were found based on searches for the NSN and part number.

DEVCOM Engineering completed searches for NSN 1005-01-176-6086, P/N 12328757 and key words such as Ammunition Chute, flexible. The market research was completed on 27 January 2025, searching for companies that create ammunition chutes. The searches did not yield any information about possible new sources for Ammunition Chute, flexible P/N 12328757-2.
